UTTAR PRADESH SHASAN Sukshm, Laghu Evam Madhyam Udyam Anubhag -2 In pursuance of provisions of clause (3) of Article 348 of the Constitution, the Governor is pleased to order the publication of the following English translation of Government notification no.2/2023/09/18-02- Notification Order Lucknow Dated, 20 March, 2023 In exercise of the powers under clause (a) of sub-section (1) of section 9 of the Indian Stamp Act. 1899 (Act no. 2 of 1899) as amended from time to time in its application to Uttar Pradesh read with section 21 of the General Clauses Act, 1897 (Act no. 10 of 1897) the Governor is pleased to remit with effect from the date of publication of this notification in the Gazette, the stamp duty to the extent shown in column-3 of the Schedule below, chargeable in respect of the instruments as shown in column-4 of the said Schedule for the purpose provided in paragraph 5.1.6.2 and sub-paragraph 5.3.3.1, 5.3.3.2, 5.3.3.3 and 5.3.3.4 of paragraph 5.3.3 of the Uttar Pradesh Micro Small and Medium Enterprises Promotion Policy- 2022 of the state as mentioned in Column-2 of the Schedule below. SCHEDULE Paragraph of the Policy Purpose and other Detail Extent of remission Nature of Instrument and Article number of Paragraph 5.1.6.2 of Micro Small and Medium Enterprises Promotion Policy-2022 On the purchase of land by the developer of the private sector, for MSME Industrial Park/Estate/Flatted Factory Complex units of 10 acres or more area in the state, The Stamp duty will be exempted- Conveyance, Under clause (a) of Article 23. In the Paragraph 5.3.3 of Micro Small and Medium Enterprises Promotion policy-2022 For the establishment of industrial units of Micro, Small and Medium Enterprises in the state, the Stamp duty will be exempted- Conveyance, Under clause (a) of Article 23 and Lease under Article (1) in Bundelkhand & Poorvanchal. (1) 100% and (2) in Madhyanchal & Paschimanchal (except Gautambuddhnagar & Ghaziabad districts). (3) in Gautambuddhnagar & Ghaziabad districts. (4) For women entrepreneurs anywhere in the state 2. Under the above paragraphs 5.1.6.2 and 5.3.3 of Uttar Pradesh Micro Small and Medium Enterprises Promotion policy-2022, Bank guarantee equivalent of the amount to the exemption of stamp duty received by the investing unit will be deposited, which will be released after the unit starts commercial production. The starting of commercial production will be confirmed by the District Magistrate of the district or the General Manager, District Industries Center. 3. The exemption under this notification shall be available if the District Magistrate or the General Manager, District Industries Centre of the concerned district shall sign such instrument as witness for the purpose of confirming the fact that the transfer is being executed under the said policy. Explanation- For the purpose of this notification : "Purvanchal" shall include the revenue divisions of Allahabad, Varanasi, Mirzapur, Azamgarh, Basti, Gorakhpur, Faizabad and Devipatan. "Madhyanchal" shall include the revenue divisions of Lucknow and Kanpur. "Bundelkhand" shall include the revenue divisions of Chitrakoot Dham and Jhansi. "Paschimanchal" shall include the revenue divisions of Agra, Aligarh, Moradabad, Meerut, Saharanpur and Bareilly. By Order, Amit Mohan Prasad Additional Chief Secretary
