EXTRAORDINARY PART III—Section 4 PUBLISHED BY AUTHORITY No. 364] NEW DELHI, TUESDAY, SEPTEMBER 19, 2017/ BHADRA 28, 1939 MINISTRY OF SCIENCE & TECHNOLOGY (DEPARTMENT OF BIOTECHNOLOGY) NOTIFICATION New Delhi, the 15th September, 2017 No.RCB/REG/2017/02.—In exercise of the powers conferred by section 43 of the Regional Centre for Biotechnology Act, 2016 (36 of 2016) along with article 10 of the of the Second Schedule annexed to the Statutes of the Regional Centre for Biotechnology, 2017, the Central Government on behalf of the Board of Studies, Regional Centre for Biotechnology hereby notifies the Regional Centre for Biotechnology (Recognition of Institution of Higher Learning within India and conduct of the Academic Programme) Regulations 2017. “BOARD OF STUDIES (REGIONAL CENTRE FOR BIOTECHNOLOGY) Regional Centre for Biotechnology (Recognition of Institution of Higher Learning within India and Conduct of the Academic Programme) Regulations, 2017 New Delhi, the 15th September, 2017 No. RCB/REG/2017/02.—In exercise of the powers conferred by section 43 of the Regional Centre for Biotechnology Act, 2016 (36 of 2016) read with article 10 of the Second Schedule annexed to the Statutes of the Regional Centre for Biotechnology, 2017, the Board of Studies hereby makes the following regulations, namely: – 1. Short title and commencement. – (1) These regulations may be called the Regional Centre for Biotechnology (Recognition of Institution of Higher Learning within India and conduct of the Academic Programme) Regulations, 2017. (2) They shall come into force on the date of their publication in the Official Gazette. 2. Definitions. – (1) In these regulations, unless the context otherwise requires, - (a) “Act” means the Regional Centre for Biotechnology Act, 2016 (36 of 2016); (b) “Academic Committee” means the Academic Committee referred to in clause (iii) of ordinance 2.1 of the Ordinances of the Regional Centre for Biotechnology, 2017; (c) “Board of Studies” means the Board of Studies referred to in clause (c) of section 2 of the Act; (d) “Recognised Centre” means the Recognised Centre as defined in clause (viii) of ordinance 2.1 of the Ordinances of the Regional Centre for Biotechnology, 2017; (e) “Regional Centre” means the Regional Centre referred to in clause (n) of section 2 of the Act. (2) Words or expressions used herein and not defined but defined in the Act or the Statutes of the Regional Centre for Biotechnology, 2017, or the Ordinances of the Regional Centre for Biotechnology, 2017, shall have the same meaning respectively assigned to them in the Act or the said Statutes or the said Ordinances. 3. Regulations to be in addition to and supplement the Statutes and Ordinances.- The recognition of institutions of higher learning within India for the purpose of the Act, and to withdraw such recognition, shall primarily be regulated by the provisions contained in clause (c) of the article 2 of the Second Schedule annexed to the Statutes of the Regional Centre for Biotechnology, 2017 and ordinance 19 of the Ordinances of the Regional Centre for Biotechnology, 2017, and these regulations shall be in addition to and consistent with the provisions of the said Statutes and Ordinances so as to clarify and supplement them. 4. Norms and standards for recognition of a Centre.- Every institution seeking the recognition of Regional Centre within India for its academic programme for the purposes of the Act shall meet the criteria as specified in ordinance 19 of the Ordinances of the Regional Centre for Biotechnology, 2017. 5. Submission of proposal for recognition and approval process.- The proposal for recognising an institution of higher learning for the purposes of the Act and the process for approving such recognition shall be in the following manner, namely:- (a) an institution seeking recognition in India for its academic programmes falling under the purview of the Act and the Statutes and Ordinances made thereunder shall forward the requisite information in such format as provided in the schedule annexed to these regulations; (b) proposals for such recognition shall be received by the Registrar of the Regional Centre throughout the year and shall be presented to the Board of Studies in its next available meeting; (c) the Board of Studies shall review the proposal for the eligibility of the institution as a Recognised Centre of the Regional Centre within India in accordance with the provisions of the Act and the Statutes and Ordinances made thereunder, and the desirability, viability, and conformity of the proposed academic programme in meeting the academic requirements of the Regional Centre; (d) the Board of Studies may on its own review such proposal, or may consider the report of a panel that it may appoint to inspect such institution and interact with the proposed faculty; (e) the recommendations of the Board of Studies shall be presented to the Board for approval in the next available meeting, and the approval of the Board or otherwise to the proposal for the recognition shall be notified by the Registrar of the Regional Centre to the applying institutions, and subsequent to such approval, the name of the institute shall be displayed on the Regional Centre website as an institution recognised by the Regional Centre; and (f) following such notification, the Recognised Centre shall enter into a written memorandum of understanding with Regional Centre, and such memorandum shall specify the objectives, needs and specific activities covered under the collaboration, which shall be signed by the Executive Director of the Regional Centre and the Head of the Recognised Centre. 6. Recognition of the faculty of Recognised Centre. – The recognition of the faculty of the Recognised Centre shall be in the following manner, namely:- (a) only the regular research and academic staff of the Recognised Centre having Doctor of Philosophy or Doctor of Medicine degree with a minimum of three years’ research or teaching experience or both shall be eligible for recognition as an adjunct faculty of the Regional Centre and it shall purely be an academic affiliation to the faculty of the Recognised Centre without any financial obligation or any other entitlement at the Regional Centre; (b) research staff of the Recognised Centre having appointments in the pay band-3 (with grade pay Rs.7600) shall be eligible to be recognised as an Adjunct Assistant Professor, and research staff of the Recognised Centre having appointments in the pay band-4 (with grade pay Rs. 8700 or 8900) shall be eligible to be recognized as an Adjunct Associate Professor, and research staff of the Recognised Centre having appointments in the pay band-4 (with grade pay Rs. 10000), or higher scale, shall be eligible to be recognised as an Adjunct Professor; and (c) the head of the Recognised Centre shall recommend the names of the faculty for recognition as adjunct faculty at the Regional Centre and the recommendations along with bio-data of the recommended faculty, detailing the academic and research accomplishments and current level of appointments at the Recognised Centre, shall be submitted to the Board of Studies for its consideration and the recognition of the faculty of the Recognised Centre as a Regional Centre adjunct faculty shall be notified by the Registrar of the Regional Centre and displayed on the website of the Regional Centre. 7. Recognition fee and annual fee payable by Recognized Centre. - To cover the cost of academic administration, management of student records, and conduct of thesis evaluation and other similar matters, a fee shall be chargeable from the Recognised Centre, as decided by the Board of Studies from time to time, payable to the Regional Centre and in addition, each student registered with the Recognised Centre shall pay the academic administration fee as fixed by the Board of Studies from time to time to the Recognised Centre. 8. Conduct of academic programme. – (1) For the conduct of academic programme, the Recognized Centre shall constitute its Academic Committee with the following composition, namely:- (i) Head of the Recognised Centre — Chairperson; (ii) two senior faculty members from the Recognised Centre to be nominated by the Head of the Recognised Centre — Members; (iii) one external academician to be nominated by the Chairperson of the Board of Studies — Member; (iv) Registrar of the Regional Centre or its nominee — Member; (v) Academic Coordinator from the Recognised Centre to be nominated by the Head of the Recognised Centre — Member-Secretary. (2) The term of the nominated member referred to in sub-regulation (1) shall be three years from the date on which he enters upon office and may be renewed and the travel and accommodation expenses, and the sitting fee of the external members referred to in the said sub-regulation, shall be payable by the Recognised Centre.
