EXTRAORDINARY PUBLISHED BY AUTHORITY No. 5018] NEW DELHI, THURSDAY, NOVEMBER 10, 2022/KARTIKA 19, 1944 MINISTRY OF ENVIRONMENT, FOREST AND CLIMATE CHANGE NOTIFICATION New Delhi, the 10th November, 2022 S.O. 5237(E).—In exercise of the powers conferred by sub-section (1) read with clause (v) and clause (xiv) of sub-section (2) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986), and sub-rule (4) of rule 5 of the Environment (Protection) Rules, 1986, the Central Government hereby makes the following amendments in the notification of the Government of India in the Ministry of Environment, Forest and Climate Change, published, vide notification number S.O. 2364 (E), dated the 4 th October, 2012, namely:— In the said notification, — (I) in paragraph 2, – (a) in sub-paragraph (i), for the words, ―Central Government in the Ministry of Environment and Forests‖, the words ―State Government for its effective implementation‖ shall be substituted; (b) in sub-paragraph (viii), for the words, ―approval thereof by the Ministry of Environment and Forests‖, the words ―approval thereof by the Competent Authority of the State Government‖ shall be substituted; (II) in paragraph 3, in sub-paragraph (5), the words ―and approved by the Ministry of Environment and Forests‖ shall be deleted; (III) in paragraph 4, – (a) in sub-paragraph (2),- (i) in item (iv), the words ―to be nominated by the Ministry of Environment and Forests, Government of India‖ shall be deleted; (ii) in item (vi), the words ― to be nominated by the Ministry of Environment and Forests, Government of India‖ shall be deleted; (b) in sub-paragraph (4), for the words, ―Ministry of Environment and Forests for prior clearances‖, the words ―Ministry of Environment, Forest and Climate Change or the State Environment Impact Assessment Authority, Karnataka, as the case may be, for prior clearances under the provisions of the said notification.‖ shall be substituted.
