Notification under Section-16

Gazette, Part I, dated 25th December, Whereas, the State Government is satisfied that for maintaining supplies of sugarcane to factories it is necessary and expedient so to do; Now, therefore, in exercise of the powers conferred by Section 16 of the Uttar Pradesh Sugarcane (Regulation of Supply and Purchase) Act, 1953, read with Section 21 of the U.P. General Clauses Act, 1904, the Governor, in supersession of Notification No. 2904-S/XVIII-C-1596-54, dated September 27, 1954, is pleased to order that in any of the following circumstances the occupier of a factory shall not purchase cane grown by any cane grower in an area which is reserved or assigned for the factory except through a cane growers’ co-operative society existing in that area- (i) Where not less than three-fourths of the cane growers of such area are members of a cane-growers’ co-operative society; or (ii) Where a cane growers’ co-operative society exists in such area and the Cane Commissioner directs the occupier of the factory to make purchases only through such society, provided that the Cane Commissioner shall make such direction only if in his opinion, which shall be final, the interest of a large number of cane growers of that area would be adversely affected if purchase of sugarcane for the factory direct from the cane growers is permitted.
