(EXTRA.), FEB. 26, 2021 (PHGN. 7, 1942 SAKA) 173 [Authorised English Translation] HARYANA GOVERNMENT DEPARTMENT OF SPORTS AND YOUTH AFFAIRS Notification The 26th February, 2021 No. G.S.R. 4/Const./Art. 309/2021.— In exercise of the powers conferred by the proviso to article 309 of the Constitution of India, the Governor of Haryana hereby makes the following rules regulating the recruitment and conditions of service of persons appointed to the Haryana Outstanding Sportspersons (Group A, B and C) Service, namely:- 1. (1) These rules may be called the Haryana Outstanding Sportspersons (Group A, B and C) Service Rules, 2021. (2) They shall come into force from the date of their publication in the Official Gazette. (3) These rules shall be applicable to the outstanding sportsperson appointed under these rules. Short title, commencement and application. 2. In these rules, unless the context otherwise requires:- (a) “cadre” means an Outstanding Sports Person Cadre (OSP Cadre) created under these rules; (b) “competent authority” means the Chief Secretary to Government, Haryana in General Administration Department. (c) “Director” means the Director, Sports and Youth Affairs, Haryana; (d) “extraordinary performance” means a performance of an outstanding sportsperson who has won a medal for India in,- (i) Olympic Games organized by the International Olympic Association; or (ii) Asian Games organized by the Asian Games Council; or (iii) World Cup or World Championships organized by the concerned international federation once every four years in events included in the Olympic Games only; (e) “Form” means the Form appended to these rules; (f) “Government” means Government of Haryana in the administrative department; (i) any institution established by law in force in the State of Haryana; or (ii) any other institution recognized by Government for the purpose of these rules; (h) “National Sports Federation” means a registered national level sports body, known as a Federation or in any other name, duly recognized by the Ministry of Youth Affairs and Sports, Government of India; (i) “person” means an outstanding sportsperson who won medal or participated in sports tournament as mentioned in Schedule-I and Schedule-II whether before the commencement of these rules or thereafter; (j) “provisional appointment” means appointment to a post by direct recruitment subject to obtaining requisite educational qualifications prescribed for the same within requisite period admissible under these rules, failing which the appointment shall stand terminated; (k) “recognized university” means – (i) any university incorporated by law in India; or (ii) any other university which is declared by the Government to be a recognized university for the purpose of these rules; (l) “Schedule” means a Schedule appended to these rules; (m) “Service” means Haryana Outstanding Sportspersons (Group A, B and C) Service; (n) “sports tournament” means a tournament where there is no age restriction in participation; and (o) “State” means the State of Haryana; Definitions. 174 HARYANA GOVT. GAZ. (EXTRA.), FEB. 26, 2021 (PHGN. 7, 1942 SAKA) PART-II-RECRUITMENT TO SERVICE Number and character of posts. 3. The Service shall comprise the posts shown in Appendix-A to these rules: Provided that nothing in these rules shall affect the inherent right of the Government to make additions to, or reductions in, the number of such posts or to create new regular posts with different designations and scales of pay. Nationality and domicile of candidates appointed to Service. 4. No person shall be appointed to any post in the Service, unless he: (a) is a citizen of India; (b) is a resident of Haryana possessing a Resident Certificate issued by the concerned authority; (c) (i) has represented the State of Haryana at the national level or has represented the Central Government or any Central Public Sector Undertaking, at National level tournament; (ii) has represented India in any sports tournament as mentioned in Schedule-I and Provided that a person shall be eligible for appointment under these rules within ten years of winning a medal or participating in sports tournament as mentioned in Schedule-I and Schedule-II. Age. 5. No person shall be appointed to any post under these rules, who is less than 18 years or more than 42 years of age on the last date of submission of application complete in all respects: Provided that in the case of person belonging to Scheduled Caste, Backward Classes, person with disabilities, ex-serviceman, relaxation in upper age limit shall be admissible as may be fixed by the Government, from time to time. Appointing authority. 6. Appointment to the posts in the Service shall be made by the appointing authority specified in column 3 of Appendix-C of these rules. Outstanding sportsperson cadre. 7. Posts listed in column 2 of Appendix-C of these rules shall constitute the Outstanding Sportsperson Cadre and shall be designated with the words “OSP” in parenthesis after the name of the post. Eligibility. 8. (1) The name of a person shall be considered for appointment to a post, in case of an individual event as per provision in Schedule-I and in case of a team event as per provision in Schedule-II of these rules, subject to fulfillment of other conditions of eligibility : Provided that in the case of (a) 4 Years World Cup/ Championship, (b) World Cup/ Championship (Less than 4 Years), (c) 4 Years Asian Championship, (d) World University Games, (e) Special Olympics, (f) Deaflympics/ 4 Years deaf World Cup/ Championship/ 4 Years Para World Cup/ Championships, sports events only included in the Olympic Games shall be considered, except Circle Kabaddi. (2) In case of a team event, a person shall be considered for appointment to a post as per Schedule-II, provided that he has participated in not less than fifty percent of the matches played by the team in that tournament. (3) A person shall be appointed on regular basis by direct recruitment to a post for which he is eligible under these rules, provided he is in possession of requisite qualifications and experience specified in column 3 of Appendix-B to these rules. A person who does not possess the requisite qualifications and experience shall be appointed on provisional basis: Provided he has obtain the requisite educational qualification within the minimum period required for the same alongwith an additional period of two years, failing which the provisional appointment shall be stand terminated. (4) On obtaining the requisite educational qualification as per sub-rule (3), the provisional appointment shall be converted to “appointment on regular basis” with effect from the date of declaration of result by the recognized university or institution. (5) In case of extraordinary performance by a person, relaxation in the educational qualification may be granted by the competent authority on the recommendations of the committee to be constituted by Government under the Chairmanship of Minister-in-charge for this purpose; however, no relaxation shall be admissible in case of Hindi or Sanskrit or as one of the subjects in matric or higher education. No person- (i) (a) who has entered into or contracted a marriage with a person having a spouse living; or (b) who having a spouse living, has entered into or contracted a marriage with any person, shall be eligible for appointment to any post in the Service: Provided that the Government may, if satisfied, that such marriage is permissible under the personal law applicable to such person as well as to the other party to the marriage and there are other grounds for doing, so exempt any person from the operation of this rule. (ii) he has any subsisting contract for pecuniary gains like commercial endorsement or professional sports; and (iii) he is guilty of sports related misconduct like doping, sexual harassment and abuse, competitive manipulation like betting, inside information, match fixing, tanking and threatening the integrity and essence of sports. Non-eligibility for appointment. 10. (1) Recruitment to the Service shall be made,- (a) in the case of Deputy Director (OSP),- (i) 50% by direct recruitment; and (ii) 50% by promotion amongst Senior Coach (OSP); (b) in the case of Senior Coach (OSP), by promotion from amongst the Coach (OSP), (c) in the case of Coach (OSP),- (i) 50% by direct recruitment; and (ii) 50% by promotion amongst Junior Coach (OSP); (d) in the case of Junior Coach (OSP) by direct recruitment. (2) All promotions shall, unless otherwise provided, be made on seniority-cum-merit basis and seniority alone shall not confer any right to such promotion. Mode of recruitment. 11. (1) An eligible person shall submit an application complete in all respects in Form-1 in case of individual event and in Form-II in case of team event along with proof of outstanding sports achievement duly signed by the President or Secretary General of the National Sports Federation of the concerned game, date of birth and such other additional information as may be sought by the State Government. (2) The Director shall forward the applications to the Government for appointment to a post admissible under these rules after verification of original documents within 30 days of receipt of application from a person. (3) The Government shall forward the case to the competent authority for approval. On the receipt of approval from the competent authority, the appointing authority shall issue the letter of appointment on regular or provisional basis, as the case may be. (4) The Government reserves the absolute right to revise, from time to time, Form-I or Form-II by an order issued with the approval of competent authority. Procedure for appointment. 12. (1) The probation period of a person shall commence from the date of his appointment on regular basis or provisional basis, as the case may be, by direct recruitment or from the date of his appointment by promotion. (2) A person appointed by direct recruitment shall be on probation for a period of two years and in case of appointment by promotion will be on probation for a period of one year. Provided that,— (a) any period, after such appointment, spent on deputation on a corresponding or a higher post shall count towards the period of probation; (b) any period of work in equivalent or higher rank, prior to appointment to any post in the Service, may, at the discretion of the appointing authority, be allowed to count towards the period of probation fixed under this rule. Probation. 176 HARYANA GOVT. GAZ. (EXTRA.), FEB. 26, 2021 (PHGN. 7, 1942 SAKA) (3) If, in the opinion of the appointing authority, the work or conduct of a person during the period of probation is not satisfactory, it may,- (a) if such person is appointed by direct recruitment, dispense with his services; and (b) if such person is appointed otherwise than by direct recruitment,- (i) revert him to his former post; or (ii) deal with him in such other manner as the terms and conditions of the previous appointment permit. (4) On the completion of the period of probation of a person, the appointing authority may,- (a) if his work or conduct has, in its opinion, been satisfactory and he possess the requisite qualification and experience, confirm such person from the date of his appointment on regular basis or provisional basis as the case may be; (b) if his work or conduct has, in its opinion, been not satisfactory.— (i) dispense with his service, if appointed by direct recruitment; or (ii) revert him to his former post or deal with him in such other manner as the terms and condition of his previous appointment permit, if appointed otherwise; or (iii) extend his period of probation for a period of one year and thereafter pass order, as it could have passed on the expiry of the first period of probation: Provided that the total period of probation, including extension, if any shall not exceed three years. Seniority. 13. Seniority, inter se of members of the Service shall be determined by the length of continuous service on any post in the Service: Provided that the length of continuous service on any post in the Service shall be determined from the date of provisional appointment or appointment on regular basis, as the case may be, to such a post: Provided further that in the case of a member appointed by direct recruitment, the order of merit determined by the competent authority shall not be disturbed in fixing the seniority: Provided further that in the case of two or more member appointed on the same date, their seniority shall be determined as follows:- (a) a member appointed by direct recruitment on regular basis shall be senior to a member appointed by promotion; (b) in case of a member appointed by promotion, seniority shall be determined according to the seniority of such members in the appointment from which they were promoted. Liability to serve. 14. (1) A member of the Service, whether appointed on regular basis or on provisional basis, shall serve at any place, whether within or outside the State, on being ordered so to do by the appointing authority. (2) A member of the service shall be liable to serve in the Department of Sports and Youth Affairs of the State Government in any district in Sports Complexes or Sports Academies or Centres of Excellence in Sports established by the State Government and also in the Home (Police), School Education or Elementary Education Departments, State Electricity Utilities or Development and Panchayats Department or Public Sector Undertakings of the State Government. (3) A member of Service may be deputed to serve under,- (i) a company, an association or a body of individuals whether incorporated or not, which is wholly or substantially owned or controlled by the State Government, a Municipal Corporation or a local authority or University within the State of Haryana; (ii) the Central Government or a company, an association or a body of individuals, whether incorporated or not, which is wholly or substantially owned or controlled by the Central Government; or (iii) any other State Government, an international organization, an autonomous body not controlled by the Government, or a private body: Provided that no member of the Service shall be deputed to the Central or any other State Government or any organization or body referred to in clauses (ii) or (iii) except with his consent. In respect of pay, leave, pension and all other matters not expressly provided for in these rules, the members of the Service shall be governed by such rules and regulations as may have been, or may hereafter be, made by the competent authority under the Constitution of India or under any law for the time being in force made by the State Legislature. Pay, leave, pension and other matters. 16. (1) In matters relating to discipline, penalties and appeals, members of the Service shall be governed by the Haryana Civil Services (Punishment and Appeal) Rules, 2016 as amended from time to time: Provided that the nature of penalties which may be imposed, the authority empowered to impose such penalties and the appellate authority shall, subject to the provisions of any law or rules made under article 309 of the Constitution of India, be such as are specified in Appendix-C to these rules. (2) The authority competent to pass an order under clause (c) or clause (d) of sub-rule (1) of rule 9 of the Haryana Civil Service (Punishment and Appeal) Rules, 2016 and appellate authority shall be as specified in Appendix-D to these rules. Discipline, penalties and appeals. 17. Every member of the Service shall get himself vaccinated and re-vaccinated as and when the Government so directs by a special or general order. Vaccination. 18. Every member of the Service, unless he has already done so, shall be required to take the oath of allegiance to India and to the Constitution of India as by law established. Oath of allegiance. 19. Where the Government is of the opinion that it is necessary or expedient to do so, it may, by order, for reasons to be recorded in writing, relax any of the provisions of these rules with respect to any class or category of persons. Power of relaxation. 20. Notwithstanding anything contained in these rules, the appointing authority shall be competent to impose additional or special terms and conditions in the order of appointment, whether on regular basis or on provisional basis, if it is deemed expedient to do so. Special provisions. 21. (1) The Haryana Outstanding Sportspersons (Recruitment and Conditions of Service) Rules, 2018 are hereby repealed. (2) Notwithstanding such repeal, anything done or any action taken under the said rules so repealed, shall be deemed to have been done or taken under the corresponding provisions of these rules: Provided that a sportsperson whose application is pending under the repealed rules shall be eligible to apply afresh under these rules.
