Regarding exemption from Central Gratuity Act-1972 for employees of District Legislative Class-3 and Class-4

No. MISC-5019/C.R.69/EST.10.—The following draft of rules further to amend the Maharashtra Zilla Parishads District Services Rules, 1968, Which the Government of Maharashtra proposes Act, 1961 to make in exercise of the powers conferred by clause (xxxvii) and (xxxix) of sub-section (2) of section 274 of Maharashtra Zilla Parishads and Panchayat Samitis Act, 1961, (Mah.V of 1962) and of all other powers enabling it in that behalf, is hereby published as required by sub-section (3) of section 274 of the said Act, for the information of all the persons likely to be affected thereby; and a notice is hereby given the said draft rules will be taken in to consideration by the Government of Maharashtra on or after the 9th of September, 2023. 2. Any objection or suggestion which may be received by the Principle Secretary, Rural Development and Panchayat Raj Department, Bandhakam Bhavan, 25, Marzban Path, Fort, Mumbai 400 001, from any person with respect to the said draft before the aforesaid date, will be considered by the Government. DRAFT RULES 1. These rules may be called the Maharashtra Zilla Parishads District Services (First Amendment) Rules, 2023. 2. In rules (6) of the Maharashtra Zilla Parishads District Service Rules, 1968, to sub-rule (1), the following proviso shall be inserted, namely :— “Provided that, the provisions of the Maharashtra Civil Services (Pension) Rules, 1982 shall not apply to the Parishad employee, to whom the provisions of the Payment of Gratuity Act, 1972 (39 of 1972) are applicable” This Rules applicable retrospectively.
