National Trust for Welfare of Persons with Autism, Cerebral Palsy, Mental Retardation and Multiple Disabilities (Amendment) Rules, 2015

EXTRAORDINARY PUBLISHED BY AUTHORITY MINISTRY OF SOCIAL JUSTICE AND EMPOWERMENT (Department of Empowerment of Persons with Disabilities) NOTIFICATION New Delhi, the 4th February, 2015 G.S.R. 71(E).—Whereas a draft of certain rules further to amend the National Trust for Welfare of Persons with Autism, Cerebral Palsy, Mental Retardation and Multiple Disabilities Rules, 2000, which the Central Government, in exercise of the powers conferred by sub-section (2) of section 4 read with clause (b) of sub-section (2) of section 34 of the National Trust for Welfare of Persons with Autism, Cerebral Palsy, Mental Retardation and Multiple Disabilities Act, 1999 (44 of 1999), vide notification of the Government of India in the Ministry of Social Justice and Empowerment, Department of Disability Affairs, number G.S.R. 809(E), dated the 14th November, 2014, published in the Gazette of India, Extraordinary, Part II, Section 3, Sub-section (i), dated the 14th November, 2014, inviting objections and suggestions from all persons likely to be affected before the expiry of thirty days from the date on which the copies of the Official Gazette of the said notification were made available to the public; And whereas copies of the Gazette were made available to the public on the 19 th November, 2014; And whereas objections and suggestions received on the said rules have been considered by the Central Government; Now, therefore, in exercise of the powers conferred by sub-section (2) of section 4 read with clause (b) of sub-section (2) of section 34 of the National Trust for Welfare of Persons with Autism, Cerebral Palsy, Mental Retardation and Multiple Disabilities Act, 1999 (44 of 1999), the Central Government hereby makes the following amendments to the National Trust for Welfare of Persons with Autism, Cerebral Palsy, Mental Retardation and Multiple Disabilities Rules, 2000, namely:- 1. (1) These rules may be called National Trust for Welfare of Persons with Autism, Cerebral Palsy, Mental Retardation and Multiple Disabilities (Amendment) Rules, 2015. (2) They shall come into force on the date of their final publication in the Official Gazette. 2. In the National Trust for Welfare of Persons with Autism, Cerebral Palsy, Mental Retardation and Multiple Disabilities Rules, 2000, for rule 4, the following rules shall be substituted,namely:- "4. Educational qualification and experience required for Chairperson.- (1) The Chairperson of the Trust shall have the following qualifications, namely:- (i) Master's Degree in Sociology or Education or Psychology or Social Work from a recognised University; or Post Graduate degree in any other discipline from a recognised University with any of the following qualifications; (a) Master in Education in one or more of the disabilities, namely, autism, cerebral palsy, Mental Retardation and Multiple Disabilities; or (b) Bachelor in Education in one or more of the disabilities, namely, autism, cerebral palsy, Mental Retardation and Multiple Disabilities; or (c) Diploma in one or more of the disabilities, namely, autism, cerebral palsy, Mental Retardation and Multiple Disabilities; (ii) Publication of research papers in reputed professional journals shall be considered as additional qualification. (2) The Chairperson shall have the following experience, namely:- (a) minimum fifteen years of experience in the disability sector of which not less than ten years in autism or cerebral palsy or Mental Retardation or Multiple Disabilities; and (b) administrative experience of not less than three years as Chief Executive Officer or Chairperson or President or General Secretary of any Non Governmental Organisation which has been serving at least for ten years in the areas of autism, cerebral palsy, Mental Retardation and Multiple Disabilities; (3) The Chairperson shall not be older than sixty-two years as on the closing date of receipt of applications by the Central Government. 4A. Procedure for selection of Chairperson.- The Chairperson shall be appointed by the Central Government on the recommendation of a search-cum-selection committee consisting of the following persons, namely:- (i) A senior distinguished academician in the relevant field to be nominated by the Minister Social Justice and (ii) Secretary, Department of Empowerment of Persons with Disabilities; ……..Member; (iii) Chief Commissioner for Persons with Disabilities...........................Member; (iv) Two experts of eminence amongst the Managing Directors or Chairperson of Non Governmental Organisations working in the field of Autism, Cerebral Palsy, Mental Retardation, Multiple Disabilities, of whom one Member will be a parent or 4B. Salary of Chairperson.- The salary of the Chairperson shall be equivalent to the basic pay of the Secretary to the Government of India and dearness allowance and city compensatory allowance as admissible: Provided that where the Chairperson is a retired person from the Central Government or a State Government or Union Territory Administration or Semi-Government body or public sector undertaking or a recognised research institution or any other autonomous or statutory body, the salary payable together with the pension or pensionary value of the terminable benefits or both received by him shall not exceed the basic pay of Secretary to the Government of India.".
