6- mez lhekA& lat; dqekj vxzoky] The 20 September 2022 No.-02/Est.-21-01/2022/4598/DMD&In exercise of the powers conferred under Article 309 of the Constitution of India, the Governor of Bihar, hereby please to make the following rules to constitute the Bihar State Disaster Management Service Cadre, its recruitment procedures & to regulate its Service conditions, as follows:- 1. Short title, Extent and Commencement:- (i) This rule may be called as “Bihar State Disaster Management Service Cadre Rules, 2022” (ii) It shall extend to the State of Bihar. (iii) It shall be effective from the date of notification. 2. Definitions:- Unless referred otherwise, requires in the subject or contexts in these rules, (i) "COMMISSION" means Bihar Public Service Commission. (ii) "PAY LEVEL" means any specified pay level. (iii) "APPOINTING AUTHORITY" means Departmental Minister through Principal Secretary/Secretary. (iv) "GOVERNOR" means the Governor of Bihar. (v) "STATE GOVERNMENT" or "GOVERNMENT" means Government of Bihar. (vi) "YEAR" means the Financial Year beginning from 1st April to 31st March of the next year. (vii) "VACANCY WITHIN YEAR" means created new posts for the service, accrued of vacancy by virtue of retirement. death, dismissal or discharge from the service. (viii) "DEPARTMENT" means Disaster Management Department. (ix) "DEPARTMENTAL PROMOTION COMMITTEE" means Departmental Promotion Committee constituted by the Government from time to time. (x) "SERVICE" means Bihar State Disaster Management Service. (xi) "MEMBER OR MEMBER OF THE SERVICE" means person working under this Service or appointed within this Service, under the provision of this rule. (xii) "CADRE" means Bihar State Disaster Management Service Cadre. (xiii) "CADRE CONTROL AUTHORITY" means Additional Chief Secretary/ Principal Secretary/Secretary, Disaster Management Department. 3. Constitution of Service and Classification of Posts:- (a) The Bihar State Disaster Management Service is constituted from the date of issue of this notification. (b) Structure of service shall be as follows:- POSTS NATURE OF POST REMARKS Assistant Disaster Management Officer Gazetted Basic grade Deputy Disaster Management Officer Stage Disaster Management Officer Stage (c) Sanctioned Strength for different levels/grades of this Service will be same as approved by the State Government from time to time. (d) Pay Scale/Pay Level for different categories of posts in this Service will be same as approved by the Finance Department, Government of Bihar, from time to time. 4. Calculation of vacancies and its information to the Commission:- Based upon the vacancies as existed on 31st March in Basic Grade, the reservation category wise vacancies in Basic Grade post will be calculated on 1st April every year and reservation category wise requisition will be made available to the Commission by 30th April each year. The Commission, after selection of candidates on the basis of Combined Competitive Examination, will send reservation category wise recommendation to the Department for their appointment. 5. Reservation Provision:- Provision of reservation shall be applicable to this Service as decided by the government from time to time for Recruitment and Promotion. 6. Age Limit:- The minimum age of a candidate for direct recruitment shall not be less than 21 years as on 1st August of the Year in which the applications for recruitment are invited. The maximum age limit will be in accordance with the provisions prescribed by the General Administration Department, Government of Bihar from time to time. 7. Duration:- Minimum time period for promotion to higher posts of the Service will be same as may be fixed by the General Administration Department, Government of Bihar, from time to time. 8. Appointment on Basic Grade Posts:- (a) Appointment to the Basic Grade Posts will be done by direct recruitment as per the recommendations received from the Commission on the basis of the results of the Combined Competitive Examination conducted by the Commission. (b) The applicant must have a graduation or equivalent degree from a recognized University (c) The first posting in the Basic Grade will be made on the post of Assistant Disaster Management Officer. 9. First Promotion Grade:- The posts of the First Promotion level will be filled by way of promotion from the officers of Basic Grade, who have passed the departmental examination conducted by the Central Examination Committee, Board of Revenue and whose service is confirmed. This post will be filled by way of promotion on seniority cum merit basis as recommended by the Departmental Promotion Committee. 10. Second Promotion Grade:- The posts of the Second Promotion level will be filled by way of promotion on seniority cum merit basis as recommended by the Departmental Promotion Committee. 11. Composition of the Departmental Promotion Committee:- The Departmental Promotion Committee shall be constituted by the Department by a separate order. 12. Probation – (a) Every officer appointed by way of direct recruitment shall be on Probation for a period of two years from the date of joining. (b) On completion of probation period, the Government may extend the period of probation for one more year if the conduct and service of the officer is not found satisfactory provided that there is a possibility of improvement in the conduct and service of the officer. The service may be terminated if the conduct and service is not found satisfactory even in the extended probation period. (c) After the first increment after appointment, the next increment will be admissible only after passing the prescribed departmental examination. (d) Subjects, Syllabus and formulation of procedure and conduct of the departmental examination and examination shall be done by the Central Examination Committee, Board of Revenue, Bihar. 13. Training:- Newly appointed officers will have to complete the training prescribed by the Department. The duration of training and other provisions will be formulated through regulations made by the Cadre Controlling Authority. 14. Confirmation:- An officer appointed on probation may be confirmed in service on completion of requisite training as well as satisfactory completion of period of probation and passing the requisite departmental examination. 15. Seniority:- The seniority of the Member of this Service will be determined in accordance with the principals and procedure laid down by the General Administration Department, Government of Bihar from time to time. 16. Control:- (a) Administrative control over the members of this cadre will be vested with Department. (b) The operational control over the members of this service will be vested with the concerned District Magistrate/Divisional Commissioner of the district/division in which the officer is posted for the time being. 17. Power to make regulations:- In order to give effect to the provisions of this rule, the Department may make necessary regulations. 18. Redressal of discrepancies/doubts The power to resolve all discrepancies/doubts relating to the implementation of the provisions of this rule will be vested in the State Government. 19 Residual case:- In respect of the remaining matters which are not covered within ambit of this rule, in respect of which no specific provision has been made in this rule, the members of the Service shall be governed by the relevant rules, orders and circulars etc. of the State Government issued from time to time for the employees of the same category. 20. Repeal and Saving:- All rules/instructions, etc., in this regard issued prior to this rule shall be deemed to have been repealed. Notwithstanding such repeal, any work done and action taken under the relevant rules/instructions etc. shall be deemed to have been done under these rules.
