UTTAR PRADESH SHASAN STAMP EVAM NIBANDHAN ANUBHAG-2 In pursuance of provisions of clause (3) of Article 348 of the Constitution of India, the Governor is pleased to order the publication of the following English translation of Government notification no. 11 /2022/912/94-SR-2-2022-700(45)/2022 dated : 02 September, 2022. Notification Order No . 11/2022/912/94-SR-2-2022-700(45)/2022 Lucknow, Dated : 02 September, 2022 In exercise of the powers under clause (a) of sub-section (1) of section 9 of the Indian Stamp Act, 1899 (Act No. 2 of 1899), as amended in its application to Uttar Pradesh read with section 21 of the General Clauses Act, 1897 (Act No. 10 of 1897) the Governor, from the date of publication of this notification in the Gazette, under the scheme of the State Government to establish Medical Colleges in 16 unserved districts (Baghpat, Ballia, Bhadohi, Chitrakoot, Hamirpur, Hathras, Kasganj, Maharajganj, Mahoba, Mainpuri, Mau, Rampur, Sambhal, Sant Kabir Nagar, Shamli and Shravasti) of Uttar Pradesh on Public Private Partnership (PPP) basis, is pleased to remit the stamp duty payable on the transfer deed of the land, executed in favour of the concerned unit for the establishment of medical college and attached hospital, subject to the conditions contained in the Uttar Pradesh Industrial Investment and Employment Promotion Policy, 2017. 2. This remittance shall be subject to the following conditions:- (a) District Magistrate or Deputy Commissioner Industries of the District shall sign such instrument as witness for the purpose of confirming the fact that the transfer deed is being executed for the purposes above-mentioned, and (b) Irrevocable Bank guarantee (The period of the bank guarantee shall be at least six months beyond the period as prescribed in the scheme) of the amount equal to the remission of stamp duty in favour of District Magistrate/Collector of the concerned district shall be presented before the Registering Officer at the time of registration of such transfer deed. In this regard, it shall be the liability of the Medical Education Department that it shall inform, the status of non- fulfillment of the purpose within the prescribed period, by the unit receiving such remission, to the District Magistrate of the district, immediately. In such a condition, the District Magistrate shall deposit the amount in the proper account head of the Stamp and Registration department, by impounding the bank guarantee : Provided that, upon confirmation of the fact by the Medical Education Department that the conditions under the scheme have been properly complied with by the concerned unit, the Bank Guarantee shall be released by the District Magistrate /Collector .
