In exercise of the powers under section 26-X of the Uttar Pradesh Krishi Utpadan Mandi Act 1964,(U.P. Act no XXV of 1964) the State Agricultural produce market board, Lucknow, makes, with the previous approval of the State Government, the following regulations: THE UTTAR PRADESH AGRICULTURAL PRODUCE MARKETS BOARD (OFFICERS AND STAFF ESTABLISHMENT) REGULATIONS, 1984 CHAPTER-I GENERAL Short title and commencement Gazette.: 1. (i) These Regulations may be called the Uttar Pradesh Agricultural Produce Markets Board (Officers and Staff Establishment) Regulations, 1984. (ii) They shall come into force with effect froin the date of their publication in the Gazette.: Defenitions 2. (1) In these regulation- 1[(a) "Additional Director", "Joint Director", and "Deputy Director (Administration/ Marketing)" means Additional Director, Joint Director (Administration/Marketing) and Deputy Director (Administration/ Marketing) of Mandies.] (b) "Board" means the State Agricultural Produce Markets Board, Lucknow constituted under section 26-A the Act. (c) "Class" means a class of posts referred to in Regulation 5. (d) "Director" means the Director of Mandies. (c) "Employee" means every person appointed on whole time basis in classes A, B, C and D mentioned in regulation 5, whether on con-tract basis, on deputation or otherwise but does not include persons employed on daily wages, work charged and on part-time basis. (f) "Pay" means the amount drawn by an employee of the Board and includes his:- (i) Basic pay which has been sanctioned to him for the post held by him substantively, or in a temporary or officiating capacity. (ii) Special pay, deputation pay and personal pay. (iii) Any other emoluments or allowances which may be specially classed as pay by the Beard but does not include dearness allowances, overtime allowance, 1 Substituted by The Uttar Pradesh Agricultural Produce Markets Board (Officers And Staff Establishment) (Eleventh Amendment) Regulations, 2022. travelling allowance, conveyance allowance, medical allowance, city compensatory allowance, house rent allowance, washing allowance or the like. (j) "Service" means service under the Board. (h)"Substantive appointment" means an appointment, not being an ad-hoc appointment, on a post in the cadre of the service, made after selection in accordance with these regulations. (i) "Year of the recruitment" means period of 12 months commencing from the 1st day of July of a calendar year. Applicability. 3. (1) Subject to the provisions of sub-regulation (2) these regulations shall apply to all employees who are in the service of the Board. (2) Employees on deputation and on contract shall be governed by the term and conditions of their deputation or contract. CHAPTER-II Strength of the Officers and Staff 1[4. (1) The strength of the officers and staff and of each category of posts therein and the scales of pay shall be such as may be determined by the Board from time to time. Provided that scales of pay shall be such as may be recommended from time to time by the Pay Commission and approved by the State Government.] (2) The present strength of the officers and staff and of each category of posts therein and the scales of pay shall, until orders varying the same are passed, be as given in the Appendix ‘A’ to these regulations. Provided that- (a) The appointing authority may leave unfilled or the Board may hold in abeyance any vacant post or posts without thereby entitling any person to compensation or other redress. (b) The Board may create such additional permanent or temporary posts from time to time as may be found necessary and may change the nomenclature of the existing posts. CHAPTER III-GENERAL CONDITIONS OF RECRUITMENT Classification of posts 1 Substituted by The Uttar Pradesh Agricultural Produce Markets Board (Officers And Staff Establishment) (Sixth Amendment) Regulations, 2010. 5. Posts under the Board shall for purposes of appointment control, and discipline, etc. be classified in classes A, B, C, and according to the pay scales as per classification of posts under the State Government in force from time to time. Age 6. Age limits for the candidates for direct recruitment to different classes of posts in the service shall be as prescribed for recruitment to posts under the State Government. Provided that the upper age limits for employees of the Board shall be greater by five year or the number of years they have put up in the Board, whichever is less. Qualifications 7. The minimum educational qualifications, preferential qualifications and experience prescribed for the various posts to be filled in by direct recruitment shall be as in Appendix 'B'. Nationality-Character, Physical fitness. Marital Status, Reservation 8. Rules regarding Nationality, Character, Physical fitness, marital status and reservation for recruitment to different class of posts as applicable for recruitment to posts under the State Government shall apply to recruitment under the Board. CHAPTER IV-Recruitment and Appointment Appointing Authority 9. The authority or the officers shown in column 1 of the table below shall be the appointing authority in respect of the posts shown in column 2 of the table, Column. 1 Column. 2 1. (1) The posts shall be filled (a) by direct recruitment; (b) by promotion of Parishad employee, (c) by Deputation or Contract basis but post of Director, Additional Director and Finance Controller shall be filled by deputation. Note- The Director shall be an officer in the super time scale of the L.A.S.. the Additional Director shall be an officer in the selection grade of the State Civil Service (Executive Branch) and Finance Controller shall be an officer in special pay scale of State Finance Services.. (2) (a) All the posts in Group-A except the post of Director, Additional Director and Finance Controller shall be filled by promotion and the posts of Deputy Director (Administration/Marketing) shall be filled by promotion as indicated below :- 1. Ten posts from Mandi Secretary Cadre. The criteria for selection shall be seniority subject to rejection of the unfit. 2. Two post from the post of marketing officer cadre. The criteria for selection shall be seniority subject to rejection of the unfit. 3. One post from the post of Publicity Officer One time and after that from the post of Marketing Officer by selection on Seniority subject to rejection of the unfit. 4. One post of Deputy Director (Administration/Marketing) Head Quarter and other post of Deputy Director (Administration/Marketing) by State PCS Service Officer on Deputation. (b) 50 percent post in Group 'B' shall be filled by promotion and 50 percent by direct recruitment provided that posts of Private Secretaries Grade-2 shall be filled by promotion. 2[(c) Lowest Grade in Clerk Cadre in Group C shall be filled as follows- 1. 80 percent posts by direct recruitment. 1 Substituted by The Uttar Pradesh Agricultural Produce Markets Board (Officers And Staff Establishment) (11th Amendment) Regulations, 2022. 2 Substituted by The Uttar Pradesh Agricultural Produce Markets Board (Officers And Staff Establishment) (12th Amendment) Regulations, 2022. 2. 15 percent posts by promotion from Group D employees who have passed High School or equivalent examination. 3. 5 percent post by promotion from Group D employees who have passed Intermediate or equivalent examination, also completed 5 year continuous service in Group D post on merit basis.] (d) All the posts in the scale of pay above the lowest grade in Group C shall be filled by promotion provided that posts of Legal Assistant, Assistant Programmer and Driver shall be filled by direct recruitment. (e) All the posts in Group D shall be filled by direct recruitment. (3) Any post required to be filled by direct recruitment or promotion may in the discretion of the Board, be filled by taking persons on deputation. (4) Promotion shall be confined to the posts within the same group as detailed in Appendix 'C' and shall be subject to the conditions eligibility for promotion to different posts as mentioned therein.] Selection Committees 11. (1) For the purposes of recruitment to Class 'A' and 'B' posts, whether by direct recruitment or by promotions there shall be constituted a Selection Committee comprising the following:- (i) two officers not below the rank of Deputy Secretary to be nominated by the Secretary to the State Government in the Agriculture Department. (ii) Three officers not below the rank of Deputy Director to be nominated by the Director. (iii) the Chairman of the Selection Committee shall be nominated, by the Secretary of the State Government in Agriculture Department, the out of the members represented in class (i) and (ii). (2) For recruitment to Class 'C' and 'D' posts, whether by direct recruitment or by promotion, the selection committee shall consist of three officers including the Chairman to be nominated by the Director. 12. (1) The appointing authority shall determine the number of vacancies, in all the classes A, B, C and D, to be filled during the course of the year as also the number of vacancies to be reserved for candidates belonging to scheduled castes, scheduled tribes and other categories under regulation 8. 1[(2) (a) The vacancies in Group 'B' shall be filled through the Uttar Pradesh Public Service Commission, Allahabad. (b) Vacancies of Group 'C' (will be filled through Uttar Pradesh Subordinate Services Selection Commission. (c) In case the above mentioned Service Commissions are dissolved or cease to exist or there are some exigencies, the selection process shall be conducted by the Mandi Parishad or other institutions with the approval of the State Government. Selection by promotion 13. (1) Selection for promotion shall be made by Selection Committee to be constituted under regulation 11. The criteria for selection shall be seniority subject to rejection of the unfit. The selection of the posts of Chief Engineer -Grade-1, Chief Engineer Grade-2, Joint Director (Administration, Marketing), Joint Director (Construction), Joint Director (Electrical/ Mechanical) and Chief Account and Audit Officer shall be filled by selection on merit. (2) The appointing authority shall prepare an eligibility list of the candidates arranged in order of seniority and place it before selection committee along with their character rolls and other necessary records pertaining to them. (3) The selection committee shall consider the cases of the candidates on the basis of records referred to in sub-regulation (2) and if it considers necessary, may interview the candidates also. (4) The Selection committee shall prepare list of selected candidates arranged in order of seniority and forward the same to the appointing authority. Combined List 14. If appointment is to be made both by direct recruitment and by promotion, combined select list shall be prepared by taking the names of the candidates from the lists prepared under regulations 12 and 13 in such manner that the prescribed percentage of direct recruitment and promotion is maintained, the first name being from the list prepared under regulation 13. CHAPTER V-Appointment, Probation, Confirmation and Seniority Appointment 15. (1) The lists prepared under regulations 12, 13 and 14 will remain in force for a period of one year from the date of their finalization, on the occurrence of substantive 1 Substituted by The Uttar Pradesh Agricultural Produce Markets Board (Officers And Staff Establishment) (8th Amendment) Regulations, 2018. vacancies, the appointing authority shall make appointments by taking candidates in the order in which they stand on these lists. (2) The appointing authority may make appointments in temporary and officiating vacancies also from lists referred to in sub-regulation I. (3) Except as provided in these regulations, any appointment made to various categories of posts under the Board as a result of regular selection before the promulgation of these regulations shall be deemed to have been made under these regulation shall be valid for the purposes. Probation. 16. (1) A candidate appointed by direct recruitment or promoted to any posts under the Board shall, on appointment to a post in a substantive vacancy, be placed on probation for a period of one year from the date of joining the post. (2) The appointing authority may, for reasons to be recorded in writing, extend the period of probation specifying the date up to which the extension is granted. (3) If it appears to the appointing authority at any time during or at the end of the period of probation or extended period of probation that a probationer has not made sufficient use of his opportunities or has otherwise failed to give satisfaction, he may be discharge or reverted to his substantive posts, as the case may be. (4) A probationer who is reverted or whose services are dispensed with under sub-regulation (3) shall not be entitled to any compensation. (5) The appointing authority may allow continuous service rendered in an officiating. or temporary capacity in a post or any other equivalent or higher post, to be taken into account for the purpose of computing the period of probation. Confirmation 17. An employee directly appointed or promoted to any post under the Board will be confirmed in his appointment by an order of the appointing authority at the end of his period of probation or extended period of probation as the case may be, if- (a) his work and conduct are reported to be satisfactory. (b) the integrity is certified, or (c) the appointing authority is satisfied that he is otherwise fit for confirmation.. Seniority 18. (1) Except as herein after provided, the seniority of persons in any category or grade of posts in the service shall be determined from the date of the orders of substantive appointment and if two or more persons are appointed together, by such order, the order in which their names are arranged in the appointment order: Provided that if the appointment order rectifies & specifies back date with effect from which a person is substantively appointed, that date, will be deemed to be the date of order of substantive appointment and in other cases, it will mean the date of issue of the order. (2) The seniority inter-se of persons appointed directly on the result of any one selection, shall be the same as determined by the selection cermittee. Provided that a candidate recruited directly may lose his seniority if he fails to join without valid reasons When vacancy is offered to him, the decision of the appointing authority as to the validity of reasons shall he final. (3) The seniority inter-se of persons appointed by promotion shall be the same as it was In the cadre from which they were promoted. (4) Where appointments are made both by promotion and direct recruitment, the inter-se-seniority shall be determined by arranging the names in a cyclic order in a combined list, prepared in accordance with regulation 14, in such manner that the prescribed percentage is maintained. CHAPTER VI SUPERANNUATION, PAY, ALLOWANCES AND OTHER SERVICE CONDITIONS SUPERANNUATION 1[19. 1) The age of superannuation of an employee of the Board shall be 60 years or such, age as may be prescribed by the State Government for its employees from time to time.] (2) Irrespective of the date on which an employs attain the age of superannuation, he will retire on the last day of the month in which be attains the age of superannuation, (3) The appointing authority may, at any time, by notice to an employee of the Board: (whether permanent or temporary), without assigning any reason, require him to retire after. he attains the age of 50 years or such employee may by notice to the appointing Authority voluntarily retire at any time after attaining the age of 45 years or 1 Substituted by The Uttar Pradesh Agricultural Produce Markets Board (Officers And Staff Establishment) (7th Amendment) Regulations, 2014. after he has completed. Qualifying service of twenty years. The period of such notice shall be three months. 1[Explanation- For taking action under sub-regulation (3) the provisions of clause (c) (including its explanation), of the Fundamental Rule 56 of the Uttar Pradesh Fundamental Rules in Financial Handbook, Volume II, Parts II to IV as amended from time to time and such other rules, regulations, instructions, orders as may be generally applicable to Government servants serving in connection with the affairs of the State of Uttar Pradesh shall mutatis mutandis apply. ] Pay on recruitment. 20. (1) An employee directly recruited shall commence to draw the minimum pay and allowances applicable to the post or the pay and allowances Indicated in his letter of appointment from the date he assumes charge. (2) In the case of employees who are appointed by promotion from a lower grade, their pay shall be fixed in accordance with the provisions contained in Financial Hand bock Vol. II, Parts II to IV. (3) In the case of employees taken from Government on deputation their pay will be as agreed upon between the Board and the Government. (4) In the case of employees engaged on contract basis their pay will be fixed according to the conditions of contract entered into between the Board and the employees concerned, (5) Payment of other emoluments e. g. special pay, post-graduate pay etc. will be made by the Board on the merits of an individual case bearing in mind the rules contained in Financial Handbook, Vol. II, Parts II to IV and such other instructions as issued by the State Govern-ment from time to time. Annual Increment 21. (1) An annual increment on the completion of one complete year of service may be allowed to an employee at the rate shown in the time scale of pay in which he has been appointed, provided that his increment has not been withheld as a disciplinary measure or he is not held up at the efficiency bar. 1 Substituted by The Uttar Pradesh Agricultural Produce Markets Board (Officers And Staff Establishment) (Amendment) Regulations, 1991. 2) Increment in a time scale will be granted to an employee from the first day of the month in which it falls due. (3) A person on probation may be allowed his increment in the time scale on comple-tion of one year's satisfactory service.: Provided that if the period of probation is extended on account of failure to give satisfac-tion, such extension shall not count for increment unless the appointing authority directs other-wise. (4) An increment of an employee who remains on extraordinary leave, shall correpon-dingly be shifted and the period of such leave shall not count for increment. Crossing of efficiency bar 22. No employee shall be allowed to cross an efficiency bar unless the appointing autho- rity is satisfied that he has been working efficiently and to the best of his ability and his integrity is certified. Dearness allowance 23. The Board may decide the rate and amount of dearness allowance admissible to the different classes and categories of employees from time to time Other allowances. 24. The Board may decide and regulate the grant of other allowances and amenities e. g. city compensatory allowance, house rent allowance, conveyance allowance and medical facilities etc subject to such terms and conditions as it may specify. Retirement benefits 25. (1) No pension shall be payable to an employee of the Board (2) The employees serving under the Board shall contribute to provident fund in accordance with the provisions of the Employees Provident Fund Act and the rules made there-under or the General provident fund rules as may be applicable to them. 1[ (3) Payment of gratuity to Board employees shall be such as may be decided from time to time by the board keeping in view of the general directions or guidelines issued by the State Government from time to time.] Leave 26. Subject to the directions of the Board, grant of leave to the employees of the Board shall be as per rules applicable to State Government employees. CHAPTER VII-MISCELLANEOUS 1 Substituted by The Uttar Pradesh Agricultural Produce Markets Board (Officers And Staff Establishment) (7th Amendment) Regulations, 2014. Conduct. 27. Provision of Government servant conduct rules applicable to State Government employees shall mutatis mutandis apply to the employees of Board. Control and appeal 28. In relation to disciplinary proceedings appeals and representations against punishment the Uttar Pradesh Government Servant (Appeals and disciplinary proceedings) Rules 1999, applicable to the employees of the State Government shall mutatis mutandis apply to the employees of the Board. Regulation of other matter, 29. In regard to the matters not specifically covered by these regulations or by. Special orders, persons appointed to the service of the Board shall be governed by the rules, regulations, instructions and orders applicable generally to Government servants serving in connection with the affairs of the State of Uttar Pradesh. (2) In regard to the matters specifically-covered or deemed to be specifically covered by these regulations or by special orders, for other details and further provisions in connection therewith not contained in these regulations or other special orders, persons apроinted to the service of the Board shall be governed by the rules, regulations, instructions and orders applicable generally to Government servants serving in connection with the affairs of the State of Uttar Pradesh. Not with standing anything contained in these regulations, where the Board satisfied that the operation of any regulation regulating the conditions of service of persons appointed to the service causes undue hardship in any particular case, it may, with the previous approval of the State Government, by order, dispense with or relax the requirements of that regulation to such extent and subject to such additions as it may consider necessary for dealing with the case in a just and equitable manner.
