MADHYA PRADESH ORDINANCE NO. 4 oF 2021 THE MADHYA PRADESH MOTOR SPIRIT UPKAR (SANSHODHAN), ADHYADESH, 2021 {First published in the “Madhya Pradesh Gazette (Extra-ordinary)’’, dated the 11th January, 2021.] Promulgated by the Governor in the seventy first year of the Republic of India. An Ordinance further to amend the Madhya Pradesh Motor Spirit Upkar Adhiniyam, 2018. Wuereas, the State Legislature is not in session and the Governor of Madhya Pradesh is satisfied that circumstances exist which render it necessary to take immediate action; Now, THEREFORE. in exercise of the powers conferred by clause (1) of Article 213 of the constitution of India, the Governor of Madhya Pradesh is pleased to promulgate the following Ordinance:— lt. (1) This Ordinance (Sanshodhan) Adhyadesh. 2021. may be called the Madhya Pradesh Motor Spirit Upkar (2) The provisions of this Ordinance shall come into force from such date, as the State government may, by notification in the Gazette. appoint. a During the period of operation of this Ordinance, the Madhya Pradesh Motor Spirit Upkar Adhiniyam,. 2018 Act. 2018 (No. IL of 2018) (hereinafter referred to as the principal Act). shall have effect subject to the amendment specified In Section 3. 3. for clause (f) of sub-section (1) of Section 2 of the principal Act, the following clause shall be substituted, namely:— “(f) “taxable turnover” in relation to a dealer means that part of the dealer's turnover which remains after deducting therefrom,— (i) the sale price of Motor Spirit purchased from a registered dealer where cess is payable by the selling dealer on such sale made to the purchasing dealer; (ii) amount collected by the way of cess under section 3 or the amount received at by applying the following formula: Rate of cess x Turnover obtained after deducting the sale price under clause (1). if any (100+ Rate of cess) Provided that no deductions on the basis of the above formula, shall be made if the amount by way of the cess collected by a registered dealer, in accordance with the provisions of this Act, has been otherwise deducted from the turnover;”’.
