EXTRAORDINARY PUBLISHED BY AUTHORITY No. 1466] NEW DELHI, MONDAY, MAY 22, 2017/JYAISTHA 1, 1939 MINISTRY OF HUMAN RESOURCE DEVELOPMENT (Department of School Education and Literacy) NOTIFICATION New Delhi, the 18th May, 2017 S.O.1655(E).—Whereas clause (d) of section 2 of the Right of Children to Free and Compulsory Education Act, 2009 (35 of 2009) (hereinafter referred to as the RTE Act), defines ‘child belonging to disadvantaged group’ as a child belonging to the Scheduled Caste, the Scheduled Tribe, the socially and educationally backward class, or such other group having disadvantage owing to social, cultural, economical, geographical, linguistic, gender or such other factor, as may be specified by the appropriate Government, by notification; And whereas, the Central Government is the appropriate Government in relation to a school established, owned or controlled by the administrator of the Union territory, having no legislature; And whereas, the Hon’ble Supreme Court has ordered in W.P. (C) No. 147 of 2014 that State Governments need to consider the issuance, so as to include children living with or affected by HIV, to be notified as belonging to a disadvantaged group under clause (d) of section 2 of the Right of Children to Free and Compulsory Education Act, 2009; And whereas, the Central Government has considered the aforementioned order of the Supreme Court; Now, therefore, in exercise of powers conferred by clause (d) of section 2 of the Right of Children to Free and Compulsory Education Act, 2009 (35 of 2009), the Central Government hereby notifies the children living with or affected by HIV as “child belonging to disadvantaged group” in respect of Chandigarh, Dadra and Nagar Haveli and Daman and Diu.
