(a?) ,-qftÿÿR ark if Rÿfoi ; ; ‘ ■»K'ti; ’fli=t>l{ for 'Jilt'll I INDIAN COUNCILOF WORLD AFFAIRS NOTIFICATION New Delhi, the 25th March, 2C08 No. F(li)/12(13)/20d7.— In exercise of the powers conferred by sub-section (3) of Section 26 of the Indian Council of World Affairs Act, 2001 (29 of 2001), the Governing Body of the Indian Council of World Affairs ereby makes the following regulations, namely :— «r---- - ~ 1. Short title and commencement—(1) These regulations may be called the Indian Council of World Affairs Regulations, 2007. v (2) They shall come into force on the day of their publication in the Official Gazette. 2 Definitions,— In these regulations, unless the context otherwise requires,— . Act, 2001 (29of 2001); : (b) "Chairperson” means Chairperson of the Governing Body of the Indian Councilof World Affairs; • , i (c) “Council” means the Indian Council of World I Affairs incorporated under Section 4of the Act; I (d) “Director General” means the Director General and the Chief Executive Officer of the Council; . (e) “Governing Body” means the Governing Body of the Council; (f) “Member”' means a member of the Governing Body and includes its Chairperson; (g) “PresSent” means the President of the Council; (h) “Vice-President” means the Vies Presidents of the Council; (i) “Standing Committee” and “Ad-hoc Committee” means the standing and ad-hoc committees constituted under sub-section (5) of Section 14 of the Act. 3. Msec.: j 1 Council.—(!) Every meetingshall sided over by . i Chairperson. (2) The Council shall meetat least once every yearat a place and on a date tobe fixed by the President. ■ • ' (3) The President may call a special meeting at any time on his own initiative or on the request made by not less than fifteen members of the Council. (4) Each member of the Council shall be given ai least fourteen days’ notice in writing of every meeting of the Council. ' ' present and voting in a meeting shall form the quorum. (6) Minutes of the meeting shall be recorded by the Secretary of the Council and with the approval of the Chairperson shall be circulated to the members. 4. The Governing Body of theCouncil—Subject to the provisions of the Act, the Governing Body of the Council shall have the following powers and functions, namely;— (a) to exercise the executive authority of the Council subject to the policy directives of the Council; (b) to formulate programmes and specific projects for submission to the Council; . (c) to approve the annual budget of the Council subject to the financial limit fixed by the.Centra! Government In this behalf and, to submit the' same to the Council for its adoption;, . . ". .. i (d) . to approve the annual report and .accounts of the Council and submit the same to the Council for its adoption; ‘ (e) to nominate ; eminent persons and the representatives- of various organisations to be members of the Council, in accordance with the provisions of clauses (g) and (h) of sub-section x (2) of Section 7 of the Act; • . , < (f) to approve the appointments of the at the staff. 5. Powers and functions of Chairperson,—Subject to the provisions of the Act, the Chairperson of the" Governing Body of the Council shall have the following powers and functions, namely :— (a) to preside over meetings of the Governing Body; (b) to advise and provide guidance to the Governing Body on policy matters in accordance with thi policy and guidelines of the Council. 6. Procedure to be followed by the Governing Body in exercise of its powers and discharge of its functions.-ÿ (1) The Governing Body shall meet at feast pmg, every year at a place and on a date to be fixed by the Chairperson. (2) Special meetings may be called by the Chairperson on his own initiative or at the request received ' - in writing from at least two-third of the members of the Governing Body. (3) Six members of the Governing Body shall form the quorum. (4) Minutes of the meeting shall be recorded by the Secretary of the Governing Body and after approval of the Chairperson it shall be circulated to the Members. 7. Term of office and filling of vacancies.—(1)The members of the Governing Body, except where otherwise provided, shall hold office for a period of three years from the date of his nomination by the Council and shall be eligible for re-appointment (2) Amemberof the Governing Body shall hold office for so long as he is the member of the Council. (3) Any casual vacancy in the office of a member of the Governing Body shall be filled up by fresh nomination and such member shall contiune for the remainder of the term of the member in whose place he is nominated. (4) The nominations, to fill the ;vacancy in the Governing Body, caused by the expiration of the term of office;pf a member of the Council shall'be made!before the expiration of the term of office. (5)1TheDirector General shall, before four months of the. expiration of the tern of office of the member, take appropriate action for filling up of the vacancy. (6) The Nomination to fill a casual vacancy shall be made as soon as possible after the date of occurrence of such vacancy. 8. Allowances of Chairperson and members of Governing Body,— -The allowances of Chairperson and members of the Governing Body and its committees or ad hoc committees shall be the same as are admissible to a member of the Council under rule6of the Indian Council of World Affairs Rules, 2006, as amended from time to time. General 3hall be the Chief Executive Officer of the Council and shall be appointed by the Councilin accordance with the provisions of Section 15 of the Act and he shall be under the administrative control of the President of the Council. (2) It shall be the duty of the Director General— (a) to ensure that the accounts and issdts of the Council are maintained in proper order in accordance with the provisions of the Act and rules or regulations made thereunder; (b) to execute contracts on behalf of the Council; (c) to formulate and present the programme of the activities and budget estimates to the Governing Body of the Council in consultation with the Financial Advisor of the Council; (d) to conduct official correspondence on behalf of the Council and its agencies as necessary; (e) to issue notices convening meetings pf the Council, its Governing Body and other Committees and to record minutes of these meetings; (f) to exercise such other powers as may be delegated or assigned to him by the Council, the Governing Body or the President of the Council. 10. Conditionsof service of Director General and other officers and employees of Council.—The conditions of service in respect of the Director General and other officers and employees of the Council shall be regulated in accordance with the regulations made by the Council in this behalf with prior approval of the Central Government in accordance with the provisions of the Act. 11. Creation of Posts.—Creation of posts, their classification into various grades and desigantions and scales of pay and allowances attached thereto, shall be such as may be.specified by regulations by the Council with the prior approval of the Central Government in accordance with the provisions of the Act. 12.
