Short title and commencement—(1) These Rules may be called Protection ofPlant Varieties and Farmers’ Rights (SecondAmendment) Rules, 2612 (2) They shall come into force on tlte date oftheir publicationin the Ofiicial Gazette 2. In the Protection ofPlant Varieties and Farmers Rights Rules, 2003, after rule 36, the following rule shall be inserted namely :— “36A Manner for arranging production and sale ofmds of registered variety under clause (e) ofsub-section 2 of section 8—0) The bmder ofa registered variety or any person entitledto produce, market and sell the seeds ofa registered variety under this Act shall :— (a) provide the seeds orpropagating material ofthe registeredvariety to thefamiers in atimely manner, so as to satisfy their reasonable requirements; or (b) arrange for production, marketing and sale of seeds or propagating material of such registered variety to the farmers at a reasonable market price” the 12th September, 2003 and subsequently amended by GS.R. 843(E), dated the 30th December, 2004, GS.R. 731(8), dated the 14th October, 2008, GSR. 319(E), dated the llth May, 2009, GS.R. 783(E), dated the Printed by the Manager, Government of India Press, Ring Road.
