EXTRAORDINARY PUBLISHED BY AUTHORITY No. 115] NEW DELHI, MONDAY, MARCH 8, 2021/PHALGUNA 17, 1942 MINISTRY OF ROAD TRANSPORT AND HIGHWAYS NOTIFICATION New Delhi, the 8th March, 2021 G.S.R. 156(E).—Whereas, the draft rules further to amend the Central Motor Vehicles Rules, 1989 were published, as required under sub-section (1) of section 212 of the Motor Vehicles Act, 1988 (59 of 1988), vide notification of the Government of India in the Ministry of Road Transport and Highways vide number G.S.R 757(E), dated the 11 th December, 2020 in the Gazette of India, Extraordinary, Part II, Section (3), Sub- section (i), inviting objections and suggestions from all persons likely to be affected thereby before the expiry of the period of thirty days from the date of which copies of the Gazette containing the said notification were made available to the public; And, whereas, copies of the said Gazette notification were made available to the public on the 11 th December, And, whereas, no objections and suggestions were received from the public in respect of the said draft rules; Now, therefore, in exercise of the powers conferred by section 110 of the Motor Vehicles Act, 1988 (59 of 1988), the Central Government hereby makes the following rules further to amend the Central Motor Vehicles Rules, 1989, namely:- 1. Short title and commencement-(1) These rules may be called as the Central Motor Vehicles (Fourth Amendment) Rules, 2021. (2) They shall come into force on the date of their publication in the Official Gazette. 2. In the Central Motor Vehicles Rules, 1989 (herein after referred to as the said rules), in rule 115,- (i) in sub-rule (18),- (A) in clause (i),- (1) in ‘Table 2’, in column relating to ‘Flex Fuel (1)’, for the brackets, letters and figures “Ethanol (E85)/(E100)”, the brackets, letters and figures “Ethanol (E20)/(E85)/(E100)”, shall be substituted; (2) in the ‘Notes’ given after ‘Table 2’,- (a) in serial number (4), after ‘item(h)’, the following items shall be inserted, namely:- “(i) The reference ethanol fuel (E100) shall be as specified in Annexure IV-SA. (j) The reference ethanol fuel (E20) shall be as per IS 17021: 2018.”; (b) in serial number (9), after ‘item (vii)’, the following items shall be inserted, namely:- “(viii) Specification for commercial ethanol fuel (E20) shall be as per IS 17021: 2018.”; (c) after serial number (20), the following serial shall be inserted, namely:- “(21) The compatibility of vehicle to level of ethanol blend of E20 or E85 or E100 shall be defined by the vehicle manufacturer and the same shall be displayed on vehicle by putting a clearly visible sticker.”; (B) in clause (ii), after serial number (17), the following serial shall be inserted, namely:- “(18) The compatibility of vehicle to level of ethanol blend of ED95 shall be defined by the vehicle manufacturer and the same shall be displayed on vehicle by putting a clearly visible sticker.”; (ii) in sub-rule (19), in clause (i), - (1) in ‘Table 2’, in column relating to Bi-fuel/Flex-fuel, for the brackets, letters and figures “Ethanol (E85)/(E100)”, the brackets, letters and figures “Ethanol (E20)/(E85)/(E100)”, shall be substituted; (2) in the ‘Notes’ given after ‘Table 2’,- (a) in serial number (4), after item(h), the following items shall be inserted, namely:- “(i) The reference ethanol fuel (E20) shall be as per IS 17021: 2018. (j) The reference for Hydrogen Compressed Natural Gas (HCNG) shall be as per IS 17314: 2019.”; (b) in serial number (5), after ‘item (f)’, the following items shall be inserted, namely:- “(g) Specification for commercial ethanol fuel (E20) shall be as per IS 17021: 2018. (h) Specification for commercial Hydrogen Enriched Compressed Natural Gas (HCNG) shall be as per IS 17314: 2019.”; (c) after serial number (13), the following serials shall be inserted, namely.- “(14) The CNG/Bio-CNG/HCNG vehicles shall meet all the safety requirements as per AIS 24 and AIS 28 (Revision 1), as applicable. (15) The compatibility of vehicle to level of ethanol blend of E20 or E85 or E100 shall be defined by the vehicle manufacturer and the same shall be displayed on vehicle by putting a clearly visible sticker.”; (iii) in sub rule (20),- (1) in ‘Table 2’, in column relating to Bi-fuel/Flex-fuel, for the brackets, letters and figures “Ethanol (E85)”, the brackets, letters and figures “Ethanol (E20)/(E85)/(E100)”, shall be substituted; (2) in the ‘Notes’ given after ‘Table 2’,- (a) in serial number ‘4’, after ‘item(f)’, the following items shall be inserted, namely:- “(g) The reference ethanol fuel (E100) shall be as specified in Annexure IV-SA. (h) The reference ethanol fuel (E20) shall be as per IS 17021: 2018.”; (b) in serial number ‘5’, after ‘item (vii)’, the following items shall be inserted, namely:- “(viii) Specification for commercial ethanol fuel (E20) shall be as per IS 17021: 2018.”; (c) after serial number ‘14’, the following serial shall be inserted, namely.- “15. The compatibility of vehicle to level of ethanol blend of E20 or E85 or E100 shall be defined by the vehicle manufacturer and the same shall be displayed on vehicle by putting a clearly visible sticker.”; (iv) in sub rule(22), - (1) in ‘Table 2’, in column relating to Bi-fuel/Flex-fuel, for the brackets, letters and figures “Ethanol (E85)/(E100)”, the brackets, letters and figures “Ethanol (E20)/(E85)/(E100)”, shall be substituted; (2) in the ‘Notes’ given after ‘Table 2’,- (a) in serial number ‘7’, after ‘item(g)’, the following items shall be inserted, namely:- “h. The reference ethanol fuel (E100) shall be as specified in Annexure IV-SA. i. The reference ethanol fuel (E20) shall be as per IS 17021: 2018. j. The reference for Hydrogen Compressed Natural Gas (HCNG) shall be as per IS 17314: 2019.”; (b) in serial number (8), after ‘item (f)’, the following items shall be inserted, namely:- “(g) Specification for commercial ethanol fuel (E20) shall be as per IS 17021: 2018. (h) Specification for commercial Hydrogen Enriched Compressed Natural Gas (HCNG) shall be as per IS 17314: 2019.”; (c) after serial number ‘13’, the following serials shall be inserted, namely:- “14. The CNG/Bio-CNG/HCNG vehicles shall meet all the safety requirements as per AIS 24 and AIS 28 (Revision 1), as applicable. 15. The compatibility of vehicle to level of ethanol blend of E20 or E85 or E100 shall be defined by the vehicle manufacturer and the same shall be displayed on vehicle by putting a clearly visible sticker.”; 3.
