You are aware that Section 12 of the RED Act 1969 and the corresponding Rules 11amed the1eundei stipulates the Registrar to give free of charge an extract of the prescribed pa1ticula1‘s from the 1egister of births and deaths to the informant under section 8 01 9 of the Act as soon as the 1egist1ation has been completed Fuithei, 11116 8 (5) flamed under this section, allows the Registia1 to send the extract to the informant by post if the same has not been collected. 2. Despite the above provisions, it has been noticed that extract of births and deaths are neither being delivered to the informant nor being sent through post by the Registrars. Although, necessary instructions in this regard have been issued, the same are not abide by the Registrar and the extracts are lying with the Registrars. 8. In this connection your attention is also invited to the recommendation no. 5.1 and 4 of National Conference of Chief Registrar of Births and Deaths of 2007 and 2009 respectively, wherein certain corrective measu1cs were suggested for improving the delivery of extract/ certificate to the concerned. In this regard, you are therefore requested to direct theconcerned Registrars to ensure the delivery of extract of birth or death to the informant immediately after registration. The following directions may be issued to the concerned registration authority: 1. Registrar may be asked to register the event immediately after receiving the information under section 8 0r 9 of the Act and deliver the extract to W‘ “Ensure Registration ovaer Birth and Death” the informant on the same day, If the said information is reported through the notifiers e.g. Aanganwadi Workers, ASHA’s, ANIVI’s or others, it should be ensured to deliver the extract/ certificate to the concerned household through them. ii. Recently, registration centers are opened in big hospitals and other PHC’s/CHC’s centers in most of the States/ UTs. In such cases, it will be the duty of the Registrar of birth and death of that Center \to deliver the extract / certificate to the mother of the new born child before her discharge from the medical institution, in case of Institutional deliveries Whereas, in case of death, the Registrar of birth and death should ensure to deliver the extract/certificate of death before hand over the dead body to the relatives. , iii. However, in case of such institutions, where registration center does not exists like private hospitals, Nursing homes etc. the person authorized to send the report of birth and death to the concern Registrar should also obtain a self addressed stamped envelope at the time of filling up the reporting form from the informant and forward it to the concerned Registrar along with the reporting form for registration. The Registrar, after registering the event of birth or death may utilize the self addressed stamped envelope for dispatch of the extract/certificate to the household concerned. You are therefore requested to issue the above necessary directions to the concerned registration functionaries for strict Compliance. You are aware that procedure of imposing Penalties on Institutions, Registrar / Sub—Registrars, Medical practitioners and on the individuals are prescribed under Section 23(1) to 23(5) of the Registration of Births and Deaths Act, 1969. The provision of Section 23 is reproduced below: — Section 23 —— (1) any person who— (a) fails Without reasonable cause to give any information which it is his duty to give under any of the provisions of sections 8 and 9; or (b) gives or causes to be given, for the purpose of being inserted in any register of births and deaths, any information which he knows or believes to be false regarding any of the particulars required to be known and registered; or (c) refuses to write his name, description and place of abode or to put his thumb mark in the register as required by section 11, shall be punishable with fine which may extend to fifty rupees. (2) Any Registrar or Sub—Registrar who neglects or refuses, Without reasonable cause, to register any birth or death occurring in his jurisdiction or to submit any returns as required by sub—section (1) of section 19 shall be punishable with fine which may extend to fifty rupees. (3) Any medical practitioner who neglects or refuses to issue a certificate under sub—section (3) of section 10 and any person who neglects or refuses to deliver such certificate shall be punishable with fine which may extend to fifty rupees. (4) Any person who, without reasonable cause, contravenes any provision of this Act for the contravention of which no penalty is provided for in this section shall be punishable with fine which may extend to ten rupees. (5) Notwithstanding anything contained in the Code of Criminal Procedure, 1898 (5 of 1898), an offence under this section shall be tried summarily by a Magistrate. Although the above provisions exists in the Act but it has been observed that most of the States/UTs do not impose any penalties on defaulting Institutions, Medical Practitioners or any individuals. Even the Penalties are not imposed on any Registrar or sub Registrar who neglects or refuses to register the events occurring in her / his jurisdiction or delay or fail in submitting the monthly returns as required under Section 19(1) of the Act and corresponding rules 14 (1) 8L (2) framed thereunder . As per the Annual Reports submitted by the State Governments, the State of Rajasthan, Kerala, Punjab and Maharashtra are imposing such penalties effectively. The other states are not implementing the provision of this section and not imposed any penalties even on the defaulting institutions. In view of the above, you are requested to issue necessary directions to all District Authorities to take steps for effective implementation of the provision of Section 23 85 24 of the RED Act and the corresponding rule 16 framed thereunder. It is also requested to lay emphasis on the details on imposing suchpenalties in the Annual Report on working of the RED Act and to ensure the timely submission of reports by the Registrar.
