Tripura Street Vendors (Protection of Livelihood and Regulation of Street Government of Tripura PUBLISHED IN THE EXTRA ORDINARY ISSUE OF TRIPURA GAZETIEE Govern1nent or Tripura NOTIFICATION No.F.14(6)-llDD/DUD/20 !5/1827-52 Agartala, the 17'" June, 2016 In exercise of the powers conferred by Section 36 of l11e Street Vendors (Protection of Livelihood and Regulation of Street Vending) Act, 2014 (7 of2014), the State Government, hereby makes the following mies for the State ofTtipura, namely:�- CHAPTER! 1. Short title and commencement.- (1) These 1ules may be called the Tripura Street Vendors (Protection ofLlveLihood and Regulation of Street Vending) Rules, 2016. (2) They shall come into force on the date of their publication in the Official Gazette. 2. Defiilitions.- (1) In these rules, unless the context otherwise requires,� (a) "Act" means the Street Vendors (Protection of Livelihood and Regulation of Street Vending) Act, 2014 (7 of2014); (b) "Bye-laws" mean the bye-laws made under section 37 of the Act; (d) ''Government" means the Govenunent of'fllpura; (e) < 1Grievance redressal and dispute resolution committee'� means a co1nmittee constituted by the Government under sub-section (1) of section 20 of the Act for the redressal of g1ievances or resolution of disputes; (f) "local autho1ity" means the local authority as defined under clause (c) of sub-section (I) of section 2 of the Act; (g) "!v1unicipal Commissioner" means the Jvfunjcipal Cotnmissioner of Agaitala tv1unicipa1 Corporation or Chief Executive Officer of a Municipal Council or Executive Officer of a Nagar Panchayat as the case may be; (h) "rule11 means rules made under section 36 of the 1\ct; (i) "scheme" means a scheme framed by the State Government under section 38; G) "section" means a section of the A.ct; (2) Words and expressions used herein and not defined, but defined in the Act, shall have the me,1nings respectively assigned to them in the Acl. CHAPTER I! REGULATION OF STREET VENDING 3. Prescription of age for issue of certilicate of vending.- A street vendor who has completed the age of fourteen years shall be issued·a cc1iificatc of vending in the manner provided under section 4. CHAPTER III TOWN VENDING COMMITTEE 4. Constitution of Town Vending Committee.- (l) In each local autho1ity one Town Vendi_ng Committee shall be constituted by the Government: Provided that the Govemm,mt, if it considers necessary, on the request of the concemed local authority may provide for constitution of more than one Town Ventling Committee for ear,:, local (2) The Town Vending Committee shall comprise the following:- (a) Municipal Commissioner or Chief Executive Oflicer or Executive Oflicer of tl1e local authority, as the case may be, who shall be the chairperson; (b) A representative of Tripura Police (preferably from the Traffic Division) not below the rank of (c) Four members representing the Street \lenders, who shall be elected by the Street Venders themselves in manner as prescribed under rule 6. Provided that at least one of tlie members sh,111 be women, and al least one of the members shall be fi lm amongst the weaker sections (belonging to Schedttled Castes, Scheduled Tribes, Other Backward Classes, minorifies or persons with disabilities); (d) One re,ircsentatives of Non-government organisations and commUllity based Organisations; (e) Two representatives of local residents; and (f) One representative oftradern. (3) The members of the Town Vending Committee other than the elected members shall be nominated by the Government: Provided that nomination of Government membern shall be prefe1Tcd from amongst persons who arc l)rovided flu1her thal nomination of members representing nlln-govcmmentaJ orgmlisal'ions 01· community based organisations or resident welfare associations shall be canicd out on the basis of such critc,ia as may be laid down by the Govcwrncnt, after inviting applications, as such, by publishing the s.ame in at least hvo local ne\vspapers or publicising in any other manner. Provided that the first set of members representing the street vendm's shall be nominated by the Government in consultation with the local authorily, till the first election of such representatives is over. Provided further that if none of 01e contesting candidates are from tl1e reserved categories, then members from the un-reserved categories may be declared elected. 5. Election of members of Town Vending Committee from amongst street vendors.·(!) The local authodty shall by a notification express its intention to conduct elections for the members of a Town Vending Committee representing the street vendors of the area under the jurisdiction of the concerned local authority. (2) The concerned local authofity shall appoint a returning officer for conducting the election under it_s jutisdiction. 6. Manner of election of members of Town Vending Committee from amongst street vendors.- (1) The returning officer appointed under sub,rule (2) of rule 5 shall, conduct the elections in the manner presctibed by the Government. (2) A street vendor shall be disqualified to be elected to a Town Vending Conunittee if; he is,­ (i) a convict of an offence involving moral turpitude; (ii) is physically and, or, mentally incapable of discharging his duties as a member of a Town Vending Comnt1ee. (3) The names of the elected members shall be intimated by each local authotily to the Government which shall upon receipt of such names along with other members nominated by it notify the constitution of the Town Vending Committee in each local authotity. 7. Term of members of Town Vending Committee.-(!) TI1e te1m of the members of the Town Vending Committee, other than the ·Government officials who shall be members in ex-officio capacity, shall be five years from the date of their election or nomination, as the case may be. (2) The process of electing or nominating, as the case may be, of the members shall be completed before the expiry of their te1m. 8. Removal of a member of Town Vending Committee.- Any member of a Town Vending Committee may be removed by the Government from the committee, if he, (a) persistently makes defaults in the perfmmance of his duties imposed on him under the Act and these rules or exceeds or abuses its powers; J\ (b) re1nains absent for tlu·ee consecutive 1ueelingS of the Conunittee \Vilhout the permission of !he (c) is convicted of any cdminal case by any court oflaw: . Provided that such member shall be given a reasonable opportunity .of being heard before his 9. Method of filling vacant post.- (1) \\11ere any vacancy occurs in a Town Vending Committee due to resignation, death, ·rern_oval ot othe11vjse of any m.ernber, other ih�ul a street vendor, the s�me procedure as specified in mle 4 shall be folfowcd to fill up such vacancy and the member so nominated shall continue to be a member for the remaining peliod of term of that member in whose place he has been nominated. (2) \Vhcrc any VlJc(lncy occurs i11 a T,nvn ,rending Con1mittee due t.o resignation, death, rernoval or Othenvise of any member ,vho is a s1reet vendor, the local authority shall fill up fh3t vacancy bas1 J on the election results conducted as per rule 6 and the member so elected shall continue to be a member for the remaining pcllod of tenn of that me1nber in ,vhose place he has been elected. 10. Allowances to members of Town Vending Committee.- The allowances payable to the members of a Town Vending Committee, who do not hold any office of pt'ofit, shall be fixed by the concerned local authotity from time to time. 11. Meetings of Town Vending Committee.- (I) A Town Vending Committee shall ordinaiily !told at least one meeting within a pedod fof three months or at any such intervals as the Chairperson of the Town \tending Co1. 1mittee n1ay decide for the transaction of its business: Provided that t11e first meeting of;,1 To,vn \lending C�omtnittee shall be conven�d by the Chairperson within fo11y five days of its constitution: Provided farther that a requisition meeting may be called by the Chairperson on a specific issue on the request of not less than one-third of the members of the ·committee, and the meeting shall be convened ,vi thin seve.nty�t\VO houni after receiving, the request so 1nade. (2) The meetings of a Town Vending Commillee shall be held at. the headqua11ers oft.he local auth01ity or at such place \Vithin the ju1is<liction of the local aulhority as tnay be decided by the Chairperson. (3) r\ notice shall be issued before seven days of a scheduled 1neeling 1o all lhc 1ne1nbers of the ·ra\Vn \lending Co1nn1it1ee, along-with the agenda of the meeting. (4) The quorum for the meeting shall be two-tltird members of the total strength of the Town Vending (5) No meeting shall be held in the absence of the quonun and where there is no quorum, the meeting shall be ac(joumed. 12. Procedure for transaction of business of Town Vending Committee.- (1) Tbe Town Vending Committee may follow such procedure for transaction of its business as may be decided by the Cl\airperson in consultation ,vith the n1e1nbers. (2) Subject to the provisions of the Act and these rules and notwithstanding anything contained in the, bye-laws, the resolution passed in a meeting ofa Town Vending Committee shall be by not kss than two­ thirds of the me1nbe-rs present and voting in the tnceting. (3) The Chaiq,erson shall ensure that the minutes of each meeting are recorded which shall he signed by him, cir1ulatcd amongst the members and published on its website, if available, within one month of the 1necling of the Cornrniltee. 13. I:i'ul1ctions of'fov,'n \'ending Conunittee.- \X/ithout pr�judicc to any other provisions oftl1c Act, a 'fo,vn Vending Committee shall perfo1m the following functions, namely:- (a) to conduct surveys \Vi thin the area of its ju1isdiction to _identify street vendors in the area and ensure their accoinmodatjon in accordance \Vith the norms, plan and the holding capacity ,vithin the area of its jurisdiction; (b) to issue cerlificate of vending to an eligible street vendor after obtaining an undertaking from him to comply with the tenns and conditions subject to which the ce1tificate of vending is issued for issue of ce1tificate ofwnding, the Town Vending Commitlee shall follow the criteria as specified in the scheme (c) to cancel or suspbnd certificate of vending of street v.endors who commit breach of any of the conditions thereof or any other tcnns and conditions specified for regulating street vending under the 1\ct or these rllles or scheme n1a<le under the Act or ,vhere the 1'o\Vn \;ending Con1n1ittee is satisfied ·that such certificate of vending has been secured b�v the street vendor through :rnisrepresentation or fraud: Provided that :my order for cancellation or suspension of a certificate of vending by the Town \Tending c:ommitlcc shall spccirv the rc.asons. for such cancellation or suspension in the \vrittcn order commtmicatcd to the vendor; ( d) to rcconuncnd to the local authority an area in its jurisdiction for declaration of the sa1ne to be a non­ vc-nding area; (e) to identify sites and spaces for vending; (f) to regul.1tc tiinings for vending lo ensure non�congcstion of public spaces; (g) to ensure enforcement of con·cctive mechanism. against defiance by street vendors; (h) to follow up cases of dispute pending before the dispute redressal committee and the local authority; (i) to furnish recommendations to the local authority in relation to the preparation of plan to promote the vocation of street vendors; G) to hold its meetings and take appropriate decisions to ensure efficient discharge of its functions; (k) to associate technical and professional persons from the Government or other non-government organisations with itself on temporary basis for obtaining assistance or advice in carrying out any of the provisions of the Act; (l) to publish the street vendor's charter in Bengali and English in newspapers of repute and displayed in the office of Town Vending Committee and other offices of the Urban Local Bodies as required, specifying therein the time within which the certificate of vending shall be iss_ucd to the street vendors and time within which such certificate of vending shall be renewed and otl1er activities to be perfonned within the time limit specified therein; (m) to maintain up to date records of registered street vendors and street vendors to whom certificate of .,,.,vending has been issued in accordance with the pro,isions of the Act and publish on the website, if available; (n) to carry out social audit of its activities under the Act or these rules or the scheme made thereunder; (o) to furnish from time to time .to the Government and the local authority such returns as prescribed under the Act and these rules; (p) to famish comments to the Govemment for undertaking promotional measures of making available credit, insurance and other welfare schemes of social secuiity for the street vendors; ( q) to assist the Government to raise awareness among the public about the role of the street vendors in the economy; and (r) to perfonn such other 7nctions for effective implementation of the Act and these rules as may be delegated to the Town Vending Committee by the local authority and by the Government. 14. Power of Town Vending Committee for temporary association of expert persons.-(]) Subject to the provisions of the Act, a Town Vending Committee may associate any suitable person of repute having adequate knowledge and expelience in the field, as expert to obtain technical or professional advice on matters relating to the street vendors. (2) The pernon to be associated as expe11 under sub-rule (I) shall be selected in a fair and t!'ansparent manner and by following the procedure for engag_ement of consult1nts and experts as technical or professional experts in Government Departments. (3J The person associated as expe,1 under sub-rule (1) shall be paid allowances as detennined by the local authority. (4) The person associated as expert under sub-rule (l) may take part in the meetings of the Town Vending Committee, but such persons shall not have a dght lo vote in the meetings. 15. Ern pJoyccs of To,\'n \1 ending Co1nn1itlee - The local authority concerned shall, when so requested by a Town Vending Committee, make available to that Comminee such employees as the local authority. considers necessary for discharge of the functions confen·ed or imposed on the Committee under rule 13 of these tu! es. CHAPTER IV DISPUTE REDRESSAL MECHANISM 16. Constitution of Grievance redressal and dispute resolution committees.- (1) ·mere shall be a Griev�nco redressal and dispute resolution committee constituted by the Government under subsection ( 1) of section 20 of the Act for ,ill local mllhorities, comprising of a Chairperson, who has been a civil judge or a judicial magistrate and hvo other professionals as members. (2) The Chairperson arnl members of the Grievance redressal and dispute resolution committee shall be appointed by the Government, for a pc1iod of tlu·ee years, extendablc for a further pedod of two years: Provided that no Chairperson shall hold office as such after he has attained the age of sixty-seven years. (3) Tiie headquarter of the Gdevance redressal and dispute resolution committee shall be at Aga1tala. The Comtnittec may have i1s sitting al" any olher location ,vi thin the ju1isdiction of local autho1ities. 17. Qualifications and experience for appointrnent -as mcniber in a G-ricvance redrcssal and dispute resolution committee.- A person shall be qualified to be appointed as a professional member i_n a Grievance redrcssal ati8 dispute resolution commitfee, ifhe)- (i) is above thirty five years but is not more than sixty five years of age; and (ii) possesses a Bachelor's degree from a recognised University; and (iii) is a J)erson of abilityi integrity and standing and has adequate kno,vledge or expedence of. at least; ten years in social work or in dealing with the problems relating to street vendors or of public affairs or of municipal or public administration. 18. Salaries and other allo,Yances anc.J ter1ns and conditions of Chairperson and 1ue1nber'ofGrievance rcdrcssal and dispute resolution committee.- (1) The Chairperson and members of the Grievance redressal and dispute resolution committee shall receive salary, allowances and other perquisites as may be notified by the Govc1nmcnl from time to time (2) The Government may remove from the office, the Chairperson and members of a Grievance redressal and dispute resolution committee ifhe,- (a) has been adjudged an ittsolVent; or (b) has been convicted of an offence which, in the opinion of the Govemment, involves moral tuivitude; or (c) has become physically or mentally incapable of action as such Chairperson or member, as the case may be; or (d) l1as acquired such financial other interests as is likely 1o affect prejudicially his functions as the chairperson or a member, as the case may be; or (e) has so abused his position as to render his continuance in office prejudicial to the public interest: Prov.ided that the Chairperson or member shall not be removed from his office on the grounds specified in clauses (d) and (e) of sub-rule (2) except on an inquiry held by the Government in accordance with such procedure as it may specify in this behalf. ' .(3) The terms and conditions of the service of the Chaitverson and members of the Grievance rcdressal and dispute resolution committee shall not be varied to their disadvantage during their tenure of office. 19. Form and manner of making application to Grie,•ancc redressal nud dispute resolution committee.- (I) Ev01y application for redressal of a grievance or resolu!ion of a dispute under sub- section (2) of section 20 of the Act shall be In Fo1m 'A'. (2) The application shall be sign'ed by the applicant and presented by him in person or tlu·ough his aut.horizcd representative to th.e Grievance redressal and dispute resolution committee or such other person as may be a11thorized by the committee in this behalf. (3) The application shall be tiled in tlu·ee sets and shall be accompanied by a fee of rupees one hundred.· (4) The application shall be accompanied by a copy of the order or notice, if any, against which the application is made and other relevant documents. (5) Such application shall be filed by the street vendor willun thirty days from the date of occurrence of any incident causing the gtievance or dispute: Provided that the Grievance redressal and clispute resolution committee may condone the delay in case it is satisfied that Ute applicant was prevented by sufficient cause from prefonfog the application within the prescribed time. 20. Manner of verification of application and enquiry.- (1) Every application for grievance rcdressal, on receipt, shall be. entered and numbered in seriatum by the person autholised in this behalf by the Glievance redressal and dispute resolution committee in a register to be kept for this purpose. (2) The person authodsed in this behalf by the Grievance redressal and dis"])Ute resolution committee, after making an entry in the register shall put up the application before the committee. (3) The Gtievance redressal and dispute resolution committee shall fix a date for headng of the application, which shall not be later ihan fifteen days from the date of filing ofH1c application, an!l.s/1alt issue notice of the hea,ing to the pat1ies or shall cause a notice to be issued. ( 4) The Gtievance redressal and dispute resolution committee while issuing a notice under sub-rule (2) shall call upon the respondent to submit a w,itten statement and the notice shall contain a statement to this effect. (5) On the date so fixed for the appearance of the pa11ies, the Grievance redressal and dispute resolution committee may call upon the applicant to remedy the defects, if any, or may call upon the patties to furnish relevant records or such other documents or evidence as it may deem fit and proper within such period as may be specified by it. (6) The Gtievance redressal and dispute resolution commil1ee may also order ·for a field enqrii,y in connection with the contentions made by the applicant and respondent and also with reference to the records submitted before it. (7) The Gtievance redressal and dispute resolution commiltee, after heaiing both the' parties and examining the record of the case shall decide the application and pass such orders as it may deem fit and proper within sixty days from the date of presentation of the application: Provided that during the hearing of the case if the Committee is satisfied that a situation exists which warrants that an inierim relief should be provided, the Commiltee may, until. the conclusion of such case or until further orders, pass such interim orders as it deems necessary. (8) The GtieVjlllC�- �sal and dispute resolution committe.e may also explore the possibility of a .settlement betlVeen,� parties and in case the parties anive'at a settlement, the committee shall record the settlemen� which shall bf signed by the parties or the authorised representatives or officers and shall dispose of the application in terms of such settlement. (9) The Gtievance redressal and dispute resolution committee shall not ente,tain an application where,­ (a) the application is anonymous or it contains general and vague allegations; (b) the matter is sub·judice in any court of law, tribunal or a judicial or quasi-judicial authority; (c) the matteris beyond the purview of the Act; (d) -the applicant has no locus standi to file the applicalion. CHAPTERV APPEALS 21. Appeal against order or decision of Grieva11ce redressal and dispute resolution (:ommittee.- (1) An appeal against an order or decision of a Gtievance redressal and dispute resolution committee may be pre furred by an aggrieved person, in Form 'B ', to the appellate authority constituted by the concerned local autho11ty, _ ----� 1 and Uvo other me1nbers of the local authority as decided in tl1e General Body meeting, within thirty days from tl1e date of communication of such order or decisi�n appealed agains1: Provided that the appellate authority may condone the delay in case it is satisfied that the applicant was prevented by sufficient cause from preferring the ;ipplication within the prescribed time. (2) The appeal shall be in the fonn of a memorandum and shall be signed by the appellant and presented by him in person or through his authotised representative to the concemed local authority. (3) 1be memorandum of appeal shall be accompanied by original order or certifiedlCopy of the order, if any, against ,vhich appeal is preferred. (4) TI1e appeal shall be filed in three sets and accompanied by a fee of rupees two hundred. (5) No such appeal shall be enter1ained unless a copy thereof has been served tipon the respondent or resPQndents, as the case may be, and proof of such service has been filed. (6) No appeal shall be enlertaincd where the order has been passed by the Grievance redrcssal anJ clispute resolution Committee in terms of the settlement anived between the parties. 22. Appe.al from decision of Town Vending Comn\ittee.- (1) An appeal under section 11 against any decision of a To'\vn \lending Committee with respect t9 issue of certificate of vending or cancellation or suspension of certificate of vending shall be prcfon-cd before the appellate authority constituted by the conce1ned Joca1 autho1ity con1prising of the 1v1ayor or ·chairpers�n as the Chairperson and 1,vo other members of the local authOr"ity as ilecided in the General Body meeting, in Fonn 'C' within thirty days from the date of communicatio� of the order appealed against: Provided that the appellate a\lfhority may condone the delay in case it is satisfied that appellant was prevented by sufficient cause from prcfen-ing the appeal within the· prescribed time: Provided further that in "the absence of Chairperson any one of the members designated by the Chairperson may chair lhe meeting oflhe appellate auth01i1y. (2) The appeal shall be in the form of a memorandum in Fo1m 'C' and shall be signed by the appellant and presented by him in person or lhrough his authorised representative, either in English or Bengali as prefen-ed by the appellant . (3) The memorandum of appeal shall be accompanied by the odginal or certified copy of the order against which appeal is prefen-ed. (4) The appeal shall be filed in three sets and accompanied by a fee ofrupces two hundred. (5) No appeal shall be entertained unless a copy thereof has been served upon the Town Vending Cotnmittee ,vhich had made the order appealed against, plior to. ftling of such appeal and proof of such service has been filed along with the appeal. 23. Procedure for disposal_of appeals by the local authority.- (1) The officer or the person autho1ised in this behalf by the concerned local authority shall make an en.tly of the appeal in the register kept for the purpose by the concerned local auth01ity with the date on which it was presented. (2) The appeal shall be put up before the Appellate Authority constituted by the concerned local authority which shall fix a date for hearing of the appeal, which shall not be later tllan fifteen days from the date of filing of the application, and shall catLse a notice of the hearing to be served upon the parties. (3) TI1e appellate autho1ity shall on the basis of submissions made before it by the parties and the records of the .case and on the basis of field enquiry, if any, ordered to be conducted by the appellate authority, pass such order, as it thinks fit� \Vith reasons to be recorded in \Vriting, confirming, n1odifying or annulling the order appealed against within sixty days from the elate of receipt of the appeal by the local authority: Provided that during the hearing of the case, if,the appellate authority is satisfied that a situation exists which warrants that an interim relief should be provided, the appellate authotity may, until the conclusion of such case Or until further ordersi pass such .in1erim orders as it deems necessary: CHAPTER VI MISCELLANEOUS 24. Manner of maintenance of records of street vendors by Town Vending Committee.- Every Town Vending Committee shall maintain up to date records as specified in the scheme under sub-section (2) of section 26 of the Act in electronic form or manually or in botl1 forms, as may be decided by the local authority: 25. Town Vending Committee to furnish returns.- (I) Evety Town Vending committee shall prepare and fumish to the Govetnrnent and local autboli ty periodical retums for each year with details as required in Fonn 'D1 . (2) The Government or the local autholity, as the case may be, may require a Town Vending Committee to furnish such other retum or retnrns in such proforma as demanded from time to time. 26. Publication of summary of notified scheme in newspapers, etc.- (1) A summary of the scheme notified by the Government in the second schedule under sub-section (l) of section 38 of the Act shall be published by the local authority by means of a public notice given in two prominent daily newspapern and circulated in the area for being widely known in the area or locality of its jmisdiction which is likely to be affected thereby, within seven days from the date the scheme is notified by the Government. (2) The notice shall be signed by t)1e Municipal Commissioner or the Chief Executive Officer or the Executive Officer of the local auth�rity, as the case may be, or by an officer authorised by him in this behalf. (3) The notice shall be in such language or languages as the !\,funicip�l Commissioner or the Chief Executive Officer or the Executive Officer of the local authority, as the case may be, may specify'in this behalf. 27, Government may remove diilicult)' or ambiguity.- The Government may issue directions, nqt inconsistent \Vith the provisions of the A Ct, to remove any difficulty or ambiguity as may arise or may be' required from time to tim·c.
