In clause (c), for the words “two percent” and “three percent” mentioned in the paragraph against “After six months but before the date of maturity”, the words “one percent” and “two percent”, respectively shall be substituted. ARNAB ROY Executive Director INDIAN COUNCIL OF WORLD AFFAIRS New Delhi, the 16 th September 2014 INDIAN COUNCIL OF WORLD AFFAIRS, DIRECTOR GENERAL, OTHER OFFICERS AND EMPLOYEES (CONDITIONS OF SERVICE) REGUALTIONS, 2014 File No. ICWA/Admin/551/24/2012—In exercise of the powers conferred by sub-section (1) and clause(f) of sub- section (2) of section 26 of the Indian Council of World Affairs Act, 2001 (29 of 2001), the Council hereby makes the following regulations, namely:- CHAPTER – I PRELIMINARY 1. Short title and commencement. –(1)These regulations may be called the Indian Council of World Affairs, Director- General, Other Officers and Employees (Conditions of Service) Regulations, 2014. (2) They shall come into force on the date of their publication in the Official Gazette. 2. Definitions. – (1) In these regulations, unless the context otherwise requires,- a) “Act” means the Indian Council of World Affairs Act, 2001(29 of 2001); b) “Appointing Authority” in relation to any post under the Council, means the Director General of the Council; c) “borrowed employee” means an employee of the Central Government whose services are being utilised by the Council; d) “Controlling Authority” means,- (i) in relation to Group ‘A’ posts, the Director General of the Council; (ii) in relation to Group ‘B’ posts and other posts, the Director of the Council; e) “employee” means any person serving in the Council in any of posts as specified in the Schedule to these regulations. f) “Government” means the Central Government; g) “ Head of Office” means an officer serving in the Council and nominated by the Director-General; h) “Sanctioning Authority” means the Director-General of the Council; (2) All the words and expressions used herein and not defined in these regulations but defined in the Act and the Indian Council of World Affairs Director-General and Other Officers and Employees (Salaries and Allowances) Rules, 2011, shall have the same meanings respectively as assigned to them in the said Act and the rules. 4184 THE GAZETTE OF INDIA, SEPTEMBER 27, 2014 (ASVINA 5, 1936) [PART III—SEC. 4 CHAPTER - II Pay 3. Pay band and grade pay or pay scale.- Pay band and grade pay or pay scale for the posts under the Council shall be as specified in the Schedule. 4. Initial pay and increment:- (1) An employee shall on his appointment to a post in the Council draw at the minimum of the pay band as initial pay. (2) On completion of each year of service, an employee shall be entitled to an annual increment of three per cent on his pay and grade pay. (3) On promotion to the next higher grade, an employee shall be entitled to an increment of three per cent. on his pay and grade pay. 5. Special pay, personal pay, honorarium and fee.- The Council may grant to an employee under special circumstances, such special pay or personal pay or honorarium or fee. 6. Pay. - (1) An employee shall be entitled to the pay of the post to which he or she is appointed from the date on which he or she assumes charge of the post. (2) The pay in respect of any month, except the month of March, shall become payable on the last working day of the month unless otherwise specifically mentioned and the pay for the month of March shall become payable on the first working day of April. 7. Leave salary. - An employee of the Council shall be entitled to leave salary on the following rates, namely:- (a) equal to pay drawn immediately before proceeding on leave; (b) equal to the amount of leave salary on sanctioned leave in terms of leave rules in Chapter V: Provided that he or she shall not be entitled to any leave salary on extraordinary leave. CHAPTER-III Allowances 8. Dearness allowance. – The dearness allowance shall be admissible to employees of the Council on the same terms and conditions as applicable to the Central Government employees from time to time. 9. House rent allowance. – The house rent allowance shall be admissible to employees of the Council on the same terms and conditions as applicable to the Central Government employees from time to time. 10. Transport allowance. – The transport allowance shall be admissible to employees of the Council on the same terms and conditions as applicable to the Central Government employees from time to time. 11. Allowances during suspension. - An employee under suspension shall, during the period of suspension, draw such allowance at such rates and subject to such orders under which the same is allowed to the Central Government employees. 12. Allowances during leave. – The house rent allowance, dearness allowance, transport allowance and any other allowances shall be admissible to the employees of the Council during leave of all kinds at the admissible rates and subject to the conditions under which such allowances are admissible to the Central Government employees of corresponding grade during the period of the same kind of leave. 13. Traveling allowance.- The employees of the Council shall be entitled to traveling allowance on official tour as admissible to the Central Government employees of the corresponding grade. 14. Children’s education allowance and reimbursement of tuition fees.- The Children education allowance and reimbursement of tuition fees shall be admissible to employees of the Council at the rates at which and subject to the orders under which, the same are allowed to the Central Government employees. CHAPTER-IV Conditions of Service 15. Probation. - (1)Every employee directly recruited to a post under the Council shall be on probation for a period of two years: Provided that the appointing authority may, in any individual case for reasons to be recorded in writing, extend the period of probation: Provided further that save where it is necessary by reasons of any disciplinary or legal proceedings pending against the employee, the extension of the period of probation, if the appointing authority deems fit, shall not exceed one year at a time and in no case for more than two years. PART III—SEC. 4] THE GAZETTE OF INDIA, SEPTEMBER 27, 2014 (ASVINA 5, 1936) 4185 (2) An employee during the period of probation may be required to undergo such training and to qualify such test as may be specified for the said post. (3) If an employee is found and considered unsuitable for holding that post, or has not completed the period of probation satisfactorily, the appointing authority shall terminate his or her services under the Council. (4) Every person appointed to a regular post under the Council by direct recruitment shall, on satisfactory completion of period of probation, be eligible for confirmation. 16. Financial upgradation for assured career progression.- (1) There shall be three financial upgradations counted from the date of direct entry into regular service, on completion of ten, twenty and thirty years of service respectively, whenever a person has served ten years continuously in the same grade pay without promotion. (2) The proposals for upgradation shall be considered by the Council’s Promotion Committee consisting of three officers, superior to the rank of the person being considered nominated by the Director-General for their recommendations on the basis of their assessment of employee’s fitness for the work of the Council as per his or her annual confidential reports for at least last two years prior to the meeting of the Council’s Promotion Committee. (3) The proposal for upgradation on the basis of recommendations of the Council’s Promotion Committee shall be approved by the Director-General. (4) The upgradation shall only be to the next higher grade pay available, as per Schedule to these regulations. (5) The eligibility conditions and bench mark for achieving financial upgradation shall be issued by further instructions based on the orders issued by the Government of India in respect of Modified Assured Career Progression. (6) The first financial upgradation shall be considered for eligible employee and shall be processed within six months of these regulations coming into force, provided that ten year period shall exclude the periods of extraordinary leave and unauthorised absence condoned and the second upgradation shall be processed only ten years after the date of regular promotion of the first time upgraded employee, on so on, if he continues in service of the Indian Council of World Affairs. 17. Termination of service. - (1) The services of an employee may be terminated by the Director-General after following the procedure in accordance with Central Civil Services (Temporary Services) Rules, 1965 and the Government of India’s orders and instructions thereunder. (2) Without prejudice to the provisions of sub-regulation (1), the service of an employee shall be terminated, if- (i) the appointment is made for a specified period and on the expiry of such period the appointment is not extended for a further period; or (ii) the appointment is made against a temporary post and on the abolition of such post or on the expiry of the period for which that post is created; or (iii) he or she fails to resume duty on the expiry of the maximum period of extraordinary leave granted to him or her under leave rules and after his or her explanation, in reply to a show cause notice, which shall be given in all such cases, has been taken into account: provided that the services of any person shall not be terminated, unless the person has been given a reasonable opportunity of being heard in the matter. 18. Retirement. - (1) An employee shall retire from the service of the Council,- (i) on completion of sixty years of age; or (ii) on being declared medically unfit for service by a Medical Board to be constituted by the Director-General; or (iii) on the imposition of the penalty of compulsory retirement; or (iv) such other grounds as may be notified by the Council. 19. Resignation. - (1) An employee may, by notice of one month in writing addressed to the appointing authority, seek permission to resign from the service of the Council. (2) The appointing authority may, if deems proper after due scrutiny as to the employee’s liabilities and dues towards the Council, or from vigilance angle, permit an employee to resign from the service of the Council. (3) The resignation shall be effective from the date of its acceptance by the appointing authority. (4) On resignation, the employee shall be entitled to the admissible service gratuity, employees provident fund and leave encashment as per the provisions of the relevant rules. 4186 THE GAZETTE OF INDIA, SEPTEMBER 27, 2014 (ASVINA 5, 1936) [PART III—SEC. 4 (5) A regular employee, intending to apply for employment elsewhere other than Indian Council of World Affairs, shall seek prior permission to apply from the Director General through proper channel. CHAPTER-V Medical Facilities 20. Medical facilities. – (1) An employee of the Council shall be allowed to get reimbursement of medical expenses subject to the condition that reimbursement will be limited to the maximum rates prescribed by the Central Government Health Scheme for the consultation or procedure or treatment admissible under Central Government Health Scheme rules, if any. (2) The reimbursement shall be allowed at the admissible rates only after submission of a claim in the specified proforma supported by the prescription and receipts duly signed by the Medical Officer concerned and shall further be subject to the terms and conditions issued and amended from time to time by the Government under Central Services (Medical Attendance) Rules, 1944. CHAPTER-VI Leave 21. Kinds of Leave. – Subject to the provisions of these regulations, an officer or employee shall be eligible for the following kinds of leave, namely;- (a) Casual Leave; (e) Special Casual Leave and Special Leave; 22. Regulation of leave. - The admissibility and the grant of any kind of leave mentioned above shall be regulated in accordance with the provisions of the Central Civil Services (Leave) Rules,1972. 23. Leave encashment.- An employee of the Council shall be entitled to encashment of earned leave on retirement as admissible to the Central Government employees under the Central Civil Services (Leave) Rules, 1972. 24. Leave travel concession.- An employee of the Council shall be entitled to leave travel concession as admissible to the Central Government employees under the Central Civil Services (LTC) Rules, 1988. CHAPTER-VII Retirement and Other Benefits 25. Provident fund and pension. - (1)The employees of the Council shall be governed by the provisions of Employees’ Provident Funds and Miscellaneous Provisions Act, 1952. (2) The employees of the Council shall be entitled to pension as per the rules under Employee Pension Scheme, 26. Insurance. - The employees shall be covered by the Group Insurance Policy undertaken by the Indian Council of World Affairs with the Life Insurance Corporation of India. 27. Death-cum-retirement gratuity. - An employee of the Council shall be entitled to gratuity on retirement as admissible under Payment of Gratuity Act, 1972 (39 of 1972). 28. Service gratuity.- (1) An employee of the Council shall be entitled to receive service gratuity (and not pension) on retirement if total qualifying service is less than ten years as admissible under the Payment of Gratuity Act, 1972 (39 of 1972). (2) A former employee of the Council who has retired or resigned prior to the publication of these regulations shall not be entitled to any post retirement benefits under these regulations. PART III—SEC. 4] THE GAZETTE OF INDIA, SEPTEMBER 27, 2014 (ASVINA 5, 1936) 4187 CHAPTER-VIII General Conditions of Service 29. Whole time employment. - (1) Every officer or employee shall be a whole time officer or employee and shall be at the disposal of the Council and he or she may be employed for the performance of such duties as may be assigned to him or her by the Council. (2) Without prejudice to the generality of sub-regulation (1), an employee may be required,- (i) to undergo a course of study; (ii) to serve the Council at any place and in any post not lower than the post to which he or she is substantively appointed or to which he or she is reduced as a measure of punishment. (3) If an employee is sponsored to attend any conference or training, he shall be deemed to be on duty. CHAPTER-IX Conduct 30. Conduct. - Every employee of the Council shall,- (i) at all times maintain absolute integrity and devotion to duty; (ii) abide by and comply with the rules and regulations of the Council and all orders and directions of superior authority; (iii) extend utmost courtesy and attention to all persons with whom he or she has to deal with in the course of his or her duties; (iv) endeavor to promote the interest of the Council and shall not act in any manner prejudicial thereto; (v) not take part in any unlawful activity of political or communal nature; (vi) report to the Council of any transaction involving acquisition of immovable property either in his or her name or in the name of any member of his or her family and likewise any transaction in movable property either in his or her own name or in the name of any member of his or her family as provided in Central Civil Services (Conduct) Rules, 1964 as applicable to an officer of corresponding rank in the Government. Note:- In respect of matters not specifically provided for in these regulations, the relevant provision of Central Civil Services (Conduct) Rules, 1964 shall apply to employees of the Council. 31. Disqualification.- No officer or employees - (a) who has entered into or contracted a marriage with a person having a spouse living, or (b) who, having a spouse living, have entered into or contracted a marriage with any person, shall be eligible for appointment to any post in the Council: Provided that the Council may if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing, exempt any person from the operation of this regulation. CHAPTER-X Disciplinary Matters 32. Suspension.- (1) The appointing authority or any other authority empowered in that behalf by the Director-General may place an employee of the Council under suspension, where.- (a) a disciplinary proceeding against an employee of the Council is contemplated or pending; or (b) in the opinion of the authority aforesaid, has engaged himself in activities prejudicial to the interest of the Council; or (c) a case against him in respect of any criminal offence is under investigation, inquiry or trial. (2) An employee of the Council shall be deemed to have been placed under suspension by an order of the appointing authority : (a) with effect from the date of his detention, if he is detained in custody, whether on a criminal charge or otherwise, for a period exceeding forty-eight hours; (b) with effect from the date of his conviction, if in the event of conviction for an offence he is sentenced to a term of imprisonment exceeding forty-eight hours and is not forthwith dismissed or compulsorily retired consequent to such conviction. 4188 THE GAZETTE OF INDIA, SEPTEMBER 27, 2014 (ASVINA 5, 1936) [PART III—SEC. 4 (3) Where a penalty of dismissal or compulsory retirement from service imposed upon an employee under suspension is set aside on appeal, and the case is remitted for further inquiry or action, the order of his suspension shall be deemed to have continued in force on and from the date of the original order of dismissal or compulsory retirement and shall remain in force until further orders. (4) (a) An order of suspension made or deemed to have been made under this regulation shall continue to remain in force until modified or revoked by the authority competent to do so; (b) where an employee is suspended or is deemed to have been suspended and any other disciplinary proceeding is commenced against him during the continuance of that suspension, the authority competent to place him under suspension may, for reasons to be recorded by him in writing, direct that the employee shall continue to be under suspension until the termination of all or any of such proceedings; (5) (a) An order of suspension made or deemed to have been made under this regulation shall be reviewed by the authority superior to the appointing authority, before expiry of ninety days from the date of suspension, if by that date the disciplinary proceedings are not concluded; (b) review of suspension shall be made or caused to be made by the Director-General; (c) total extension of suspension shall not be for a period exceeding one hundred and eighty days. (6) An order of suspension made or deemed to have been made under sub-regulations (1) or (2) above, shall not be valid after a period of ninety days unless it is extended after review for a further period before the expiry of ninety days: provided that no such review of suspension shall be necessary in the case of deemed suspension, if the employee continues to be under suspension at the time of completion of ninety days of suspension and the ninety days period in such case will count from the date the employee detained in custody is released from detention or the date on which the fact of his release from detention is intimated to his appointing authority, whichever is later. 33. Penalties: Without prejudice to the foregoing regulations, an officer or employee who commits breach of these regulations or who displays negligence, inefficiency or indolence or who commits acts detrimental to the interests of the Council or is guilty of any other acts of misconduct, shall be liable for one or more of the penalties as follows, namely,- (i) censure; (ii) warning; (iii) recovery from his pay or emoluments or such other amounts as may be due to him of the whole or part or any pecuniary loss caused to the Council by negligence or breach of orders; (iv) withholding of increments of pay; (v) reduction of pay to a lower stage in the same pay scale; (vi) reduction to a lower grade or post; (vii) compulsory retirement; (viii) removal from service which shall not be a disqualification for future employment; (ix) dismissal from the employment of the Council, which shall ordinarily be a disqualification for future employment. 34. Disciplinary Authorities : (1) The Director-General may impose any of the penalties specified in regulation 33 on an employee of the Council. (2) Any of the above penalties may also be imposed on an employee by the appointing authority, in which case appeal shall lie with the Director-General. PART III—SEC. 4] THE GAZETTE OF INDIA, SEPTEMBER 27, 2014 (ASVINA 5, 1936) 4189 35. Inquiry: Whenever the disciplinary authority is of the opinion that there are grounds for inquiring into the truth of any imputation of misconduct or misbehavior against an employee of the Council, he may himself inquire into or appoint under these regulations, as the case may be, an authority to inquire into the truth thereof. 36. Disciplinary procedure: (1) Where it is proposed to hold an inquiry against an employee, the disciplinary authority shall draw up or cause to be drawn up; (i) a statement of the misconduct or misbehavior noticed; (ii) a statement of all relevant facts including any admission or confession made by the employee; (iii) a list of documents by which, and a list of witnesses by whom, charges are proposed to be sustained. (2) The disciplinary authority shall deliver or cause to be delivered to the charged employee, a copy of the articles of charge, the statement of the imputations of misconduct or misbehavior and a list of documents and witnesses and shall require the employee to submit within such time as may be specified, a written statement of his defence. (3) On receipt of the written statement of defence, the disciplinary authority may himself inquire into such of the charges, as are not admitted. (4) (a) If no written statement of defence is submitted by the charged employee, the disciplinary authority shall, after giving an opportunity to him or her, inquire into the articles of charges; (b) after examining evidences and witnesses available and considering the interests of justice, conclude the enquiry by recording the details of the enquiry, statements of the charged employee and witnesses and their relevance to his conclusion; (c) the disciplinary authority may impose on the charged employee such penalty as may deem fit in accordance with these regulations. (5) A employee of the Council who has been dismissed shall not be entitled to any post retirement or resignation benefits, nor any pension, nor service gratuity, nor leave encashment, nor any other benefits under these regulations. CHAPTER-X Appeals and Review 37. Appellate authority. - (1) An appeal shall lie from any original order made. – (i) by the Head of Office to the Deputy Director-General; (ii) by the Deputy Director-General to the Director-General; (iii) by the Director General to the President of the Council. 38. Period of limitation for appeals .- No appeal shall be entertained unless it is submitted within a period of forty-five days from the date on which the order appealed against is communicated to the person concerned: Provided that the appellate authority may allow the appeal after the expiry of the said period, if he or she is satisfied that the appellant had sufficient cause for not filing the appeal in time. 39. Particulars of an appeal.- Every appeal shall comply with the following, namely:- (i) it shall be in writing and couched in polite and respectful language and shall be free from un necessary padding or superfluous verbiage; (ii) it shall contain all material statements and arguments relied upon and shall be complete in itself; (iii) it shall specify the relief desired; (iv) it shall be filed before the Deputy Director-General who shall, unless he himself is the appellate authority, transmit it to the appellate authority. 4190 THE GAZETTE OF INDIA, SEPTEMBER 27, 2014 (ASVINA 5, 1936) [PART III—SEC. 4 40. Consideration of appeals. - The appellate authority after giving an opportunity of being heard to the appellant shall, consider every appeal in such manner as it deems fit and pass such orders as it deems proper in the circumstances of the case: Provided that no order imposing an enhanced penalty shall be passed unless the appellant is given an opportunity of making representation which he may wish to make against such enhanced penalty. 41. Review. - The Council may on its own motion or otherwise, review any order made by the appellate authority and pass such orders as it may deem fit in the circumstances of the case. 42. Orders on reinstatement. -Where an employee who has been dismissed or suspended is reinstated, the authority reinstating shall make an order specifying,- (i) the period of his absence from duty and any pay and allowances that he may be entitled to ; (ii) whether such period may be treated as duty for all or any purpose. Note:- In respect of any matters not specifically provided for in these regulations in Chapter XI, relating to Appeals and Review, the relevant provisions contained in the Central Civil Services(Classification, Control and Appeal) Rules, 1965 shall apply to the employees of the Council. CHAPTER-XI Miscellaneous 43. Special provisions for existing employees. - Every person holding a post under the Council at the commencement of these regulations shall, on such commencement be deemed to have been appointed under the provisions of these regulations to the corresponding post in the Schedule to be specified wherever necessary by the Director-General and shall draw the pay drawn by him immediately before such commencement. 44. Authentication. - All orders and decisions of the Council shall be authenticated by the signature of the President or the Vice-President of the Council and all other instruments issued by the Council shall be authenticated by the signature of the Director-General or by any other officer of the Council as authorised by the Council in this behalf. 45. Holidays. - The Council shall observe such holidays as are observed by the Government of India offices located in National Capital Territory of Delhi. 46. Service books and character rolls. - (1) The Council shall maintain a service book and a character roll of each employee in the form and as per instructions issued with the approval of the Director-General from time to time. (2) The entries in the service book of an employee so made, shall be attested by the administrative officer (Administration) except the first page, which shall be attested by the controlling officer. (3) The entries in the character roll of an employee shall be made by the authority to whom such employee is immediately subordinate and shall be countersigned by the controlling authority with his remarks. 47. Residual conditions of service. - Any matter relating to the conditions of service of an employee for which no provision is made in these regulations, shall be determined by the Governing Body in consultation with the Government in the Ministry of External Affairs and the Financial Advisor: Provided that any concession which is allowed by the Central Government to its employees may be allowed to the employees of the Council, subject to the terms and conditions governing the grant of such concessions to the Central Government employees. 48. Removal of doubts. - Where a doubt arises in the interpretation or application of any of the provisions of these regulations, the Director-General shall obtain the views of the Government in the Ministry of External Affairs before seeking a decision from the President.
