G.S.R. 334(E) Environment (Protection) Rules, 1986

EXTRAORDINARY PUBLISHED BY AUTHORITY No. 319] NEW DELHI, WEDNESDAY, MAY 4, 2022/VAISAKHA 14, 1944 MINISTRY OF ENVIRONMENT, FOREST AND CLIMATE CHANGE NOTIFICATION New Delhi, the 4th May, 2022 G.S.R. 334(E).—In exercise of the powers conferred by sections 3 and 6 of the Environment (Protection) Act, 1986 (29 of 1986) read with rule 13 of the Environment (Protection) Rules, 1986, the Central Government hereby makes the following rules to amend the Lead Stabilizer in Polyvinyl Chloride (PVC) Pipes and Fittings Rules, 2021, namely:- 1. Short title and commencement. - (1) These rules may be called the Lead Stabilizer in Polyvinyl Chloride (PVC) Pipes and Fittings (Amendment) Rules, 2022. (2) They shall come into force six months from the date of notification in the Official Gazette. 2. In the Lead Stabilizer in Polyvinyl Chloride (PVC) Pipes and Fittings Rules 2021 (hereinafter referred to as the said rules), in rule 2,- (a) in sub-rule(1), for the words, brackets and figure ―provided in column (3)‖, the words, brackets and figure ―provided in column (4)‖, shall be substituted; (b) for sub-rule (2), the following sub-rule shall be substituted, - ‗(i) The manufacturer shall submit water test report of pipes and fittings carried out by authorised agencies for testing as per sub-rule (1) of rule 4, to respective State Pollution Control Board or Pollution Control Committee in accordance with the consent to operate granted by respective State Pollution Control Board or Pollution Control Committee subject to the provision of the Water (Prevention and Control of Pollution) Act, 1974 (6 of 1974): Provided that the manufacturer having valid licence from Bureau of Indian Standards for manufacturing of all such Polyvinyl Chloride Pipes and Fittings, and having all such Polyvinyl Chloride Pipes and Fittings marked with "Standard Mark" in accordance with the specification provided in the Licencse issued by the Bureau of Indian Standards, shall be exempted from submission of such test report. (ii) Every manufacturer and every importer of Polyvinyl Chloride Pipes and Fittings for every product under the respective Category A, B, and C specified in the Schedule shall comply with the conditions mentioned in that Schedule with respect to IS code of Bureau of Indian Standard or equivalent which are presently available or shall be developed in the future. Explanation.- For the purposes of this rule and rule 3, ―manufacturer‖ means manufacturer of Polyvinyl Chloride Pipes and Fittings situated within the territory of India or outside the territory of India‘. 3. In rule 3 of the said rules, in sub- rule (3), for the words ―A Panel‖, the words ―A Panel including a representative from manufacturer‖, shall be substituted. 4. In rule 4 of the said rules, for sub- rule (1), the following sub-rule (I) shall be substituted namely:- (I) ―The Laboratories accredited by National Accreditation Board for Testing and Calibration Laboratories shall be authorised to carry out such tests as are necessary to ascertain the compliance of rule 2‖. 5.
