AT 4256(), AT 12 wzAY, 2021 FIT AT F TS, AHTLTI, ST MINISTRY OF ENVIRONMENT, FOREST AND CLIMATE CHANGE NOTIFICATION New Delhi, the 16th February, 2 2 S.0. 745(E).—In exercise of the powers conferred by sub-section (3) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986) and in pursuance of the notification of the Government of India in the erstwhile Ministry of Environment and Forests, number S.O. 1533(E), dated the 14th September, 2006, the Central Government hereby makes the following amendment in the notification of the Government of India in the Ministry of Environment, Forest and Climate Change, published in the Gazette of India, Extraordinary, Part II, Section 3, Sub- section (ii), vide number S.0. 4256(E), dated the 12th October 2021, namely:- In the said notification, in the table under the opening paragraph.- @) against serial number.1, in column (2), for the words “Rajeev Swarup”, the words “Rajeeva Swarup ” shall be substituted; (i) against serial number.3, in column (2), the word “Member” shall be omitted; (iii) in paragraph 4, after the brackets, letters and figure “(SEAC-1)”, the words, figures, brackets and letters “or State level Expert Appraisal Committee-2 (SEAC-2), as the case may be” shall be inserted. Rajasthan 2. The Chairman and Members of the Authority, Rajasthan shall hold office for a term of three years from the date of publication of this notification in the Official Gazette. 3. The Authority, Rajasthan shall exercise such powers and follow such procedures as specified in the said notification. 4. The Authority, Rajasthan shall take its decision on the recommendations of the State Level Expert Appraisal Committee-1 (SEAC-1) constituted under paragraph 5 for the State of Rajasthan. 5. For the purpose of assisting the Authority, Rajasthan, the Central Government in consultation with the State Government of Rajasthan, hereby constitutes two State Level Expert Appraisal Committees, that is, the State Level Expert Appraisal Committee-1 and State Level Expert Appraisal Committee-2 (hereinafter referred to as the SEAC-1 and SEAC-2, Rajasthan) comprising of the following Members, namely: - SEAC-1, Rajasthan 1. The Chairman and Members of the SEAC-1 and SEAC-2, Rajasthan shall hold office for a term of three years from the date of publication of this notification in the Official Gazette. 7. The SEAC-1 and SEAC-2, Rajasthan shall exercise such powers and follow such procedures as specified in the said notification. 8. The SEAC-1 and SEAC-2, Rajasthan shall function on the principle of collective responsibility and the Chairman shall endeavor to reach a consensus in each case, and if consensus cannot be reached, the view of the majority shall prevail. 9. In order to avoid any conflict of interest, - (a) the Chairman and Members of the Authority, Rajasthan and SEAC-1 and SEAC-2, Rajasthan, shall declare as to which consulting organisation they have been associated with and also the project proponents; () the Chairman and Members of the Authority, Rajasthan and SEAC-1 and SEAC-2, Rajasthan shall not undertake any consultation or associate with preparation of Environmental Impact Assessment (EIA) Environment Management Plan for a project, which is to be appraised by the Authority, Rajasthan and SEAC-1 and SEAC-2, Rajasthan during their tenure; and (© if in the past five years, the Chairman or any of the Members of the Authority, Rajasthan and SEAC- 1 and SEAC-2, Rajasthan have provided consultancy services or conducted EIA studies for any project proponent, in that event they shall recuse themselves from the meeting of the Authority, Rajasthan and SEAC-1 and SEAC-2, Rajasthan in the process of appraisal of any project being proposed by such proponents. 10. The Government of Rajasthan shall notify an agency to act as Secretariat for the Authority, Rajasthan and SEAC-1 and SEAC-2, Rajasthan and the Secretariat shall provide all financial and logistic support including accommodation, transportation and such other facilities in respect of all their statutory functions. 11 The sitting fee, travelling allowances and dearness allowances to the Chairman and Members of the Authority, Rajasthan and SEAC-1 and SEAC-2, Rajasthan shall be paid as per the rules of the State Government of Rajasthan JIGMET TAKPA, Jt.
