Notification Declaring Eco Sensitive Area S.O. No. 2820(E) Amendment in Mahableshwar Panchgani ESA, Maharashtra

EXTRAORDINARY PUBLISHED BY AUTHORITY No. 2681] NEW DELHI, TUESDAY, JUNE 21, 2022/JYAISTHA 31, 1944 MINISTRY OF ENVIRONMENT, FOREST AND CLIMATE CHANGE NOTIFICATION New Delhi, the 16th June, 2022 S.O. 2820(E).—In exercise of the powers conferred by clause (v) of sub-section(2) and sub-section (3) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986) read with sub-rule (4) of rule 5 of the Environment (Protection) Rules, 1986, the Central Government hereby makes the following amendments in the notification of the Government of India in the Ministry of Environment, Forest and Climate Change published in the Gazette of India, Extraordinary, Part-II, Section 3, Sub-section (ii) vide number S.O. 52(E), dated the 17 th January, 2001, namely:- In the said notification, - (I) In paragraph 2, in sub-paragraph (a)- (i) in clause (i), for the words, “approved by the Ministry of Environment and Forest in the Government of India within a period of two years from the date of publication of this notification”, the words “approved by the Competent Authority in the State Government for its effective implementation” shall be substituted; (ii) in clause (iii), for the words, “and concurrence of the Ministry of Environment and Forest shall be obtained on this” shall be omitted; (iii) in clause (iv), for the words, “and approval by the Ministry of Environment and Forests to” shall be omitted; (II) In paragraph 3, for sub-paragraph (a) , the following shall be substituted namely : - “(a) The state Govenment Shall constitute the Monitoring Committee for a tenure of three years consisting of the following composition, namely:- Sl.No. Constituent of the Monitoring Committee Designation 1. An eminent person with proven managerial or administrative experience and understanding of local issues. Chairperson 2. The Chief Conservator of the Forest, Mahabaleswar-Panchgani Member, ex-officio 3. A representative of Urban Development Department, Government of Maharashtra. Member, ex-officio 4. A representative of Revenue Department, Government of Maharashtra. Member, ex-officio 5. A representative of the Municipal Council or Municipal Administration, Government of Maharashtra Member, ex-officio 6. A representative of Maharashtra Pollution Control Board. Member, ex-officio 7. Senior Town Planner of the Area, Pune Division, Government of Maharashtra Member, ex-officio 8. Two representatives of Non-governmental Organizations working in the field of environment (including heritage conservation) to be nominated by the Government of Maharashtra Member 9. Chief Executive Officer, Zila Parishad, Satara, Maharashtra Member, ex-officio 10. The District Collector, Satara, Maharashtra. Member Secretary, ex-officio., (aa) The Monitoring Committee shall ensure compliance of the provisions of this notification and in addition, it shall have the powers to regulate and control noise pollution and regulate traffic within the Eco- SensitiveZone, which shall be in conformity with the provisions of the Master Plan.”; (III) In paragraph 4, for the words “High Level Monitoring Committee”, the words “Monitoring Committee” shall be substituted.
