'~~~~~~t lfpolfpolfpolfpo Chhattisgarh State Electricity Regulatory Commission Irrigation Colony, Shanti Nagar, Raipur – 492001 Tel: 0771-4073553, Fax-2445857 Date 10 January, 2014 55/CSERC/2013 - Chhattisgarh State Electricity Regulatory Commission (the Commission), in exercise of the power vested to the Commission under section 181 of the Electricity Act, 2003, and all other powers enabling it in this behalf, hereby makes the following regulations, to amend Chhattisgarh State Electricity Regulatory Commission (Conduct of Business) Regulations, 2009. 1. Short title and commencement 1.1 These Regulations may be called the Chhattisgarh State Electricity Regulatory Commission (Conduct of Business-First Amendment) Regulations, 2013. '~~~~~~t 1.2 These regulations shall come into force from it's publication in Chhattisgarh Rajpatra. 2. Amendment in Regulation 7 (1) (b) In Regulation 7(1) (b) the following proviso may be inserted:- "Provided that, in case the quorum could not be fulfilled due to vacancies in post of members, or any of the members is unable to attend meetings for a long time, by the reasons of health or any other genuine cause, the chairperson or in case of his absence the other member nominated by the chairperson or in absence of such nomination, the senior member present, by stating the reasons and the cause of urgency in writing, may hear and decide urgent matter presented before him. Provided further that, no single member may take such decisions which may affect the prevailing tariff and policies. Provided further that, if, there is only one Member of the Commission is available, due to vacancy, the quorum of the proceedings of the Commission also shall be one and in this situation the single member may take all such decision, for which the Commission is empowered.” 3. Amendment in Regulation 23 Following sub clause-4 may be inserted after sub clause-3 of regulation 23:- "(4) Admissibility of any review petition shall be decided within 30 days of it's filling. Every review petition must be decided within one hundred twenty days from the date of receipt of the petition. If the order could not be passed in the time frame, the cause of delay must be expressed in the Commission's order." By Order of the Commission Secretary
