The Government of Maharashtra is making the following rules in terms of the provisions of Section 48(1) and Section 173(1) and Section 174(1).

No. Misc-0624 / C.R.41 / pol-13.– In exercise of the powers conferred by sub-section (3) of section 48, sub-section (1) of section 173 and sub-section (1) of section 174 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (46 of 2023), read with sectio n 24 of the General Clauses Act, 1897 (10 of 1897) and in supersession of all earlier notifications, rules, orders or instruments issued in this behalf, the Government of Maharashtra hereby makes the following rules, namely :— 1. Short title and commencement.—(1) These rules may be called the Bharatiya Nagarik Suraksha Sanhita (Records of Arrest and Commission of Offences) Maharashtra Rules, 2024. (2) They shall come into force on the 1st July 2024. 2. Definitions.—(1) In these rules, unless the context otherwise requires,— (a) “ Form” means a Form appended to these rules ; (b) “Sanhita” means the Bharatiya Nagarik Suraksha Sanhita, 2023 ; (c) “Section” means a section of the Sanhita. (2) Words and expressions used but not defined in these rules shall have the same meanings as are respectively assigned to them under the Sanhita. 3. After arrest of a person, an entry of the fact as to who has been informed of the arrest of such person shall be made in a book in ‘Form A’. 4. The substance of information relating to the commission of cognizable offence to be recorded under section 173 of the Sanhita shall be recorded in a book in ‘Form B’. 5. The substance of information relating to the commission of non-cognizable offence to be recorded under section 174 of the Sanhita shall be recorded in a book in ‘Form C’.
