In exercise o the powers under sections 25-A and 26-X of the Uttar Pradesh Krishi Utpadan Mandi Adhiniyam, 1964 (U. P. Act no. XXV of 1964) the State Agricultural Produce Market Board, with the previous approval of the State Government, makes the following regulations:- THE UTTAR PRADESH AGRICULTURAL PRODUCE MARKET COMMITTEES (CENTRALISED) SERVICES REGULATIONS, 1984 PART 1-GENERAL Short title and commencement. 1. (1) These regulations may be called the Uttar Pradesh Agricultural Produce Market Committees (Centralised) Service Regulations, 1984. (2) They shall come into force with effect from the date of their publication in the Gazette. Status of the Service. 2. The Uttar Pradesh Agricultural Produce Market Committees (centralised) Service comprises [Class C posts and Class D posts]. Definitions. 3. In these regulations :- 2[(a) "appointing authority" means- (1) The Director in relation to the post of Secretary of a Market Committee; or (2) The Regional Deputy Director (Administration) in relation to the officers or the officials other than the employees holding posts specified in this clause; or (3) the Secretary to the Market Committee in relation to the employees holding (b) "Additional Director" means the Additional Director of Mandis, (c) "Board" means the State Agricultural Produce Markets board, Lucknow, d) "Cadre" means a cadre in the centralised Service, (e) " Centralised Service" means services common to the Market Committees created under regulation 4 of these regulations, (f) "Citizen of India" means a person who is or is deemed to be a citizen of India under Part II of the Constitution; (g) "Director" means the Director of Mandis; (h) "Government" means the Government of Uttar Pradesh; (i) "Market Committes" means a Committee constituted under section 13 of the Uttar Pradesh Krishi Utpadan Mandi Adhiniyam, 1964; (j) "Regional Deputy Director" means the Deputy Director Mandis incharge of the region in which Market Committee is situate; (k) "region" means the area within the jurisdiction of a Deputy Director allotted by the Director for general superintendence from time to time; (l) "Secretary" means the Secretary of a Market Committee; (m) "Selection Committee" means the Committee constituted under these regulations for selection of candidates to the various cadres of the service; (n) "Service" means the Uttar Pradesh Agricultural Produce Market Committees Centralised Service; 1- Substituted by Regulation 3 of The Uttar Pradesh Agricultural Produce Market Committees (Centralised) Services (First Amendment) Regulations, 1989 2- Substituted by Regulation 4 of The Uttar Pradesh Agricultural Produce Market Committees (Centralised) Services (First Amendment) Regulations, 1989 (o) "Substantive appointment" means an appointment, not being an ad hoc appointment, on a post in the cadre of the service, made after selection in accordance with these regulations. (p) "Year of recruitment" means the period of twelve months commencing from the first day of July of a calendar year. Creation of Centralised Service. 1[4. With effect from the commencement of these regulations there shall be a centralised services for the Market Committees consisting of the cadres and posts given below:- 1. Secretaries: 2. Market Staff- (a) Mandi Paryavekshak, 3. Accounts Staff- (a) Accountant, (c) Cashier-cum-clerk. 4. General Staff- (a) Head Clerk, (b) Clerk-cum-typist. 5. Fourth Class Staff- (a) Mandi Sahayak (Kamdar), (b) Peon (c) Chaukidar (f) Waterman (g) Mali (i) Lineman (j) Electrician (k) Driver (l) Bhisti (m) Sweeper] Classification of posts. 5. The posts in the Centralised Service for purposes of appointment, control and discipline, shall be classified in 2[Class B, Class C and Class D] according to its pay scale as per classification of posts under the State Government in force from time to time. PART II 1. Substituted by Regulation 2 of The Uttar Pradesh Agricultural Produce Market Committees (Centralised) Services (Amendment) Regulations, 1991. 2. Substituted by Regulation 6 of The Uttar Pradesh Agricultural Produce Market Committees (Centralised) Services (First Amendment) Regulations, 1989. Strength of Service. 1[6. (1) The strength of the service and of each category of posts there and the scales of pay shall be such as may be determined by the Board from time to time. Provided that scales of pay shall be such as may be recommended from time to time by the Pay Commission and approved by the State Government.] (2) All the existing posts under the Market Committee covered by the Centralised Service shall form the present strength of the Service. 3) The appointing authority may leave unfilled or the Board may hold in abeyance, any vacant post or class of posts without thereby entitling any person to compensation. (4) The Board may create such additional permanent or temporary posts from time to time as may be found necessary. Academic and other Qualifications 2[7. A candidate for direct recruitment to the various posts in the cadre of the service must possess the qualification laid down in column 2 of the table given below. Other things being equal, preference shall be given to a candidate possessing the qualification and/or experience laid down in column 3 of the said table: name of post essentials qualification preferential qualification 1-secretary class-3 grade-3 Bachelors Degree in Agriculture, agriculture Marketing. Science, Commerce, Economics or Agriculture Economics from a recognised University. Preference shall be given to the candidates having Post Graduate Degree from a recognised University in a Agriculture Marketing or M.B.A. (Agri Business Management) from the institute recognised by AICTE or equivalent thereof 2-secretary class-2 Bachelors Degree in Agriculture, agriculture Marketing. Science, Commerce, Economics/ Agriculture Economics from a recognised University. Preference shall be given to the candidates having Post Graduate Degrees from recognised University in Agriculture Marketing or M.B.A. (Agri Business Manage ment) from the institute recognised by AICTE or equivalent thereof 3- (1) mandi prayavekshak for general candidates Bachelors Degree from a recongnised University 1. Substituted by Regulation 2 of The Uttar Pradesh Agricultural Produce Market Committees (Centralised) Services (Fifth Amendment) Regulations, 2010.. 2. Substituted by Regulation 2 of The Uttar Pradesh Agricultural Produce Market Committees (Centralised) Services (Sisth Amendment) Regulations, 2010.. with atleast 50 percent marks and atleast 50 percent marks in intermediate. For scheduled Caste/ scheduled Tribes, Other Backward classes candidates Bachelor Degree from a recognised University with atleast 45 percent marks and atleast 45 percent marks in intermediate. (2) Amin/auctioners Bachelors Degree from a recognised University. Experience of agricultural marketing work (3) clerk-cum- typist/Cashier- cum-clerk/ account clerk Bachelors Degree from a recognised University. experience of handling of cash and having knowledge of keeping accounts and minimum speed of 25 word per minute in Hindi typing. high school pass one year experience in a market committee or in an Agriculture marketing orgnization. Age limits for the candidates for direct recruitment to different classes of posts in in the centralised service shall be as prescribed fer recruitment to posts under the State Government: Provided that the upper age limits for employees of the Committee shall be greater by five year or the number of years of service they have put in the Committee, whichever is less. Nationality, Character Status, Marital Status Physical Fitness 9. Regulations regarding character, marital status and physical fitness of the candidates for recruitment to different classes of posts in the Centralised Service shall be as prescribed for recruitment to posts under the State Govern ment. PART III-RECRUITMENT AND ITS PROCEDURE Sources of Recruiment. 10. Recruitment may be made either- (a) from open market (By direct recruitment); Provided that any posts required to be filled by direct recruitment, may, in the discretion of the Board, be filled by taking persons on deputation. Reservation 11. Reservation for candidates belonging to Scheduled castes, Scheduled tribes and others in respect of posts in the centralised service shall be made in accordance with the orders of the State Government in force at the time of recruitment. Constitution of Selection Committees 12. (1) For purposes of open recruitment to Class B posts whether from the open market or by promotion there shall be constituted a selection committee comprising- (i) two officers not below the rank of Deputy Secretary to be nominated by the Secretary to the State Government in the Agriculture Department. (ii) Three officers not below the rank of Deputy Director in the service the Board to be nominated by the Chairman of the Board. NOTE-The Chairman of the Selection Committee shall be nominated by the Secretary to the State Government in the Agriculture Department out of the officers mentioned in clauses (i) and (ii). (2) For purposes of recruitment to Class C, posts of the Secretaries/Mandi Paryavekshak from the open market or by promotion there shall be constituted a Selection Committee comprising-, (i) one officer not below the rank of a Deputy Secretary to be nomi-nated by the Secretary to the State Government in the Agriculture department. (ii) two officers not below the rank of a Deputy Director in the service of the Board to be nominated by the Director. NOTE-The Chairman of the Selection Committee shall be nominated by the Director out of the members mentioned in clauses () and (ii). (3) For recruitment to other Class C posts, whether by direct recruitment or by promotion, the selection committee shall consist of three officers including the chairman to be nominated by the Director. 1[(4) For recruitment to Class D posts the Selection Committee, shall consist of the Regional Deputy Director (Administration), one officer nominated by the Director and the Secretary and where there are more than one Secretary the senior most Secretary of the concerned Market Committee. The senior most officer among the shall be the Chairman.] Quota:- 1. (1), Subject to the provision of sub-rule (2) recruitment to various categories of posts in the cadres of the service shall be made from the source and in the proportion indicated below:- Name of post Source of recruitment percentage 1- secretary class-3 direct recruitment 100 By promotion of Secretary class 3, grade - 3who has put in atleast 5year continuous service as such (not being service on ad hoc basis ) as on the first day of year of recruitment. Name of post Source of recruitment percentage who have passed high school or equivalent examination and have 5year experience. 10- mandi sahayak chaukidar, mandi abhirakshak, security guard, waterman, mali, pump operator/ electrician, lineman electrician, driver, bhisti, sweeper. direct recruitment 100 (2) Except as otherwise provided in the regulation, any appointment made to the posts included in the centralised service as a result of regular selection before the promulgation of these regulations will be deemed to be an appointment under these regulation and shall be valid for all purposes. Determination of vacancies. 1[14.(a) The vacancies in Group 'B' shall be filled through requisition to Uttar Pradesh Public Service Commission, Allahabad. (b) Vacancies of Group 'C' shall be filled through requisition to Uttar Pradesh Subordinate Service Commission. (c) In case above service commissions are disbanded or do not existing or there are some urgent exigencies, the selection procedure shall be conducted by the market board or other institutions with the approval of the State Government.] Fees. 15. Candidates taking part in the selection by direct recruitment shall be required to pay to the appointing authority such fees as may be prescribed from time to time by the Board. Procedure of selection by direct recruitment. 16. (1) When the applications of the candidates have been received in response to the advertisement made under regulation 14 or the names are received through the employment exchanges the appointing authority shall fix a date for selection and forward the applications and names to the Selection Committee. 2[(2) The Selection Committee shall scrutinise the applications and prepare a list of aligible candidates. The Committee shall, having regard to the need for securing due representation of the candidates belonging to Scheduled Castes, Scheduled Tribes and other categories in accordance with regulation 11, call the eligible candidates for test and/or interview as it may decide. In the case of selection for the posts of clerk- cum-typist, cashier-cum-clerk, amin/auctioner, and group D posts the procedure laid down in the State Government's Subordinate Office Ministerial Staff (Direct Recruitment) Rules, 1985 of the Group D Employees Service Rules, 1985 as the case may be, as amended from time to time shell generally be adopted. The Committee shall prepare a list of candidates in order of a merit as disclosed by the marks obtained in the test and/or interview. If two or more candidates obtain equal marks, 1. Substituted by Regulation 10 of The Uttar Pradesh Agricultural Produce Market Committees (Centralised) Services (First Amendment) Regulations, 1989.. the Committee shall arrange their names on the basis of their age, the older in age being placed higher.] (3) The names of the candidates belonging to such categories for whom vacancies are required to be reserved under regulation 11 shall be arranged in a separate list according to their inter-se-merit disclosed by the marks obtained by them. (4) The number of candidates to be selected will be larger (but not larger by more than 25 per cent) than the number of vacancies for which the selection has been made. (5) The list prepared under sub-regulations (2) and (3) above shall be forwarded by the Selection Committee to the appointing authority mentioning the aggregate marks obtained at the selection by each candidate. The names of general and reserved candidates shall be arranged by the appointing authority in a common list according to the merit of the candidates having due regard to the posts reserved under regulation 11. Procedure of selection by promotion 17. (1) Selection for promotion shall be made by Selection Committee constituted under regulation 12. The criteria for Selection shall be seniority subject to rejection of the unfit. (2) The appointing authority shall prepare an eligibility list of the candidates arranged in order of seniority and place it before the selection committee along with their character rolls and other necessary records pertaining to them. (3) The Selection Committee shall consider the cases of the candidates on the basis of records referred to in sub-regulation (2) and if it considers necessary, it may interview the candidates also. (4) The selection committee shall prepare list of selected candidates arranged in order of seniority and forward the same to the appointing authority. Combined list 18. If appointment is to be made both by direct reoruitment and by pro motion, a combined select list shall be prepared by taking the names of the candidates from the lists prepared under regulations 16 and 17 in such manner that the prescribed percentage of direct recruitment and promotion is maintained the first name being from the list prepared under regulation 17. PART IV Retention and reversion of employees on deputation 19. (1) The Director shall prepare a list of all such Government servants who on the date of coming into force of these regulations, were serving on deputation and forward the same to a committee, constituted for the purpose consisting of the Director, the Additional Director and a nominee of the Secretary to the Government in the agriculture department, together with all the relevant papers including character rolls and service books, if any. (2) The Committee shall consider the papers referred to in sub-regulation (1) to Judge the suitability of such servants for retention in the Centralised Service and send its recommendation to the appointing authority. (3) The appointing authority shall consider the recommendation of the Committee and those servants, who are found suitable shall, by an order of the appointing authority become members of the cadre under clause (b) of sub-section (2) of section 23-A; Provided that if no orders are passed within six months of the enforcement of these regulations, all such servants shall be deemed to be suitable and shall become members of the cadre. PART V-APPOINTMENT, PROBATION, CONFIRMATION AND SENIORITY Appointment. 20. (1) The appointing authority shall make appointments against substantive vacancies by taking candidates in the order in which they stand in the lists prepared under regulations 16, 17 or 18 as the case may be. (2) The appointing authority may make appointments in temporary and officiating vacancies also from the lists referred in sub-regulation (1). (3) The candidates selected for appointment as Secretary shall not be given appointment unless they have successfully undergone a training prescribed for Market Secretarios by the Government of India, Ministry of Rural Reconstruction at present being imparted at Lucknow and Hyderabad Centres. Probation 21. (1) A candidate shall on appointment to a post in a substantive vacancy in the Centralised Service be placed on probation for a period of one year from the date of joining the post. (2) The appointing authority may, for reasons to be recorded, extend the period of probation specifying the date up to which the extension is granted but in no case the period of probation shall be extended by more than two years. (3) If it appears to the appointing authority at any time during or at the end of the period of probation that a probationer has not made sufficient use of his opportunities or has otherwise failed to give satisfaction, he may be roverted to his substantive post, if any, without assigning any reason. If he does not hold a lien or any post, his services may be dispensed with. (4) A probationer who is reverted or whose services are dispensed with under sub- regulation (3) shall not be entitled to any compensation. (5) The appointing authority may allow continuous service rendered in an officiating or temporary capacity in a post included in the cadre of the Centralised Service or any other equivalent or higher post, to be taken into account for the purpose of computing the period of probation. Confirmation. 22. A probationer directly appointed or promoted to a post in the Centralised Service shall be confirmed in his appointment by an order of the appointing authority at the end of his period of probation or extended period of probation, as the case may be, if- (a) he has satisfactorily completed the training prescribed, if any, (b) his work and conduct are reported to be satisfactory, (c) his integrity is certified; and (d) the appointing authority is satisfied that he is otherwise fit for confirmation. Seniority. 23. (1) Except as hereinafter provided, the seniority of persons in any category or grade of posts in the Centralised Service shall be determined from the date of the order of substantive appointment and if two or more persons are appointed together, by the order in which their names are arranged in the appointment order: Provided that if the appointment order specifies a particular back date with effect from which a person is substantively appointed, that date, will be deemed to be the date of order of substantive appointment and, in other cases, it will mean the date of issue of the order. (2) The Seniority interse of persons appointed directly on the result of any one selection, shall be the same as determined by the Selection Committee Provided that a candidate recruited directly may loose his seniority if he fails to join without valid reasons when vacancy is offered to him, the decision of the appointing authority as to the validity of reasons shall be final (3) The seniority interse of persons appointed by promotion shall be the same as it was in the cadre from which they were promoted. (4) Where appointments are made both by promotion and direct recruitment, the inter-se-seniority shall be determined by arranging the names in a cyclic order in a combined list. prepared in accordance with regulation 18, in such manner that the prescribed percentage is maintained. (5) Government servants serving on deputation on a post or grade in a cadre, who have been found suitable and become a member of the service under regulation 19 shall rank senior to those appointed to that post or grade in the cadre after the coming inte force of these regulation. The inter-se-seniority of such servants shall be the same as it was in their parent department. (6) Besides maintenance of seniority list of each category of posts in the service by the appointing authority concerned, a combined seniority list of such categories of officers as are eligible for promotion to the post of secretary of the market Committee shall be maintained at the Board's level also. Transfer of Members of the Services 1[(1) A member of contralised service [other than the employees mentioned in sub-regulation (2)) may be transferred from one Market Committes to another Market Com-mittee in the region by the order of the Director, or Additional Director or the Regional Deputy Director (Administration) and from one region to another region by the order of the Director or the Additional Director. The transfer travelling allowances of members of the centralised service shall be borne by the Market Committees to which he is transferred. 2[(2) The regional Deputy Director (Administration/Marketing) may transfer any member of the service holding the post of Group "D" from one Market Committee to another within the region and the Director or the Additional Director on the basis of mutual request or proven misconduct through proceedings as per rules can transfer them from one region to another.] (3) On transfer, the member of the service shall be entitled to travelling allowances as admissible to the State Government employees in the corresponding scale of pay. PART VI Paying Authority. 25. Subject to the provisions of these regulations the pay and allowances of persons appointed to the Certralised Service shall be paid by the Market Committee in which such persons is for the time being posted. Pay on recruitment 1. Substituted by Regulation 4 of The Uttar Pradesh Agricultural Produce Market Committees (Centralised) Services (Amendment) Regulations, 1991.. 2. Substituted by Regulation 2 of The Uttar Pradesh Agricultural Produce Market Committees (Centralised) Services (Ninth Amendment) Regulations, 2023.. 26. (1) A person directy recruited to the Centralised Service from the open market shall commençe to draw the minimum pay and allowances applicable to the post or the pay and allowances indicated in his letter of appointment from the date he assumes charge. (2) In the case of a member of the Centralised Service who is appointed on promotion from a lower grade, his pay shall be fixed in accordance with the provisions contained in F.H.B., Vol. II, Parts 11 to IV. (3) In the case of persons taken from Government on deputation., their terms and conditions of service shall be as agreed upon between the Board and the Government. Annual Increment 27. (1) An annual increment on the completion of one year of service may be allowed to a member of the Centralised Service at the rate shown in the time scale of pay in which he has been appointed, provided his increment has not been withheld as a disciplinary measure or he is not held up at an efficiency bar. (2) Increment in a time scale will be granted to a member of the service from the first day of the month in which it falls due. Pay during Probation. 28. A person, on probation, may be allowed his first increment in the time scale on completion of one year's satisfactory service, and second increment after two years's service when he has completed the probationary period and is also confirmed: Provided that if the period of probation is extended on account of failure to give satisfaction such extension shall not count for increment unless the appointing authority directs otherwise. Increment during extra-ordinary leave. 29. An increment due to a member of the service who has remained off duty on extra ordinary leave, shall correspondingly be shifted, and the period of such leave shall not count for increment. Crossing of effciency bar. 30. No member of the savice shall be allesed to cress (1) the first efficiency bar unless his work and conduct are found to be satisfactory and his Integrity is certified and (ii) the second efficiency bar unless he has worked deligently and to the best of his ability, has given full satisfaction by his work and conduct, and his integrity is certified. PART VII Commencement of sevices 31. Service of a person appointed to the Centralised service shall commence from the forenoon of a working day on which he reports for duty at a place in compliance with the orders of a competent authority. In case a candidate joins in the afternoon, his service shall commence from the following day. Leave 32. (1) Leave cannot be claimed as a matter of right. When the exigencies of service, require, the Director or any other officer authorised by him in this behalf shall have the full discretion to refuse or to cut short leave of any description. (2) Casual leave during a calendar year shall be limited to a maximum 14 days. In addition, a member of the service may avail of restricted leave subject to the limit of two days. (3) Officer authorised by the Director shall be the authority competent to grant casual leave to a member of the centralised service. Leave of other kinds shall be sanctioned by the Director or any other officer authorised by him in this behalf in accordance with the provisions in F. H. B., Vol. II, Parts II to IV. For this purpose a member of the service shall make an application through proper channel Scope of Service. 33. A member of the service shall devote himself exclusively to the duties assigned to him from time to time during the usual working hours and whenever necessary, as the exigencies of work require. Whole time of a member at the disposal of a market committee. 34. Whole time of a member of the service shall be at the disposal of a market committee and he shall serve the committee in such capacity as he may be directed from time to time. Observance by a member of orders of a superior authority. 35. A member of the service shall comply with and obey all orders and directions which may from time to time be given to him by any person under whose control and superintendence he may be working. Courtesy by a memberin official dealings. 36. A member of the service shall soryoia Market Committee honestly and faithfully, shall show courtesy, attention and diligence in his dealings with any person with whom he may may come into contact in his official capacity. Participation of a member subversive activities 37. A member of the service shall not take part in, and subscribe, in aid of, or assist in any way, any activity subversive of law and order. activities Absence with out permission. 38. A member of the service shall not leave the station of duty without obtaining prior permission from the competent authority, Application for employment else-where 39. A member of the service seeking employment elsewhere outside the Market Committee shall make an application through proper channel. The Director reserves the right to withhold such application without assigning any reaon therfor. Part-time Employment 40. A member while in service or on leave of any kind shall not accept or seek an outside employment without the prior written sanction of the appointing authority. Canvarsing 41. No recommendation, either written or oral, in regard to the candidature of a person for a post in the Centralised Service, will be taken into consideration, Any attempt on the part of a candidate to enlist support directly or indirectly in this connection will disqualify him for appointment. General Conduct 42. A member of the service shall at all times conduct himself in accordance with the provisions contained in the conduct rules applicable to Government servants in Uttar Pradesh which shall mutatis mutandis apply to him. Disciplinary Proceedings. 43. The rules relating to disciplinary proceeding, appeals and representations against punishment, applicable to the employees of the State Government shall matatis mutandis apply to the members of the centralised service. Holidays 44. The holidays to be observed by the members of the service shall be such as may be prescribed by the Board for each calendar year. Maintenance of service records and character rolls. 45. (1) A record of service and character rolis shall be maintained in respect of each member of the service in such forms as are prescribed by Government for its employees from time to time. (2) The appropriate authority, of each Market Committee shall send to the appointing authority by 30th Aprit each year his annuals confidential remarks in respect of the work and conduct, of the member of the Centralised corvices working under him. Age of Retirement. 46 (1) The date of superannuation of a member of the service shall be the date on which he attains the age of 60 years or that decided by the Board from time to time. (2) No member shall be retained in service beyond the date of superannuation without specific extension in service or re-employment being granted by the Board which, in no case, shall go beyond the age of 60 years with the prior approval of the State Government (3) Irrespective of the date on which a member attains the age of spar annuation, he will retire on the last day of the month in which he attains the ago of superannuation. (4) The appointing authority may permanent or temporary) without assigning any reason require him, to retire after he attains the age of 50 years or such member may by notice to the appointing authority volun tarily retire at any time after attaining the age of 45 years or after he has completed qualifying service of twenty years. The period of such notice shall be three months. Explanation-For taking action under sub-regulation (4) the provisions of clause (c) (including its explanation), of the "Funda-mental Rule 56 of the Uttar Pradesh Funda-mental Rules in Financial Handbook, Volume II, Parts II to IV as amended from time to time and such other rules, regula-tions, instructions, orders as may be generally applicable to Government servants serving in connection with the affairs of the State of Uttar Pradesh shall mutatis mutandis apply." Retirement benefits 47. (1) No pension shall be payable to a member of the Contralised Service. (2) The members of the Centralised Service shall contribute to Provident Fund in accordance with the provisions of the Employees Provident Fund Act and the regulations made therounder. (3) The Provident Fund Accounts of the members shall be maintained in accordance with such instructions as may be issued by the Director from time to time, (4) Employees covered by the Payment of Gratuity Act, 1972 will be paid gratuity according to the provisions of that Act, for employees who are not covered by the said Act, payment of gratuity shall be regulated by the decisions of the Board taken from time to time within the limitation of the general direction or guidelines issued by the State Government. Regulation of other other matter. 48. In regard to the matters not specifically covered by these tegulations or by other special orders, person appointed to the centralised service shall be governed by the rules, regulations, instructions and orders applicable generally to Government servants serving in connection with the affairs of the State of Uttar Pradesh. (2) In regard to the matters specifically covered or deemed to be specifically covered by these regulations or by special orders, for other details and further provisions in connections therewith not contained these regulations or other special orders, persons appointed to the centralised service shall be governed by the rules, regulations, instructions and orders applicable generally to Government servants serving in connec-tion with the affairs of the State of Uttar Pradesh. Relaxation from the conditions of service 49. Notwithstanding anything contained in these regulations, where the Board is satisfied that the operation of any of service of persons appointed to the service causes undue hardship in any of any regulation regulating the conditions particular case, it may, with the previous approval of the State Government, by order, dispense with or relax the requirements of that regulation to such extent and subject to such additions as it may consider necessary for dealing with the case in a just and equitable manner.
