Sllggestions have been received for amendment to the. regulations to facilitate their operation and for removal' of functional difficulties from the same. After a series of consultations at various levels, it has been decided to bring out, a new set of regulations in supersession of the existing one. Now, therefore, in exerCIse of the powers conferred under section 32 (2) of the NCTE Act,. 1993, the National Council for Teacher Education hereby makes the following regulations, namely:- 1. Short Title and Commencement (1) These Regulations may be called the National Council for Teacher Education (Recognition Norms & Procedure) Regulations, 2Q05. (2) They shall come into force with effect from the date of their publication in the Official Gazette. 2. Definitions In these regulations, unless the context otherwise requires, aJl the words and expressions used herein and defined in the National Council for Teacher Education Act, 1993 (73 of 1993) shall have the same meaning respectively assigned to them in the said. Eligibility Ma~ner of making application I The following categories of institutions are _~ligihle for consideration of their applications under these regulations:- (1) Institutions established by or under the a~ttority -of Central/ State Government / UT Administration; - (2) - Institutions financed by Central/ State Goverhment/ UT -Admiilistrationto the extent of not less th~n 50% -of their recurring cost; - I (3) All universities~ including institutions deemed to be universities, so recognized under UOC Act, 1956. Self financed educational institutions established and operated by not for profit' Societies apd Trusts- registered under the appropriate law. I I I I I (1) An institution eligible under Regulation 4, desirous of running a teacher education programme may apply to the concerned Regional Committee of NCTE in the I prescribed form in triplicate along with processing fe"e and requisite documents, for recognition. I (2) The form can be downloaded fr-om the CounCil's website www.ncte-in.or~, free of cost. The said form lean-also be obtained from the office of the Reglonal Committee concerned by payment of Rs. 1000 by way of a demand draft of a Nationalised Bank drawn in favour of the - I Member Secret~, NCTE payable at the city where the_ Qfficeof the Regional Committee is located. ; (3) All - application can - be submitted -conventionally or electronically ~n-line. In the latter case, the requisite documents in triplicate along with the pr6cessing fee shall be submitted separately to the office of the f.. f I: I Regional Committee concerned. Those who apply on- line shall have the benefit of not to pay for the form. 6. Processing Fees There shall be a uniform fees of Rs. 40,000 j - for processing an application for grant of recognition to ari institution to conduct a teacher education programme or addition to programme or intake in the existing programme payable in the form of a demand draft of any Nationalized Bank drawn in favour of the Member Secretary, NCTE payable at the city where the office of Regional Committee is situated. 7. Processing of applications (1) Applications which .are complete in all respects shall be processed by the office of the Regional Committee concerned within 30 days of receipt of the such applications. (2) The applications shall be processed as under :_ (i) The particulars of the institutions shall be hosted on the official website of the RegionaJ Committee concerned of the National Council for Teacher Education. (ii) This will serve as an electronic communication to the applicant an9also the State Government JUT Administration concerned for necessary follow up action on their part. (iii) A written communication in addition shall also follow to the applicant. (iv) A written corrimunication alongwith a copy of .the application. form submitted by the institution(s) of the concerned state/V.T. shall be sent to the State On receipt of thecotnmunication, the State Governrnent/UT Administration concerned shall furnish its recommendations on. the applications ,to the .office of the Regional Committee concerned of the National Council for Teacher Education within 60. days from r~ceipt. If the recommendation is negative, the .State. Government/UT Administration shan j I; I I I I I I, I I I I I [PART Ill-SEC. 4] I Ordinarily, the inspection of infrastructure, equipment, instructional facilities etc. of an institution shall be conducted I within 30 days of completion of processing of its application by the office of the Regional Committee with I .a .view to assessing the level. of preparedness of the institution to commence the course. Such inspection shall 1 be in the . \ ,. I chronological order of the date of receipt of th~. completed application in the office of the Regional Committee concerned. Among the applications received on the same day, . I alphabetical order shall be followed. I I All the applicant institutions are expected Jo laun~h their own webs~te .simultane~usly with the sl,lbmission of their applications coveringi"in'fer alia, the details of the institution, its locatfon, name :of the ,course applied for with intake, availability of physi~al infrastructure (land, buil~ing, office,' classrooms, and other facilities/amenities), iJ:1structional. facilities (laboratory,. 'libniry etc.) 'and the particulars: of their . I'proposed. teaching and non-teaching staff I etc. with photographs for infotrriation of all concemed. I • fr to .l -f J' videographed In a manner that all important facilities are videographed along with interaction with the management an,d the staff (if available). The visiting teams shall finalize and courier their reports alongwith the' video tapes on the same day. (8) The application and the report alongwith the video tapes of the Visiting Team shall be placed before the Regional Committee concemed for consideration of grant of recognition or permission to an institution in its next meeting. (9) The Regional Committee shall decide grant of recognition or permission to an institution only after satisfying itself that the institution fulfills all the conditions prescribed by the NCTE under the NCTE Act, Rules or Regulations, including, inter alia,: the norms and standards laid down for the relevant. teacher education programme/ course. (10) In the matter of grant of recognition, the Regional Committees shall strictly act within the ambit of the National Council for Teacher Education Act, 1993, the National Council for Teacher Education Rules, 1997 as amended from time to time and the regulations including the norms and standards for various teacher, education programmes a.nd shall not make any relaxation thereto. The Regional Directors shall be responsible for ensuring that the decisions of the Regional Committees are not in contravention of the NCTE Act, NCTE Rules and regulations including the norms and standards. (11) The institution concerned shall be informed of the decision for grant of recognition or permission subject to appointment of qualified faculty members before the commencement of the academic session. (12) The institution concerned, after appointing the requisite faculty/staff, shall put the information on its official website and also formally inform the Regional Committee concemed. The Regional' Committee' concerned shall then issue a formal unconditional recognition order. However, no such fee is reqyired if the deficiencies pointed out are minor in nature not involving civil ' . I ' construction or the like and the rectifications are verifiable without physical inspection. : I IThe reports of inspection of the institutions along with the names, of the Visiting Team Experts sh8.llbe made available on the official website of the Regional Committee: concerned after the same have been considered by the Regional ' • ICommIttee. I I I I I IAn institution must fulfill all the prescribed conditions related .' Ito norms and standards as prescnbed by the, NCTE for conducting the course or training in teacher' education. These norms, inter alia, cover conditions relating to financial, resources, accommodation, library, laboratory, 9ther physical infrastructure, qualified staff including teaching,: and non~ tea,ching personnel, etc. I I IIn the first instance, an institution shall be considered for Igrant of recognition for the 'basic unit as, prescribed in the norms, & standards for the particular teacher: education programme. . An institution shall be permitted to apply for enhancement of intake in a teacher edUcation course already app~6vedafter ' completion of three academic sessions of running tHe course'. I An institution shall be perrnitted to apply for enharicement, of intake in Secondary Teacher Education Programme B.Ed. & B.P.Ed. Programme, if it has accredited' itself with the National Assessment and Accreditation Council' (NAAC), I ~f;1k~/4 ~'{(r ~ffi~,~~ I I r I: with a grade of B+ on a NAAC. nine point scale developed by (5) No institution shall be granted recognition under these regulations unless itis in poss~ssion of required land on the date of application .. The land free from all encumbrai'1ces. could be either on ownership basis or on lease for a period of not less than 30 years. In cases where under relevant State/DT laws the maximum permissible lease period is less than 30 years, the State Government/DT Administration law shall prevail. (6) The institution/ ~ocietyshall furnish an affidavit on Rs. 100 stamp paper duly att.ested by Oath Commissioner stating the precise location of tl1e land (village, district, state etc.), the total area in possessIon and the permission of the competent authority to use the' land for educational purposes, mode of possession i.e. ownership or lease. The affidavit shall be relied upon by the Regional Committee as' an authentic self-declaration. The copy of the affidavit sheill be displayed by the institution on its official website so as to make the self-declara.tion available in public domain. In case the contents of the affidavit are found to be'incorrect or false, the society jtrust or the institution concerned shall be liable for action under the relevant provisions of Indian Penal Code and other relevant laws.' In case of Government institutions the said affidavit shall be furnished by the Principal or. the Head of the Institution or any other higher authority. At the time of inspection, the building of the in'stitution shall .be complete in the form of a permanent structure on the land possessed by the institution' in terms of Regulation 8(5), equipped with all necessary amenities ana fulfilling all such requirements as prescribed in the norms and stm:dards. In case of change of premises, prior approval of the. Regional Committee concemed shall be necessary, which could be accorded after due inspection' of the institution at the new site. The change can be permitted to a site which, if applied initially, could have qualified for establishment of an institution as per prescribed norms of NCTE. The change should be displayed on website thereafter. The application for' I j I r I I i r I • I 20 THE GAZEITE OF INDIA: EXTRAORDINARY (PART III-SEC. 4) - -- I --- change of premises shall be accompanied by a demand draft. of Rs. 40,000/- of a Nationalized Bank drawn in favour of the Member Secretary, NCTE and payable at the city where the Regional Committee is located. : (10) An institution shall make admission unconditional letter of recognition Committee conc~rned, and affiliation body. only after it obtains from the I Regional from the examining I I I Whenever there are changes in the norms and standards for the course or training in teacher education, the institution shall comply with the requirements laid down in the revised -norms and standards immediately but not later than the date of commencement of the next academic session, subject to conditions prescribe:d in the reVised norms. : I I An institution shall have copies of all relevant Acts, IRules and Regulations of NCTE, Central and State/ UU' Govts., affiliating/ examining -bodies, and other Central/IState/ UT authorities, relevant to the running of an educational in~titution currently in force. The institution shall make all - I the infor:,mation/ documents available to the NqTE or its authorised representatives as and when demanded by them. Failure to produce/ show any of these documents, shall be treated as a breach of condition for recognition. I The institution shall maintain records/ registers land other documents etc., which are essential for running an educational institytion especially those prescrib1ed in the relevant noms and standards and guidelines/ instructions/ rules etc. of the Central/ State/ UT Govts, 'affiliating/ examining bodies. The institution shcUl adhere to the mandatory disclosure in the prescribed format and display up-to-date information on its official website. -: I i I I i I I 'I I 9. Financial Manage~ent: (1) In the case of self - financed institutions I including Government/ Government aided _institutions tunning a course on self-financing basis, there shall be an endowment I I f}-~ fund of Rs. 5.00 lakh per course per unit and a reserve fund ofRs. 3.00 lakh per course per unit of approved intake, in the form. of a Fixed Deposit of a duration of and above 5 years of a nationalized bank. Th~ endowment fund shall. be operated jointly by the authorized representative of the management and an officer of the Regional Committee concerned. The payment of salary to the staff should be through cheques only. Following statements of Accounts, duly certified by a Chartered Accountant, shall be maintained and displayed on its official website by every institution every financial year by 30th September of the year. (i) Balance Sheet as on the last date of the financial year .. (ii) Profit and Loss Account for the financial year. (iii) Receipt and Payment Account for the .financial year. 10. Power to Relax On the recommendations of State Government/ UT Administration concerned and only for removal of any hardship caused in adhering to the provisions in these regulations, in circumstances peculiar to the said State/D.T.,it shall be competent for the Chairperson, National Council for Teacher Education, for reasons to be .recorded in writing, to relax any of the" provisions of these regulations" in respect of any class or category of institutions in the concerned state/U.T., to such extent and subject to such cQnditions, as may be specified in the order allowing r~laxation. i I I I i I I I I I I r,..
