Notification regarding compounding of forest offence 2025

RAJASTHAN GAZETTE Extraordinary Published by Authority Magha 09, Wednesday, Saka 1946- January 29, 2025 (Forest Department) NOTIFICATION Jaipur, January 07, 2025 S.O.114 .-In exercise of the powers conferred by section 68 and 76 of the Rajasthan Forest Act, 1953 (Act No. XIII of 1953) and in supersession of the Revenue department’s notification number F2 (20) Rev.Gr.8/ 79 Jaipur, dated 26th October 1986, the State Government hereby empowers the Forest Officers mentioned in column number2 of the table given below, within their respective territorial jurisdiction, for accepting compensation for compounding of offence mentioned in column number 3 according to the scale specified in column number4and estimated value mentioned in column number 5of the saidtable to be charged for release of seized vehicle/equipment/machinery. Forest Range Officer Grade- I/Forest Range Offences involving transport of forest produce by,- (i) Headloads, (ii) Animal loads or cycle loads. The amount of compensation for forest Produce being carried shall be equal to twice of its market value 2. Assistant Conservator of Field Director Offences involving transport of forest produce by,- (i) Animal driven vehicle, (i) 3. Deputy Conservator of Forest/Divisional Forest Offences involving transport of forest produce by Truck/ Dumper or any Chief Wildlife Director Tiger Project other mechanically driven vehicleother then tractor trolley, - (i) The value of vehicle / machinery is more than 25 lakhs and such vehicle/ machinery is upto 5 years old (ii) The value of is more than 25 lakhs and such vehicle/ machinery is more than 5 years and upto 10 years old (iii) Othervehicle/mach inery excluding clause (i) and (ii) above 4 Lakhs 3 Lakhs Note: 1. Where Offence involved the forest produce which is a mineral as per the provisions of theMines and Mineral (DevelopmentandRegulation) Act, 1957and rules made thereunder such offence shall not be compounded under this notification and same shall dealt with as per the provisions of the above Act of 1957 and rules made thereunder. 1. Estimated Value shall be charged for release of seized vehicle/equipment/machinery for first offence only and if such vehicle/equipment/machinery involved in second or subsequent offence such vehicle/ equipment/machinery shall be confiscated.
