S.O. 303 (E) [08/02/2011] - The Animal Birth Control (Dogs) Amendment Rules, 2010

MINISTRY OF EIWIRONMENT^NDJfORlSfS New Delhi, the 8th February,2011 S.O. 303(E).—Whereas, the (draft rules amending the Animal Birth Control ?(Dqgs) &alss, 2001 were published, as required'by subisectron (1) of Section 38 of the Prevention of Ctael^taMimafe Act, 1960,(59 of 1960) under the notification ofthe Government of India, Ministry of Environment and Forest vMfetBBfiberS.Q, 714(E), dated the 26th March, 2010 m;the Gazette of India, Extraordinary, inviting objections andsuggestions from aH persons likely to be affected therebyB be&rethe «xpiiy of the period of thirty days from the date a» »tech copies of the Gazette containing the said notification are made available to the public; And, whereas, copies of the said Gazette were made available to the public on the 31st day of March, 2010; And, whereas no objection or suggestion has been received from the public in respect of the said draft rules by the Central Government; Now, therefore, in exercise of the powers conferred by sub-sections (1) and (2) of Section 38 of the Prevention of Cruelty to Animals Act, 1960 (59 of 1960) the Central Government hereby makes the following rules further to amend the Animal Birth Control (Dogs) Rules, 2001, namely:— 1. (1) These rules may be called Animal Birth Control (Dogs) Amendment Rules, 2010. (2) They shall come into force on the date of their final publication in the Official Gazette. 2. In the Animal Birth Control (Dogs) Rules, 2001 (hereinafter referred to as the said rules), in rule 4,— (a) after the words "constituted by the local authority", the words "for a period of three years" be inserted; (b) after clause (f), the following clause shall be inserted namely :— "(g) a representative of the people who is a humanitarian or a well known individual who has experience in animal welfare in the locality". 3. In rule 5 of the said rules, after clause (g), the following clause shall be inserted, namely:— "(h) the activities of the Committee shall be brought to the public notice by announcements and advertisements". 4. In rule 6 of the said rules, after sub-rule (3) the following sub-rule shall be inserted, namely :— "(4) The Monitoring committee of the said locality shall meet at least once in every month to assess the progress made in regard to implementation of the Animal Birth Control Programme". 5. In rule 7 of the said rules, in sub-rule (6), for the words "other institutions", the words "other recognized institutions" shall be substituted.
