Short title, extent and commencement.- (1) These Rules may be called the “Bihar Nursing Teaching Cadre Rules, 2019.” (2) It shall extend to the whole of the State of Bihar. (3) It shall come into force from the date of its publication in official gazette. 2. Definitions.- In these Rules, unless otherwise required in the subject or context- (i) ‘Government’ means Bihar State Government; (ii) ‘Department’ means Health Department; (iii) ‘Appointing Authority’ means State Government of Bihar; (iv) ‘Commission’ means Bihar Technical Service Commission; (v) ‘Cadre’ means Bihar Nursing Teaching Cadre; (vi) ‘Recognized Institutions’ means the institution recognized by the Indian Nursing Council, New Delhi/Health Department, Bihar, Patna; and (vii) ‘Appendix’ means appendix appended to these Rules. 3. Constitution & Structure of the cadre.- (1) This cadre shall be State Level. In this cadre, the number of posts in each grade shall be such as may be sanctioned by the government, from time to time: (2) The following posts of Nursing Training Schools/ Institutions and Nursing Directorate will be included in this cadre- (a) Tutor - Basic Grade (b) Principal and equivalent - First Chain (c) Deputy Director, Nursing - Second Chain (d) Joint Director, Nursing - Third Chain 4. Recruitment.- The appointment in this cadre shall be made by direct recruitment to the basic category posts, on the basis of recommendation of the Commission. 5. Qualifications.- (1) For appointment by direct recruitment to the basic category posts, qualifications shall be pass in M.Sc. Nursing or B.Sc. Nursing (Basic/Post Basic) Course or Diploma in Nursing Education and Administration (D.N.E.A.) course with two years professional work experience, of the period determined by the Indian Nursing Council from time to time from a recognised institution and a certificate related thereto shall be necessary. Registration of candidates from Bihar Nurses Registration Council, Patna shall also be necessary. (2) For direct recruitment, minimum age limit shall be 21 years and maximum age limit shall be the same as determined reservation categorywise, from time to time, by the Government (General Administration Department): Provided that, for the purpose of giving opportunity of appointment to the Sister Tutor/Tutor appointed and working on contractual basis in the Government Nursing Schools of Bihar State, having requisite qualification determined under sub&rule (1), the maximum age limit may be relaxed, from time to time. (3) For the purpose of determining age, 1st August of the concerned year shall be deemed to be the cut off date. 6. Procedure of Recruitment.- (1) The Appointing Authority, after calculating the vacancy on the basis of position as on 1st April of the year and getting roster cleared, shall send reservation categorywise requisition to the Commission by 30th April. (2) In light of the requisition, the Commission shall invite applications by advertising vacancies and shall prepare a merit list on the following basis:- (a) For marks obtained in B. Sc. Nursing (Basic/Post Basic) or D.N.E.A. course examination - 60 Marks (b) For M. Sc. Nursing course - 15 Marks (c) For teaching experience as a Sister Tutor/Tutor in Government Nursing School of Bihar state (5 Marks per year, maximum 25 marks) - 25 Marks Total - 100 Marks Explanation:- The marks to be given to a candidate for B.Sc. Nursing (Basic/Post Basic) or D.N.E.A. course shall be determined by multiplying the percentage of total marks obtained in the aforesaid examination by the multiple of 0.6 . For example, if a candidate has obtained 50% marks, then he will be given 50 X 0.6 ¾ 30 marks. Note- Provided that the desirous Staff Nurse Grade 'A', who were sent for training in Post Basic B.Sc. Nursing course by the State Government before the year 2014, on having passed in the said course, may be promoted to the basic grade post of Tutor of the Bihar Nursing Teaching Cadre as one time measure. (3) After preparing merit list on the basis of sub-rule (2), reservation categorywise recommendations in accordance with requisitioned vacancies shall be sent by the Commission to the Department. At the level of Department, after scrutiny of certificate etc., verification of antecedents of the recommended candidates shall be caused to be accomplished. (4) After recommendation of the Commission, compliance of instructions issued by the Government (General Administration Department) from time to time, with respect to procedure of appointment, shall be necessary. 7. Probation period.- After appointment, the candidates shall remain under probation. The probation period will be of two years. In case, the service during probation period is not found satisfactory, the probation period will be extended for one year. If the service is not found satisfactory in the extended period also, then the appointing authority may terminate the service of such Tutor. 8.Training.- In probation period, the Tutor shall have to successfully complete such training (including treasury training), which may be determined by the Department. 9. Departmental Examination.- The Tutor shall have to pass the departmental examination conducted by the Central Examination Committee, Board of Revenue, Bihar. The subject, syllabus and procedure of departmental examination shall be determined by the Board of Revenue, Bihar in consultation with the Department. 10. Confirmation.- On service being satisfactory during probation period successful completion of training and passing of the departmental examination, a Tutor may be confirmed in the service. 11. Seniority.- The inter-se seniority of the Tutor shall be determined according to the merit list prepared finally by the Commission. 12. Promotion.- (1) Subject to availability of vacany, a confirmed Tutor on having obtained a minimum of ten years teaching experience shall be considered for promotion from the post of Tutor to the next chain of posts of Principal and equivalent, on the basis of seniority-cum-merit: Explanation.- The post of Assistant Director (Nursing) and Registrar shall be equivalent to the post of Principal: Provided that according to necessity, M.Sc Nursing pass person (with three years teaching experience) or B.Sc Nursing (Basic/ Post Basic) pass person (with five years teaching experience) may be appointed on the post of Principal by direct lateral entry. The procedure of selection for lateral appointment shall be in accordance with the procedure enumerated in rule-6(2). Rule 7, 8, 9 and 10 shall be applicable to the Principal appointed by this procedure. (2) Deputy Director, Nursing & This post shall be filled up by promotion from amongst the holder of post of Principals and equivanent post on the basis of seniority-cum-merit, subject to availability of vacancy. (3) Joint Director, Nursing & This post shall be filled up by promotion from amongst the holder of the post of Deputy Director, Nursing, on the basis of seniority-cum-merit, subject to availability of vacancy. (4) At the time of consideration of promotion to the posts of Deputy Director, Nursing and Joint Director, Nursing, compliance of instructions concerning KALAWADHI, issued by the Government (General Administration Department), from time to time, shall be necessary. (5) Compliance of instructions issued by the Government, from time to time, with respect to promotion and Character Roll/PAR, Sealed cover system; etc shall be necessary at the time of consideration of promotion. (6) Till the post of Assistant Director, Deputy Director and Joint Director of the Nursing Cadre are not filled up by posting/promotion, the posts may be filled up by deputation or appointment on contractual basis for which the honorarium determined by the Government will be payable. 13. Departmental Promotion Committee.- (1) Promotions shall be considerable on the basis of recommendations of the Departmental Promotion Committee. (2) The Departmental Promotion Committee shall be the same as are constituted by the Government for the Service Departments; Provided that for consideration of promotion in the maximum grade pay/pay level, the chairman or any Member of the Bihar Public Service Commission shall be the Chairman of the Departmental Promotion Committee. 14. Reservation.- Compliance of provisions of Reservation Act of the Government and reservation roster for direct recruitment and promotion issued, from time to time, by the Government shall be compulsory. 15. The personnels appointed/promoted and working before the commencement of these Rules on the posts of this cadre mentioned in appendix of these Rules shall be deemed to be automatically included in this cadre. 16. Residuary Matters.- For the subjects for which provisions have not been made in these Rules, provisions of concerned Code/Rules/Resolutions/Instructions of the state shall apply. 17. Removal of Doubt.- If any doubt arises with respect to interpretation of any provision of these Rules, it shall be referred to the Department and in this respect the decision of the Department after consultation with the Law Department, shall be final. 18. Removal of Difficulties.- If any difficulty arises in implementation of provisions of these Rules, the Department may remove such difficulty, after consultation of the Law Department, by such order which is not in consistent with provisions of these Rules and necessary and appropriate for removal of such difficulty. 19. Repeal and Savings.- (1) The Bihar Nursing Teaching Cadre Rules, 2014 and Bihar Nursing Teaching Cadre (Amendment) Rules, 2016 is hereby repealed with the coming into effect of these Rules. (2) Notwithstanding such repeal, anything done or any action taken under the said Rules shall be deemed to be done or taken under these Rules, as if these Rules were in force on the date on which such thing was done or such action was taken. Note:- The Pay Band, Grade Pay and Pay Level of all the aforesaid categories shall be the same as if may be determined by the Government, from time to time.
