Supply ond Distribution) Rules, 2004, nomely:- I- (l ) Ihese rules moy be colled the Cigorettes ond other Tobocco products (Prohibition of Advertisement ond Regulotion of Trode ond Commerce, Production, Supply ond Distribution (Second Amendment) Rules,2o0s. (2| They sholl come into force on the I sr doy of Jonuory 2W6. 2. ln the Cigorettes ond other Tobocco Products (Prohibition of Advertisement ond Regulotion of Trode ond Commerce, Production, Supply ond Distribution (Amendment) Rules ,2@4, in rule 4,- (i) {or sub-rule (6),the following sholt be substituted, nomety:- "(6) No individuol or o person or o chorocter in cinemo ond television progrornmes sholl disploy lobocco products or lheir use: provided thot this sub'rule sholl not opply to (o) lndion films ond letevision progrommes disploying use of tobocco products necessory lo represent the smoking or iobgcco usoge of o reol historicol figure or for representotion of o hisloricol ero; (b) Old lndion films ond lelevision progrommes, produced prior to coming into effecl of this nolificotion. being screened in o cinemo holl or theolre or oired on television; tcl Foreign films ond lelevision progrcmmes, including dubbed or sub- titled foreign films or television progrommes, being screened in cinemo holls or lheotres or oired on television; lndion or foreign films ond television progrommes, disploying use of iobocco products, in cose of documentories or heolih spots mode to cleorly ond unombiguously reflecl ihe dongers ond dire consequences of tobocco use; Live coveroge of news, cunent offoirs, interviews, public meeiings, sports events, culturol events ond ihe like. being telecost on ielevision whereby there is o purely incideniol ond completely uninlentionol coveroge of use of iobocco products: Provided ihoi ihe exemplions under clouses (o), (b), (c), (d) & (e) obove sholl nol exlend lo disploy of brqnds of iobocco producls or tobocco producl plocemeni in ony form. Close ups of cigoreiie pockoges or lobocco products sholl nol be permissible ond such scenes sholl be ediled by ihe producer/dislribuior/broodccster prior lo screening in cinemos/lheoires or oiring on lelevision. Explonotion {l ).- For lhe purpose of this sub-rule, oll films ihot receive CBFC certificolion prior lo the effective dote of this noiificotion sholl be cotegorized os 'old films'. Explonoiion (2),- For the purpose of this sub+ule, 'Foreign film' implies 'lmported' os defined in the Cinemotogroph (Certificotion) Rules, i983. (64) ll sholl be mondoiory for ihe producer or disiributor of ihe film to include onti iobocco heolth spois of minimum thirty seconds durotion in ihe mosier prini. to be screened oi the beginning, middle ond end of the soid film. ln cose of old Indion films, the owner or monoger of the cinemo holl or iheotre where the film is being screened shcll ensure ihol these onti tobocco heolth spots ore duly screened os prescribed. The provisions of lhis sub-rule sholl not opply to clouse {d) of sub+ule 6. (68) In cose of ielevision progrommes, il sholl be mondolory for the broodcoster lo ensure eilher plocement of on onti tobocco heolih worning os o promineni scroll ol the botiom of ihe ielevision screen during the period of such disploy or oiring of onti tobocco heollh spois for o period of minimum ihirty seconds during the telecosi of eoch television progromme of ihirty minuie durotion or less. ln cose the television progromme is more thon ihirty minutes further oirtime of '30 seconds sholl be ollocoted for eoch incremenlol ihirty minules, for telecosting onti lobocco spots. The minimum durotion of eoch onti tobocco spot sholl be not less thon l5 seconds. The provisions of this sub+ule sholl noi opply to clouses (d) ond (e) of sub{ule 6: (d) (e) (ii) Provided thot, the onlitobocco heolth worning scroll sholl be legible ond reodoble with fonl in block colour on white bockground. Ihe texl of lhe heolth worning sholl be 'smoking ccruses concei' or 'smoking kills' for Sroiing torm 6f lobocCo use ond 'Tobocco couses concer' or'Tobocgo kills' forlhewing ond other form of lobocco or such otherworning os moy be specified bY the Government: Provided further thot. the onli lobocco heolth woming scrolls or heolth spois sholl be in the some longuoge(s) os us9! i1 the film or television progromme. lncose of duo-bed or subtifled films or lelevision bro6ro*res, the scrolls or spots sholl be conied in the longuoge of dubbing or subtitlement" for sub-rule {7),the following sholl be substiiuted, nomely:- ,'Wherever brond nomes or logos of iobocco products form o port of the pictures to be printed in ony fJrm of print or oyidgol medio or footoge to be oired through ""v r"r- of electronic medio, it sholl be mondotory for the medio to crop Or mosk the some to ensure thot the brond nomes ond togos of the tobocco products ore not visible, except in cose of live, or defened iive telecost of sporls, culturol ond other events/octivilies held in other countries being oired on television in lndio"' ofter sub+ule {7),the following suFrule sholl be inserted, nomely:- ,,{il) n Steering Committee sholl be constituted under the choirmonship of the Union Heolth Secretory with representotion from omong others the uinirtnT of lnformotion & Broodcosting, Ministry of Low & Justice' nir"riitlng Stondords Council of lndio, Press Council of lndio' Members of Porlioment ond voluntory orgonizotions' Ihis committee will toke cognizonce suo moto or look into specific violotions under section 5 0f the Act.
