Uttar Pradesh Shasan Parivahan Anubhag-4 In pursuance of the provisions of clause (3) of Article 348 of the Constitution, the Governor is pleased to order the publication of the following English translation of notification no.10/2020/752/XXX-4-2019-1(sa)/2017, dated: 30 July, 2020 Notification no. 10/2020/752/XXX-4-2020-1(sa)/2017 Lucknow dated: 30 July, 2020, In exercise of powers conferred under sub-section (1) of section 200 of the Motor Vehicles Act, 1988 (Act no. 59 of 1988) read with section 21 of the General Clauses Act, 1897 (Act no. 10 of 1897) and in supersession of Government notification no. 14/2019/ 931/XXX-4-2019/01(Sa)2017, dated June 07, 2019, the Governor is pleased to direct that the officers mentioned in column-1 of the Schedule below may compound the offence mentioned in column 3 and offence under sections mentioned in column 2 for amount mentioned against each in column 4 and 5 of the Schedule - SCHEDULE Officials who can compound the offences Sections of The Motor Vehicles Act, 1988, under which a offence is to be compound Description of offences The amount of compounding fees In the case of first offense Second or In case of follow-up offence (1) Officials of the Transport Department Passenger Tax Officer / Assistant Regional Transport Officer / Regional Transport Officer and all officers above the rank principal secretary, secretary and special secretary, Transport. of Motor Vehicles Act 1988, read with Section Traffic related offence: 1- Violation of parking rules. of Motor Vehicles Act 1988, read with Section 130, Rule 15(7) of Central Motor Vehicle Rule. 2- Failure to present certificate of Registration, Permit, Certificate of Fitness, Driving License, Pollution under control Certificate on demand NOTE: Documents in electronic form in Degiloker will be accepted. Section 47 read with Section 177 of Motor 3- Using registration mark of other states for a period exceeding 12 Months. (b) In other cases. (a) Not below the rank of Additional Transport Commissioner and Principal Secretary, Secretary and Special Secretary of Transport department. (b) Not below the rank of Deputy Transport Commissioner and Principal Secretary, Secretary and Special Secretary of Transport department. 182(A)1 (A) Whoever, being a Manufacturer, Importer or Dealer of motor vehicles sells or delivers or alters or offers to sell or deliver a vehicle that is in contravention of the provisions of chapter VII of the Act and the rules and regulations made there under. Use of handheld communications devices while driving. -Do- 186 Whoever drives a motor vehicle in any public place when he is to his knowledge suffering from any disease or disability calculated to cause his driving of the vehicle to be a source of danger to the public. -Do- 189 Whoever, without the written consent of the State government permits or takes part in a race or trial of speed between motor vehicles in any public place. -Do- 190(2) Any person who drives or causes or allows to be driven in any public place a motor vehicle in contravention of the Officials who can compound the offences Sections of The Motor Vehicles Act, 1988, under which a offence is to be compound Description of offences The amount of compounding fees In the case of first offense Second or In case of follow-up offence standards prescribed in relation to: 1- road safety such as without reflector, not fitted with retro reflective tape as per standards, non installation of speed limit device in commercial vehicles as per standards 2- Violation of prescribed standards in relation to air pollution. 3- Violation of prescribed standards in relation to noise pollution. (1) Officers of the Transport Department Passenger Tax Officer / Assistant Regional Transport Officer / Regional Transport Officer and all officers of above the rank and principal secretary, secretary and special secretary, Transport. (2) Officers of Police Department (i) Gazetted Officer of Civil Police / Traffic Section 192 read with section 39 and 56 of the motor vehicle Act. Section 192 read with Rule 51 of the Central Motor Vehicles rules 1989. (i) On the operation of motor vehicle without registration or with suspended or cancelled registration. (ii) On the operation of vehicle without valid certificate of fitness. (iii) Carrying registration mark displayed in the vehicle not in the prescribed manner. (iv) To Display other motor vehicle’s Registration No. on one’s vehicle. Whoever, drives a motor vehicle without permit or causes or allows a motor vehicle to be driven in contravention of any condition of a permit relating to the route on which or the area in which or the purpose for which the vehicle may be driven.
