(EXTRA.), JUNE 9, 2023 (JYST. 19, 1945 SAKA) 1415 Øe la[;k HARYANA GOVERNMENT EXCISE AND TAXATION DEPARTMENT Notification The 9th June, 2023 No. 22/X-1/P.A.1/1914/Ss.21 and 59/2023.— In exercise of the powers conferred under sections 21 and 59 of the Haryana Excise Act, 1914 (Punjab Act 1 of 1914), and with reference to the Haryana Government, Excise and Taxation Department, notification No. No.55/X-1/P.A.1/1914/S.9/2022, dated the 6th September, 2022, I, Ashok Kumar Meena, Excise Commissioner, Haryana, hereby makes the following rules further to amend the Punjab Distillery Rules, 1932, in their application to the State of Haryana, namely:- 1. (1) These rules may be called the Punjab Distillery (Haryana Amendment) Rules, 2023. (2) They shall come into force with effect from the 12th day of June, 2023. 2. In the Punjab Distillery Rules, 1932 (hereinafter called the said rules), in rule 3, for clause (e), the following clause shall be substituted, namely :- “(e) For setting up a distillery/Ethanol Plant in the State of Haryana an applicant shall obtain a Letter of Intent before the installation of the Distillery Plant. The letter of Intent shall be issued with certain terms and conditions with a specified period of validity. It shall be issued with the permission of the Government. Fee for Letter of Intent to be issued for the first time and for subsequent years shall be as under:- Serial Number Type of plant to be established Annual fee for grant of LOI Re-validation fee for each subsequent extension of Letter of Intent for one year 1 Distillery ₹5,00,00,000 ₹50,00,000 1416 HARYANA GOVT. (EXTRA.), JUNE 9, 2023 (JYST. 19, 1945 SAKA) Serial Number Type of plant to be established Annual fee for grant of LOI Re-validation fee for each subsequent extension of Letter of Intent for one year 2 New ethanol plant for production of ethanol only 3 Installation of a new standalone separate Ethanol Plant within the existing licensed premises of D-2 License (there should be no common boiler, turbine, distillation process and such like facilities) for production of ethanol only. 3. In the said rules, in rule 4, for clause (a), the following clause shall be substituted, namely:- “(a) deposited a sum of rupees for following license, namely:- Serial Number Name of License Installed Capacity in Kilo Litre per day License fee (In Rs.) 1. D-2 Less than 60 Kilo Litre 2,00,00,000/- From 60 Kilo Litre to less than 120 Kilo Litre 120 Kilo Litre or above 4,00,00,000/- 2. D-2A - 5,00,000/- in addition to D-2 license fee 3. D-2B - 5,00,000/-.”. 4. In the said rules, in rule 28, for clause (i), the following clause shall be substituted, namely:- “(i) The general operation of the distillery shall be allowed for 8:00 hours in a working day which can be extended by further 8:00 hours (i.e. first extra shift) by a distillery/bottling plant on payment of ₹18,00,000/-per annum and for further 8:00 hours (i.e. second extra shift ) on payment of ₹12,00,000/- per annum with the prior permission of competent authority.”.
