Notification Declaring Eco Sensitive Area S.O. No. 5236(E) Amendment in Bhagirathi ESA, Uttarakhand

EXTRAORDINARY PUBLISHED BY AUTHORITY No. 5017] NEW DELHI, THURSDAY, NOVEMBER 10, 2022/KARTIKA 19, 1944 MINISTRY OF ENVIRONMENT, FOREST AND CLIMATE CHANGE NOTIFICATION New Delhi, the 10th November, 2022 S.O. 5236(E).—In exercise of the powers conferred by sub-section (1) read with clauses (v) and (xiv) of sub- section (2) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986), and sub-rule (4) of rule 5 of the Environment (Protection) Rules, 1986, the Central Government hereby makes the following amendment in the notification of the Government of India, Ministry of Environment, Forest and Climate Change, published in the Gazette of India, Extraordinary, Part-II, Section 3, Sub-section (ii), vide notification number S.O. 1260 (E), dated the st May, 2012, namely:- In the said notification,- (i) in paragraph 2, – (a) in sub-paragraph (1), for the words, ―approved by the Central Government in the Ministry of Environment and Forests‖, the words ―approved by the Competent Authority of the State Government for its effective implementation‖ shall be substituted; (b) for sub-paragraph (8), the following paragraph shall be substituted, namely:- ―(8) Pending the preparation of the Zonal Master Plan for Eco-sensitive Zone and approval thereof by the Competent Authority of the State Government, all new constructions and other developmental activities shall be referred to the Monitoring Committee constituted under paragraph 4 of this (ii) in paragraph 4, - (a) in sub-paragraph (2),- (i) in item (c), the words ―to be nominated by the Government of India‖ shall be deleted; (ii) in item (g), the words ―to be nominated by the Ministry of Environment and Forests, Government of India‖ shall be deleted. (b) in sub-paragraph (4), for the words, ―Ministry of Environment, Forest and Climate Change, for prior clearances under the provisions of the said notification‖, the words ―Ministry of Environment, Forest and Climate Change or the State Environment Impact Assessment Authority, Gujarat, as the case may be, for prior clearances under the provisions of the said notification.‖ Shall be substituted.
