S. R. 327 (E).—In exercise of the powers conferred by paragraph 8 of the Bhopal Gas Leak Disaster (Registration and Processing of Claims) Scheme, 1985, framed by the Government of India under Section 9 of the Bhopal Gas Leak Disaster (Processing of Claims) Act, 1985 (No. 21 of 1985), the Commissioner, hereby makes the following amendment in the procedure to be followed by the Additional Commissioners/Deputy Commissioners and other Officers and Employees appointed to discharge the functions under the Act and the Scheme, namely :— AMENDMENT In the said procedure, for sub-para (ii) of para 12, the following sub-para shall be substituted namely :— "(ii) However, if the case is dismissed or rejected in the absence of claimant and if within the period of thirty days, from the date of the said order or if the case is dismissed or rejected before 1st March, 2000, from 1st March, 2000, the claimant appears and files an application and satisfies that there was sufficient cause for his non-appearance on the date fixed for final hearing, the Tribunal may reopen the case and after giving an opportunity of hearing and to produce evidence may decide the claim : Provided that if the Tribunal is satisfied that the claimant was prevented by sufficient cause from his appear- ance before the Tribunal within the said period of thirty days, the Tribunal may, within a further , period of thirty days but not thereafter, reopen the case for hearing and decide the claim according to law." 2.
