NOTIFICATION RiGHT To FAIR COMPENSATION AND TRANSPARENCY IN LAND AcQuISITION, REHABILITATION AND RESETTLEMENT AcT, 2013 . No. Sankirna. 2018/C.R.46/A-3.—WHEREAS, the Government of Maharashtra has, vide the Government Notification, Revenue and Forests Department, No. MIS. 11/2014/CR.77(PART-2)/A-2, dated the 11th September 2015 (hereinafter referred to as the said notification), issued in exercise of the powers conferred by proviso 10 clause (6) of section 3 of the Right to रिक्षा Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 (30 of 2013), in its application to the State of Maharashtra (hereinafter referred to as the said Act), notified that, in relation to acquisition of land in respect of a public purpose as defined in clause (za) of section 3 of the said Act, in a District ति क्षी area not exceeding 10,000 hectares, the Collector of such District shall be deemed to be the appropriate Government; AND WHEREAS, section 10A of the said Act provides that the State Government may, in the public interest, by notification in the Official Gazette, exempt any of the projects mentioned in the said section 10A from the application of the provisions of Chapter Il and Chapter IIl of the said Act; AND WHEREAS, it appears to Collector of the Ahmednagar District, being the appropriate Government as provided in the said notification, that the lands mentioned in the Schedule | appended hereto are required or likely to be required ति the project mentioned in the Schedule Il appended hereto, which is covered under clause (b) of the said section 10A (hereinafter referred to as “ the said project ”); AND WHEREAS, the State Government has ensured the extent of the said lands for the proposed acquisition keeping in view the bear minimum land required for the said project; AND WHEREAS, the Government of Maharashtra considers it expedient to exempt the said project under the said section 10A of the said Act from the application of the provisions of Chapter Il and Chapter 11 of the said Act; NOW, THEREFORE, in exercise of the powers conferred by section 10A of the said Act and of all other powers enabling it in that behalf, the Government of Maharashtra hereby exempts the said project from the application of the provisions of Chapter Il and Chapter Il of the said Act.
