(ii) They shall come into force on the date of their publication in the Official Gazette and the pay scales prescribed in Column 4 of the Schedules annexed hereto in para 6 below shall come into effect from the date prescribedgin the Central Civil Services (Revised Pay) Rules, 2008, as amended from time to time. I In Regulation 12 of the National Highways Authority of India (Recruitment, Seniority and Promotion) Regulations, 1996 (hereinafter referred to as the principal regulations), after clause (6), the following clauses shall be inserted, namely:- “(7) In case of selection of officers belonging to the Central Road Research Institute (CRRI); Central Public Works Department (CPWD); Corps of Engineers, Indian Army; Border Roads Organisation (BRO); Military Engineering Services (MES); Central / State Government Departments and Central / State Public Sector Undertakings, who carry the similar pay scales in CDA pattern as applicable to Central Government employees and possess the requisite qualification and experience prescribed for the posts, the requirement to advertise the vacancies and screening of applications through the Screening Committee shall be dispensed with. “(8) In case of selection of officers to the post of Deputy Manager (Technical) by direct recruitment through campus recruitment, the requirement to advertise the vacancies and screening of applications through the Screening Committee shall be dispensed with.” 3. In sub—regulation (5) of the regulation 13 of the National Highways Authority of India (Recruitment, Seniority and Promotion) Regulations, 1996 (hereinafter referred to as the principal regulations), for the clauses (b), (d), (g) and (h), the following clauses shall be substituted, namely:- .- “(b) At least two years of continuous service on deputation basis_in the Authority in the post for which the officer seeks absorption. (d) Consent of the cadre controlling authority in parent department. Provided that this condition may be dispensed-with in case of officers or employees whose resignation / voluntary retirement has been accepted by the parent department. (g) The officer should be less than 55 years of age as on 15' day of January of the year in which the officer is being considered for absorption and should have at least 5 years of residual service as per age for superannuation prescribed in Regulation 10 of the NHAI (Recruitment, Seniority and Promotion) Regulations, 1996, as amended from time to time. (h) For officers who are already on deputation, vigilance clearance from Vigilance Division ofNHAI will be required.” 4. In the principal regulations, for regulation 15, the following regulation shall be substituted, namely:— “15. Seniority — (1) There shall be a separate categories of post-wise seniority list for all posts in different disciplines. (2) In case of selection of officers or employees by direct recruitment / direct recruitment through lateral entry, their seniority shall be in the order in which they are recommended by the Selection Committee. For the rest proviso (3) below will apply. I (3) The seniority of officers and employees of the Authority shall be determined on the basis of the instructions and guidelines issued by the Central Government (Department of Personnel & Training), from time to time. (4) A copy of the respective seniority list shall be supplied to each officer and employee. (5) In case of any dispute regarding inter-se seniority of officers in the respective seniority list, the decision of the Chairman shall be final.” 5. Afier regulation 21 of the principal regulations, the following regulation shall be inserted as regulation 22, namely:- “22. Residuary matters — In regard to matters not specifically covered by Regulations made under Section 35 of the Act or any general, or special orders made or issued thereunder, the service conditions of the officers and employees of Authority shall be governed by the rules applicable to the employees of the Central Government in general and instructions issued by the Central Government, from time to time.” I 6. In the Schedule to the principal regulations, the Schedule prescribing the eligibility criteria and qualifications for the following posts shall be substituted, namely:- “Deputy Manager (Technical)” Assistant Manager (Administration).” RAJIV YADAV, Member (Administration) [ADVT III/4/122/12/Exty.] Footnote: The principal regulations were published vide notification No.NHAR-12011/l/95—Admn., dated 11‘h March, 1996, in the Gazette of India, Extraordinary, Part III, Section 4, dated the 11‘“ March, 1996 and last amended vide notification No.NHAI/1101 l/l7/2012-HR.I(Vol.I), dated 23rd July, 2012, published in the Gazette of India, Extraordinary, Part III — Section 4, dated the 24'“ July, 2012. Examination (Civil) conducted by Union Public Service Commission (UPSC); Essential:- Degree in Civil Engineering from a recognized University or equivalent. and possessing essential educational qualification prescribed in Column 7. OR (2) By deputation from officers of Central Engineering Service (Roads) of Ministry of Road Transport & Highways holding the post of Assistant Executive Engineer (Civil) on regular basis g from the officers holding equivalent posts carrying similar pay scale in CDA pattern in the Central / State Government Departments or Central / State Public Sector UndErtakmgs on regular basis and possessing essential educational qualification prescribed in column 7.’ Period of deputation Not more than three years but may be extended/ curtailed with the approval of the Competent Authority.
