The Registrar shall, not less than thirty days previous to each annual meeting of the Court, issue to each member a notice of the same. In the case of meetings other than the annual meetings of the Court, the Registrar shall give at least ten days' notice of the time and place of the meeting as the circumstances in each case may permit. In such cases he shall issue the Agenda paper alongwith a notice of the meeting. I. 2. (i) Notice of the meeting (ii) Provided that in the case of emergency meetings, the Vice- Chancellor may call a meeting by giving a shorter notice. (iii) The requisition for a special meeting of the Court, signed by not less than so members of Court, shall be accompanied, in writing, by the business which is intended to be trans- acted at the meeting of the Court together with the names of the proposers and the seconders of the resolution or resolutions, if any, to be moved. 3. (i) Any vacancies among the officers of the University or among the members of the Court or the Executive Council or the Finance Committee which ought to be filled by the Court shall be so filled up, either at the annual meeting of the Court or at any meeting convened by the Vice- Chancellor. (H) A report of the working of the University during the previous year, together with a statement of the receipts and expenditure, the balance sheet, as audited, and the financial estimates shall be presented to the Court at its annual meeting. The Chancellor shall, if present, preside at all meetings of the Court. (ii) The Pro-Chancellor shall, if present, in the absence of the Chancellor, preside at the meetings of the Court. (Hi) The Vice-Chancellor shall, if present, in the absence of the Chancellor and the Pro-Chancellor preside at the meetings of the Court. (iv) The Pro-Vice-Chancellor shall, if present, in the absence of the Chancellor, the Pro-Chancellor and the Vice- Chancellor, preside at the meeting of the Court. (v) If the Chancellor, Pro-Chancellor, Vice-Chancellor and the Pro-Vice-Chancellor are absent from any meeting of Business for the Court President of the Court the Court, the members present shall elect a Chairman for the meeting. At all meetings of the Court, 25 members, inclusive of the Chairman, shall form a quorum. If a quorum is not present 15 minutes after the appoi- nted time of the meeting, the Chairman may adjourn the meeting. Any member of the Court may, in the course of a meeting, call the attention of the Chairman in regard to the absence of the quorum, and in the absence of a quorum, the Chairman shall either dissolve or adjourn the meeting. Any member who wishes to propose a resolution at the meeting of the Court shall forward the terms of the resolu- tion to the Registrar so as to reach him not later thar fourteen days before the date fixed for the meeting. 6. (i) Notice of Resolution and Amendment All resolutions shall appertain to the powers and duties of the Court in accordance with the Act, the Statutes and the Ordinances. Any resolution which is not in conformity with this rule shall not be admitted. (3) The Vice-Chancellor shall be the sole authority to determine whether a resolution is in order. No resolution not admitted by the Vice-Chancellor, shall be included in the Agenda. 7. (i) The Registrar shall, at least twelve days before the date of the meeting issue an Agenda paper showing the business to be brought before the meeting, and the terms of all the resolutios admitted by the Vice-Chancellor to be proposed after their notice in writing has previously reached him, together with the names of the proposers. (2) Notice of an amendment to a motion or resolution included in the Agenda must reach the Registrar at least seven days before the meeting of the Court at which the motion or resolution is to be considered. (3) If any amendments are received, the Registrar shall, as soon as possible in the circumstances, notify the amendments proposed to the members of the Court. 8. No resolution, proposal,amendment, or any other business of which due notice has not been given shall be brought before the Court at any meeting without the special permission of the Chairman except the following*. : (a) to adjourn the debate, (b) to adjourn the meeting, (c) to dissolve the meeting, (d) to change the order of the business, *Note : Motions (a), (b), (c) and (d) shall not be moved without the sanction of the Chairman. (e) to refer any matter to any authority of the University, (f) to pass on to the next item of the business, (g) to appoint a Committee, and (h) to propose that the question be put to vote. 9. (i) No amendment of which a due notice has not been given shall be moved to a motion or resolution which is being considered at a meeting of the Court unless (a) the Chairman rules it to be in order as arising out of the debate, or (b) Permission to move the amendment is given by a majority of the members present. (ii) At a special meeting of the Court, called on due requisition of members of the Court, any member may bring forward any amendment without previous notice being given. ro. (t) Every motion shall be affirmative in form and must be seconded. Procedure A motion standing in the name of a member who is absent from the meeting may be proposed by any other member of the Court. When a motion has been seconded the terms of it shall be stated by the Chairman and the discussion thereon, if any, may then proceed. If no discussion is raised or no amendment thereto is proposed the motion shall at once be put to the vote. Every motion shall be decided by the majority of the votes of the members present. In the case of the votes being equal, the Chairman shall have casting vote in addition to his own vote as a member. When an amendment has been proposed and seconded, the terms of such an amendment shall be stated by the Chairman and the discussion of the original motion and the amendment thereto shall proceed pad passu. Not more than one motion and one amendment thereto shall he placed before the meeting at the same time. No amendment shall be proposed which will in effect constitute a direct negative to the motion. Every amendment must be relevant to the motion to which it is moved. No amendment shall be proposed which raises a question already disposed of by the meeting or which is inconsistent with any resolution already passed by it. The order in which amendments are to be borought forward before the meeting shall be determined by the Chairman. An amendment must be seconded in the same manner as the motion failing which it shall drop. A seconder of an amendment may reserve his speech with the permission of the Chairman. (to) (it) (t2) No member shall be allowed to speak more than once in the- course of the disucssion of a motion or of a motion and an amendment, except the proposer of the substantive motion, who will have a right to reply in either case at the close of the discussion, provided that a member who has spoken on a motion before the proposal of an amendment thereto, shall be entitled to speak once again upon such amendment. No speech in the Court, other than that of the Chairman, shall exceed ten minutes. (13) The Chairman shall decide who is in possession of the House. (14) No member shall speak on the question after the mover has entered on his reply. (t5) When the debate is concluded, the Chairman shall, after summing up, if he so desires, put the question to the vote thus :— (a) If there is an amendment, the Chairman shall state the motion and the amendment and take the vote of the meeting on the amendment. (b) If the amendment is negative, the original motion shall be again stated from the Chair, and subject to the foregoing regulations; any other amendment which is in order may than be proposed thereto. If an amendment is carried, the motion as amended shall be stated from the Chair, and then be debated as a sub- stantive question to which any further amendments to the original motion which are in order may be proposed, subject to the foreogoing regulations. Such further amendment shall be disposed of in the same manner as the original amendment. When all the amendments have been thus dealt with, the Chairman shall take the vote of the meeting on the motion as amended, as the substantive resolution. (16) A member proposing the adjournment of the meeting or of a discussion shall also state the date and the time for such ad- journment. A meeting or discussion continued on adjourn- ment shall be deemed one with that preceding the adjournment. (17) If a motion for dissolution is carried, the business before the meeting shall drop. (18) A motion of an amendment may be withdrawn by the proposer with the consent of two-thirds of the members present at the meeting. (t9) Any member may, with the permission of the Chairman, even whilst another is in possession of the House, rise to explain any misconception of any expression or expressions used by him, but he shall confine himself strictly to the same. (20) Any member may at any time in the course of discussion rise and call the attention of the Chairman to a point of order. If a point of order is raised by one member in the course of speech by another, the speaker shall resume his seat until the Chairman has decided it. If the Chairman is of opinion that the point of order has been raised vexatiously or for the purpose of more obstruction to the discussions or to the business of the (c) meeting, he shall so declare it and it shall be deemed a breach of order. (2 r) The Chairman shall be the sole judge on the point of order and may, at his own instance or at the instance of a member call to order any member who is speaking. If the member so called to order disregards such call, the Chairman may direct him to resume his seat. If the member so directed to resume his seat disregards or questions the ruling of the Chairman, the Chairman may adjourn the meeting or may forthwith at his discretion take a vote of the meeting as to whether such member shall not be suspended from his functions as a member for that day. If two-thirds of the members present are in favour of such suspension, the Chairman shall declare the member offending suspended and such member shall immediately whithdraw. The meeting shall thereupon proceed to business treating such member as absent from the meeting. (22) On putting a motion or amendment to the Vote, the Chairman shall call first for the expression of the opinion of the meeting by a show of hands and shall declare the result thereof. Any member dissatisfied with such a declaration may then and there demand a division and the Chairman shall elect two or more from among the members of the Court to act as tellers. The tellers shall then take such voting paper to each member who shall subscribe his name in one or other of the two columns, according as hi- is in favour of or against the motion or amend- ment before the meeting. (23) When all the members present desiring to vote, including the tellers have subscribed their names on the voting paper or papers, the tellers shall c,st up the number of the two columns, and when the total have been recorded, shall sign their names thereto and hand the voting paper or papers to the Chairman, who shall thereupon declare the result of the division. When the numbers are equal, the Chairman shall have a second or casting vote and, if he gives it shall record the same on the voting paper below the signature of the tellers as follows: "1 give my casting vote" ("for" or "against" the motion or amendment as the case may be) and shall sign his name and description as Chairman. (24) Any member may demand that votes be taken by ballot and the Chairman may decide that votes be recorded by ballot. In case a motion for ballot is supported by not less than six members of the Court present in the meeting, the Chairman shall order that votes be recorded by ballot and shall select two or more from among the members of the Court to act as scruti- neers. The Registrar shall then give a voting paper to each member who shall record his vote "for' or "against" a motion in the one or other of the two columns of the voting paper according as he is in favour of or against a motion or amendment before the meeting. (25) When all the members present desiring to vote, including the scrutineers, have recorded their vote, the scrutineers shall cast up the number of the two columns and when the totals have been recorded shall sign their names thereto and hand the voting paper or papers to the Chairman who shall thereupon declare the result of he ballot. When the numbers are equal, the Chairman shall have a second or casting vote and if he gives it, shall record the same on the voting paper below the signature of the tellers as follows : "I give my casting vote" ("for" or "against" the motion or amendment as the case may be); and shall sign his name and description as Chairman. (26) If the Chairman desires to take an active part in a debate he shall vacate the Chair until the vote on that debate shall have been taken. During such time the Chair shall be taken by a member present appointed by the Chairman. The actin°. Chairman shall, during the debate in question, exercise all theb rights of the Chairman. it. (I) A motion for the appointment of a Committee on a subject Corn- under debate may be made by any member at any time, mittee and without the notice required by Regulation No. 6(t). (2) A motion for the appointment of a Committee Must define the purpose for which the Committee is to act and the number of its members. Amendment to enlarge or restrict the number may be made without previous notice. If the motion is carried, the member shall name the persons whom he wishes to form a Committee. Any member or members may thereupon propose and second other names. Votes shall then be taken and the requisite number appointed from those who obtain the largest number of votes. The Court shall appoint a member of the Committee as Chairman of the Committee. The quorum for a Committee shall be not less than a majority of the members appointed. The Committee appointed by the Court shall submit a report to the Court and it shall be presented to the Court at its next meeting. No matter which has been decided by the Court shall, within a period of six months, be reconsidered by the Court except at a special meeting of the Court convened for that purpose upon the requisition of not less than 3o members. Once every twelve months or at such other intervals as the Court may direct, the Executive Council shall cause the minutes of the meetings of the Court, Executive Council and Academic Council to be printed and a copy thereof be forwarded to each member. A member of the Court may ask for information regarding matters connected with the administration of the University. But no information which is of a confidential nature andjor which reflects upon the personal character or - competence of a member of the University staff, shall be asked for or supplied. Reconsi- deration of previous decisions. x3. Supply of Minutes of the Court. Interpella- tions. 676 Regulations--Executive Council The Vice-Chancellor, or, in his absence, the Pro-Vice- Chancellor, may decline to give information about any question if he considers it contrary to the best interests of the University. Such a decision shall be final. Subject to the above, the information asked for will be supplied to the members concerned. THE EXECUTIVE COUNCIL ( In the Regulations the "Vice-Chancellor" includes in his ab ,-ence the 2. I. Meetings of the Executive Council shall be convened by the Vice-Chancellor at any time. But on a requisition signed by any five members of the Executive Council to convene a special meeting thereof, theVice-Chancel lpr shall convene a special meeting on a date fixed by him. At such meeting only such subjects as the signatories to therequisi- tion have set forth in the requisition shall first be brought forward and disposed of. 2. The Registrar shall, ordinarily, at least seven days before each meeting of the Executive Council, issues to each member thereof a notice convening the meeting and a copy of the Agenda thereof: Provided that in the case of emergent Meetings, the Vice- Chancellor may suspend or modify the operation of this rule. At all meetings of the Executive Council seven members shall form a quorum. The Vice-Chancellor shall be the Chairman of the Executive Council. In his absence, the Pro-Vice-chancellor shall be the Chairman and in the absence of both, the Council shall elect its own Chairman, for the meeting from amongst the members present. 5. The Registrar shall be the ex-officio Secretary. In the absence of the Registrar, the person performing the duties of the Registry r shall act as Secretary. 6. No resolution, proposal or other matter, foreign to, or wholly inconsistent with, the matter appearing in the Agenda paper shall be decided by ha t e Executive Council, except to the extent permitted by the Chairman whose decision on the subject shall be final. 7. Every motion shall be in the form of a resolution which must be seconded. 8. When a motion has been duly proposed and seconded, the Chairman shall read it out to the meeting. It shall then be open to discussion, and if there be no discussion, the motion shall at once be put to the vote. f3 Regulations—Executive Council 677 10. Any member present may propose an amendment to a motion. When two or more amendments are proposed, the Chairman shall put them to the vote in the inverse order, the last amendment being put to the vote first, and the first last. 1. It shall be in the discretion of the Chairman to decide whether an amendment is in order or not. 12. An amendment must he duly seconded. 13. The proposer of an amendment may make speech in support o1 his amendment, but he shall not be entitled to reply. Every question shall be decided by a majority of the votes of the members present. It shall be in the option of the Chairman to decide the manner in which the votes of the members shallbe recorded. 15. In the case of equality of votes, the Chairman shall have the casting vote in addition to his vote as member. 16. No member shall have a right to speak more than once in the course of the discussion of a motion or of an amendment, except the proposer of the motion who shall have the right to reply at the close of the discussion of the motion. 17. No speech other than that of the Chairman shall exceed ten minutes in duration. i8. It shall be in the power of the Chairman to regulate the order of the speeches. 19. A motion for dissolution of the meeting, adjournment of the meeting, adjournment of the discussion, or closure may be made at any time as a distinct question, but not in the from of an amendment, nor while a member is speaking. 20. If a motion for dissolution of the meeting is carried, the meeting shall stand dissolved. If a motion for adjournment of the dis- cussion is carried, such discussion shall stand postponed tothe next meeting. If a motion fr closu is carried, the substantive proposal, or the amendment o thereto, re as the case may be, shall immediately be put to the vote. 21 A member proposing the adjournment of the meeting or of the discussion shall also mention the date and time for such adjournment. A meeting or discussion continued on the adjourned date shall be deemed to be the continuation of the adjourned meeting. 22. No discussion shall be allowed on a motion mentioned in Regulation No. 20. 23. A member may withdraw his motion or amendment, and any motion or amendment may be withdrawn by its proposer with the consent of two-thirds of the members present at the meeting. 24. Any member may, by way of personal explanation, with the permission of the Chairman, explain any misconception of the fact, btit in doing so he shall strictly confine to a statement of the fact. r r 678 Regulations—Academic Council 25. Any member may, at any time, in the course of a discussion rise and call the attention of the Chairman to a point of order. 26. Res. No. 162, dated 18.11.1960. Regulations—Fac. of Arts 679 3. The Vice-Chancellor shall be the Chairman of the Academic Council. In his absence, the Pro-Vice-Chancellor shall be the Chairman, and in the absence of both, the Council shall elect its own Chairman for the meeting from amongst the members present. 4. At all meetings of the Academic Council, twenty five (now 1 thirty) members shall form a quorum. 5. Business not included in the Agenda** as sent to the members may only be taken up by permission of the Council given by a two-thirds majority vote, provided that (a) any recorn-a-rriendation to the Executive Council and .13) any business falling within the sphere of the Committee of Courses and Studies which has not been considered by such Committee, shall, if they were not included in the Agenda, only be taken up by a nemine contradicente vote of the Council. 6. The Registrar shall be the ex-officio Secretary. In the absence of the Registrar, person performing the duties of the Registrar shall act as Secretary. 7. All proposals brought forward for the consideration of the Academic Council, shall be decided by majority of votes. The Chairman may decide that any matter may be so decided by a secret ballot or by the show of hands at his discretion. 8. All amendments to any proposal shall be put before the proposal itself, the last amendment being put up first, and if carried, other amend- ments inconsistent with it shall be treated as rejected and the substantive proposal shall likewise be so treated. g. It shall be open to the Chairman to put to the vote any amendment in parts, or two or more amendments consolidated. The Chairmen may also take vote on two or more amendments in the alterna- tive. to. Meetings of the Faculty may be convened by the Dean of the faculty at any time and shall be convened by him on receipt of et requisitior signed by not less than five members. 2. The Secretary, Faculty of Arts shall, not less than five days previous to each meeting of the Faculty, issue to each member a notice stating the time and place of the meeting alongwith the Agenda papers. **Items on the Agenda dealing with individual students shall be given precedence at all meetings of the Council (A.C. Any member wishing to make a proposal not included in the Agenda may send his proposal to the Secretary, Faculty of Arts, so as to reach his office at least three days before the date of the meeting. The Secretary, Faculty of Arts, shall circulate these proposals among the members. 4. No business or proposal, or which previous notice has not been given, shall be brought before the meeting except by permission of the Faculty given by a two-thirds majority vote of the members present. 5. At all meetinqi the Faculty, eight members, inculsive of the Chairman, shall form a quorum. But if a meeting is adjourned for want of a quorum, for the adjourned meeting, no quorum shall be necessary. 6. In the absence of the Dean, the members present shall elect their own Chairman. 7. The Chairman may give his own vote, and on equality of votes, he shall possess a casting vote. 8. The rules of discussion shall be the same as those for the Academic Council, and the Chairman shall have power to enforce them at his discretion. *THE FACULTY OF SCIENCE 5. i. Any member wishing to make a proposal not included in the Agenda may send his proposal to the Registrar so as to reach his office at least three days before the date of the meeting. The Registrar shall circulate such proposal among the members of the Faculty. 2. No business or proposal, of which previous notice has not been given, shall be brought before the Faculty at the meeting, except by special permission of the Chairman. 3. In the absence of the Dean, the me ers present shall ellect their own Chairman: 4. The Chairman may give -firs own vote, and on equality of votes, he shall possess a casting vote. 5. The rules of discussion shall be the same as those tor-the meetings of the Academic Council, and the Chairman shall have the power to enforce them at his discretion. 6. If two, or more Committees belonging to the same Faculty meet jointly, the Chairman at the joint session will be the Dean, or a Head of the Department appointed by the Dean : Whereas if such Committee belongs to different Faculties, the Chairman, at the joint session shall be the Vice-Chancellor, or a Head of a Department appoin- ted by the Vice-Chancellor. *Since revised vide Ordinance XIV-B. Meetings of the Faculty may be convened by the Dean of the Faculty at any time, and shall be convened by him on receipt of a requisition signed by not less than three members. 2. The Registrar shall, not less than five days previous to each meeting of the Faculty, issue to each member a notice stating the time and place of the meeting alongwith Agenda papers for the meeting. 3. Any member wishing to make a purpesal not included in the Agenda may send his purposal to the Registrar so as to reach his office at least three days before the date of the meeting. The Registrar shall circulate such proposal among the members of the Faculty. 4. A. (r) There shall be a Committee of Courses and Studies for each of the following Departments for Under-graduate (other than the Honours), Honours Post-graduate and Research Studies in the subjects assigned to them : (i) Linguistics (ii) Sanskrit (iii) Buddhist Studies (iv) Arabic and Persian (vii) Modern Indian Languages---one for each language. viz. Tamil, Telugu, Malayalam, Kannada, Gujarati, Marathi and Sindhi. 2. The Committee of Courses and Studies shall consist of the following :-- Head of the Department (ex-officio member and Chair- man). (b) All Professors in the Department (ex-officio members), (e) One-third of the total number of Readers in the Depart- ment or four Readers, whichever is more, by rototion in order of seniority. (d) Two Lecturers from the University Department or the actual number of Lecturers, whichever is less by rotation in order of seniority. Six Lecturers from the Colleges, associated with teaching of Post-graduate and/or Honours Courses, three of whom shall be chosen by rotation on the basis of seniority from among those teachers in all Colleges who have put in not less than to years service, and the remaining three shall be chosen by rotation on the basis of seniority from amongst those teachers in all Colleges who have put in less than • o years' service, provided that not more than one of the teachers from both the categories belongs to one and the same College : Provided, however, that in the, case of a Department where instruction in any of the subjects assigned to it is exclusively provided in the Department itself and not in any of the Colleges, the number of Lecturers from the Department under category (d) above may be increased up to a maximum of 8 ; Provided further that in the case of a Department where the number of Lecturers is less than two, the Department (a) (e) Regulations—Conte. of Courses & Stds. 687 shall have the option to include that number of additional Readers under category (c) or additional Lecturers from Colleges under category (e) equivalent to the short-fall in the number of Lecturers under category (d) Provided further that in a University Department which has Professors. Readers, and Lecturers as well as a large number of Lecturers in the Colleges, and which still chooses to have only one Committee of Courses and Studies for Under graduate (other than Honours), Honours, Post Graduate and Research Studies, the Department shall have the option to include eight Lectu- rers under category (e). 3, (a) Members of the Committee other than ex-officio members shall hold office for a term of two years. (b) In respect of the category of teachers who have put in less than 10 years' service and have become members under (c) above, the membership will continue for the full term of two years irrespective of whether or not they complete to years of service during the course of the term of two years. 4. The Committee shall have the power to invite to its meetings one or two experts from other universities/Research Institute when the question of restructuring of courses of studies or revision of the syllabii of papers is considered by the Committee and such experts shall be nominated by the Committee, with the approval of the Vice-Chancellor. 5. The meetings of the Committee may be convened by the Head of the Department at any time and shall be convened by him on receipt of the requisition signed by not less than three members. 6. All notices stating the time and place of the meeting along with the agenda papers shall be issued not less than three days before the date of the meeting. 7. (e) r Four Lecturers from the Colleges, associated with the teaching of post-graduate and/or honours courses, two or whom will be chosen by rotation on the basis of seniorsity from among those teachers in all colleges who have put in not less than s o years' service and the remaining two will be chosen by rotation on the basis of seniority from amongst those teachers in all colleges who have put in less than so years' service provided that not snore than one of the teachers from both the categories belongs to one and the same college : Provided, however, that in the ease of a Department where instruction in any of the subjects assigned to it is exclusi- vely provided in the Department itself and not in any of the Colleges, the number of Lecturers from the Depart- ment under category (d) above be increased upto a maximum of 6 : Provided further that in the case of a Department where the number of Lecturers is less than 2, the Department shall have the option to include that number of additional Readers under category (c) or additional Lecturers from Colleges under category (e) equivalent to the short-fall in the number of Lecturers under category (d) : Provided further that in a University Department which has Professors, Reeders, and Lecturers as well as a large number of Lecturers, in the Colleges, and which still chooses to have only one Committee of Courses and Studies for Under-graduate (other than Honours) Honours, Post-graduate and Research Studies, the Department shall have the option to idclude eight Lecturers under category (e). 2. The Committee of Courses and Studies for the Under-graduate (excluding Honours) studies shall consist of the following :— (a) The number of members shall not exceed lo. The exact number for each Department shall be decided by the Faculty concerned on the basis of the requirements of the subject concerned and the strength of the Department. (b) The Head of the Department in the subject concerned shall be an ex-officio member and the Chairman of the Committee. (c) Two teachers from the University Department concerned and the rest from amongst the teachers associated with the teaching, the two teachers from the University Department concerned shall be members of the Committee by rotation on the basis of seniority. The rest of the members shall be chosen from amongst the teachers who are associated with the teaching by rotation on the basis of the seniority in all the Colleges provided that not more than one teacher shall be from one and the same College : Provided that if the total number of members of the Committee of Courses and Studies is less than so, teachers from different categories shall constitute the Committee proportionately according to the principles enunciated above. g. In the case of the Department of Modern European Languages, the Committee of Courses and Studies shall consist of the following (a) The Head of the Department of Modern European Langu- ages (Member and Chairman). (b) One teacher from each Language by rotation in order of seniority. The provisions under Clauses (3) to (7) uuder Secf on 'A' of these regulations regarding the term of office, the power to invite one or two experts to the meetings of the Committee, the quorum, issue of notice and agenda etc., shall mutatis mutandis apply to the Committees under B (I), (2) ad (3) above." COMMITTEES OF COURSES AND STUDIES IN THE FACULTY OF SCIENCE REGULATIONS REGARDING CONSTITUTION AND MEETINGS r. Constitution of the Committees of Courses and studies in each subject in the Departments comprised in the Faculty of Science, shall he as follows : (i) Physics and Astro-Physics—There shall be two Committees of Courses and Et udies—one for Honours, Post-graduate and Research Studies and another for Under-graduate (encluding Honours) Studies. (iii) Botany -do- (v) Home Science -do- (vi) Anthropology/ Courses of Stds. There shall be only one Committee of Courses and Studies for Post-graduate and Honours Courses. In the case of History of Science and one-year Certificate Course in Forensic Science in the Department of Anthropology separate Committees of Courses and Studies shall continue as constituted under the existing rules. 2. The composition of the Committees of Courses and Studies for the Honours, Postgraduate and Research Studies in each of the Departments of Physics and Astrophysics, Chemistry, Botany, Zoology and Home Science, shall consist of the following :— (a) The Head of the Department concerned (ex-officio member) (b) All Professors in the Department concerne officio(ex members) (c) One tir of te total nmber of Reaers in the Deart - ment h or d four h Readers,u whichever is d more, by rotation in order of seniority. Two Lecturers from the university Department or the actual number of lecturers whichever is less by roration in order of seniority. The Committees of Courses and Studies for the Under—graduate (excluding Honours) Studies shall be as follows :— (a) The number of members shall not exceed so. The exact number for each Department will be decided by the Faculty concerned on the basis of the subject concerned and the strength of the Department. (b) The Head of the Department in the subject concerned shall be an ex-officio member and the Chairman of the Commit- tee. Two teachers from the University Department concerned and the rest from amongst the teachers associated with the teaching. The rest of the members shall be chosen from amongst the teachers who are associated with the teaching by rotation on the basis of seniority in all the Colleges provided that not more than one teacher shall be from one and the same College : Provided that if the total number of members of the Committee of Courses and Studies is less than to, teachers from different categories shall consitute the Committee poportionately according to the principles enunciated above., In respect of the Departments of Authropology and Geology, the composition of the Committee of Courses and Studies in each of these Departments shall be as follows :— (a) The Head of the Department concerned (ex-officio member and Chairman) (b) Professors, if any (ex-officio members) (c) All Readers front the University Department if the number does not exceed three. (d) One-third of the total number of Lecturers in the Univer- sity Department or four Lecturers of the Department, whichever is less, by rotation in order of seniority. In respect of the Department of Nursing, the composition of the Committee of Courses and Studies shall be as follows :— (a) The Head of the Departmenr concerned (ex-officio members and Chairman) (b) Professors, if any (ex-officio members) (c) One-third of the total number of Lecturers in the Univer- sity Department or four Lecturers of the Department, whichever is less, by rotation in order of seniority. COMMITTEE OF COURSES AND STUDIES IN THE FACULTY OF LAW Regulations Regarding Constitution and Meetings 1. There shall be a Committee of Courses and Studies appointed by the Faculty of Law as below: (a) The Head of the Department (b) Two teacher-members of the Faculty, and (b) Two non-teacher members of the Faculty. 2. The Committee of Courses ar.d Studies shall have power to co-opt not more than two persons as its members. 3. Meetings of the Committee may be convened by the Head of the Department at any time and shall be convened by him on reteipt of a requisition signed by two or more members. 4. Ordinarily notices of meetings shall be issued to each member atleast three days before the date or the meeting together with the Agenda for the meeting. An emergent meeting may be convened by the Head of the Depart- ment at any time. 5. Members of the Committee shall hold office for three years. 6. The quorum shall consist of three members. COMMITTEE OF COURSES AND STUDIES IN THE FACULTY OF MEDICAL SCIENCES Regulations Regarding Constitution and Meetings 19. 1. There shall be one Committee of Courses and Studies appointed by the Faculty of Medical Sciences consisting of not more than fourteen members at least four of whom shall be teachers in the Faculty of Medical Sciences. 2. The Committee shall have powers to co-opt four additional members, if necessary. 3. The Dean of the Faculty shall be an ex-officio member Convener and Chairman of the Committee. In the absence of the Dean, the Committee shall elect a Chairman from among their own number. 4. The meeting of the Committee may be convened by the Convener of the Committee at any time and shall be convened by him on receipt of a requisition signed by not less than four members. 5. (b) In respect of the category of teachers who have put in less than so years' service and have becorrie members under (e) above, the membership will continue for the full term of two ears irrespective of whether or ot they complete to years y of service during the course of n the term of two years. 4- The Committee shall have the power to invite to its meetings one or two experts from other Universities Research Institutes when the question of restructuring of courses of studies or of revision of the syllabii of papers is considered by the Committee, and such experts shall be nominated by the Committee with the approval of the Vice-Chancellor 5. The meetings of the Committee may be convened by the Head of the Department at any time and shall be convened by him on receipt of the requisition signed by not less than three members. (d) (e) Regulation—Conte. of Courses & Stds. 695 6. All notices stating the time and place of the meeting along with agenda pepers shall be issued not less than three days before the date of the meeting. 7. The quorum for the meeting shall be one-third of the members of the Committee. But if a meeting is adjourned for want of quorum, for the adjourned meeting, no quorum shall be necessary.. B. t. There shall be a Committee of Courses and Studies consisting of the following for each of the following Departments :— (i) Social Work (ii) Business Management and Industrial Administration. 2. The Committee of Courses and Studies shall consist of the following :— (a) The Head of the Department concerned (ex-officio member and Chairman) (b) Professors if any (ex-officio members) (c) All Readers from the University Department, if the number does not exceed three. (d) One third of the total number of Lecturers in the Univer- sity Department or four Lecturers of the Department whichever is less, by rotation, in order of seniority. S. Members of the Committee other than ex-officio members shall hold office for a term of two years. 4. (ii) Economics (iii) History (2) The Committee of Courses and Studies for the Honours. Post• Graduate and Research Studies shall consist of the following: — (a) The Head of the Department concerned (ex-officio mem- ber and Chairman, (b) All Professors in the Department concerned (ex-officio members). One-third of the total number of Readers in the Depart- ment or four Readers, whichever is more, by rotation in order of seniority. (d) Two Lecturers from the University Department or the total number of Lectures which ever is less, by rotation in order of seniority. Four lecturers from the Colleges, associated with the teaching of post-geaduate and or honours courses, two of whom will be chosen by rotation on the basis of seniority from among those teachers in all colleges who have put in not less than so years' service and the remaining two will be chosen by rotation on the basis of seniority from amongst those teachers in all the colleges who have put in less than to years' service, provided that not more than one of the teachers from both the categories belongs to one and the same College : Provided, however, that in the case of a Department where instruction in any of the subjects assigned to it is exclusively provided in the Department itself and not in any of the Colleges, the number of Lecturers from the Department wider category (d) above may be increased up to a maximum of 8 : Provided further that in the case of a Department where the number of Lecturers is less than two, the Department shall have the option to include that number of additional Readers under category (c) or additional Lectures from Colleges under category (e) equivalent to the short-fall in the number of Lecturers under category (d): Provided, however that in a University Department wach has Peofessors, Readers and Lecturers as will as a large number of Lecturers in the Colleges, and which still chooses to have only one Committee of Courses and Studies for Under-graduate (other than Honours), Honours, Post-gra- duate and Research Studies, the Department shall have the option to include eight Lecturers under category (e). (3) The Committee of Courses and Studies for the Under-graduate Studies (excluding Honours) shall consist of the following :— (a) The number of members shall not exceed to. The exact number for each Department will be decided by the (c) (e) Regulations—Conte. of Courses & Stds. 697 Faculty concerned on the basis of the requirements of the subject concerned and the strength of the Department. (b) The Head of the Department in the subject concerned shall be an ex-officio member and the Chairman of the Committee. (c) Two-teachers from the University Department concerned and the rest, from amongst the teachers associated with the teaching. The two teachers from the University Department concerned shall be members of the Committee by rotation on the basis of seniority. The rest of the mem- bers shall be chosen from amongst the teachers who are associated with the teaching by rotation on the basis of seniority in all the Colleges provided that not more than one teacher shall be from one and the same College : Provided that if the total number of members of the Com- mittee of Courses and Studies is less than to, teachers from different categories will constitute the Committee proporti- onately according to the principles enunciated above. The provisions under Clauses (3) to (7) under Section 'A' of Part I of these Regulations regarding the term of office, the power to invite one or two experts to the meetings of the Committee, the quorum, issue of notice and agenda etc., shall mut atis mutandis apply in respect of these Committees of Courses and Studies under Section 'C' of Part II above COMMITTEES OF COURSES AND STUDIES IN THE FACULTY OF TECHNOLOGY Regulations Regarding Constitution and Meetings 22. 1. There shall be a Committee of Courses and Studies separately for Electrical Engineering, Mechanical Engineering, Civil Engineering, Chemical Engineering, Textile Technology and Architecture. 2. Each Committee of Courses and Studies shall consist of the following members: (i) Sell:or-most Professor in the Department—ex-officio member and Chairman. In the absence of a Professor, the Senior-most Asstt. Professor/Reader shall be the ex-officio member and Chairman. (ii) Six persons to be appointed by the Faculty of Technology, at least four of whom shall be teachers in the subject. 3. The Committee shall have the power to co-opt not more than two members. 4. The meetings of the Committee of Courses and Studies maybe convened at his own discretion by the Chairman at any time. Alternatively, meetings shall be convened by the Chairman on receipt of a requisition signed by not less than three members. All notices stating the time and the place of the meeting alongwith the Agenda papers shall be issued by the Registrar not less than three days previous to each meeting of the Committee. • Regulations—Conte. of Courses & Stde. 5. Members of the Committee other than ex-officio members shall hold office for one year. Four members of the Committee of Courses and Studies shall form a quorum. COMMITTEES OF COURSES AND STUDIES IN THE FACULTY OF MUSIC AND FINE ARTS Regulations Regarding Constitution and Meetings 23. t. There shall be a Committee of Courses and Studies for Under graduate, Honours, Post-graduate and Research Studies for the Depart- ment of Music. The Committee of Courses and Studies shall consist of the following : (a) Head of the Department (ex-officio member & Chairman). (b) All Professors in the Department (ex-officio members) (e) One-third 01 the total number of Readers in the Depaitment or four Readers, whichever is more, by rotation in order of seniority. (d) Two Lecturers from the University Department or the actual number of Lecturers, whichever is less, by rotation in order of seniority. (e) Six Lecturers from the Colleges, associated with teaching of Post—graduate and or Honours Courses, three of whom shall be chosen by rotation on the basis of seniority from among those teachers in all colleges who have put in not lets than to years' service and the remaining three shall be chosen by rotation on the basis of seniority from amongst those teachers in all Colleges who have put in less than to years' service, provided that not more than one of the teachers from both the categories belongs to one and the same College : Provided, however, that in the case of a Department where instruction in any of the subjects assigned to it is exclusively provided in the Department itself and not in any of the Colleges, the number of Lecturers from the Department under category (b) above be increased up to a maximum of 6 : Provided further that in the case of a Department where the number of Lecturers in less than two, the Department shall have the option to include that number of additional Readers under categor (c) or additional Lecturers from Colleges under cate- gory (e) y equivalent to the short-fall in the number of Lecturers under category (d) : Provided further that in a University Department which has Professors, Readers, and Lecturers as well as a large number of Lecturers in the Colleges, and which still chooses to have only one Committee of Courses and Studies for Under-grad other than Honours), Honours, Post-graduate and Research Studies, the Department shall have the option to include eight Lecturers under category (e). (3) (a) Members of the Committee other than ex-officio members shall hold office for a term of two years. (b) In respect of the category of teachers who have put in less than t o years' service and have become members under (e) above, the membership will continue for the full term of two years irrespective of whether or not they complete to years' of service during the course of the term of two years. (4) The Committee shall have the power to invite to its meetings one or two experts from other Universities/Research Institutes when the question of restructuring of courses of studies or revision of the syllabii of papers is considered by the Committee, and such experts shall be nomina- ted by the Committee with the approval of the Vice-Chancellor. (5) The meetings of the Committees may be convened by the Head of the Department at and time any shall be convened by him on reeeipt of the requisition signed by not less than three members. (6) All notices stating the time and place of the meeting along with the agenda papers shall be issued not less than three days before the date of the meeting. (7) The quorum for the meeting shall be one-third members of the Committee. But if a meeting is adjourned for want of quorum, for the adjourned meetings, no quorum will be necessary. The provisions under Clause (3) to (7) under Section A-7 Part I regarding the term of office, the power to invite one or two experts to the meetings of the Committee, the quorum, notice and agenda etc. shall mutatis mutandis apply in to this Committee of Courses and Studies under General : Applicabte to all the Facutties (I) A Department may identify within its scope of studies more than one discipline (or branch) and choose to have one or for Committees of Couses and Studies in each of these disciplines or branches) along the lines indicated in the provisions above. If more than one discipline is identified by a Department the I Department concerned shall also determine to which discipline or disciplines (branch or branches) each member of that Department belongs and constitute the Committee or Committees of Courses and Studies in each discipline (or branch) from out of only those members who are treated as belonging to that discipline (or branch). (2) Wherever there is provision for including additional Lecturers from Colleges on the Committees of Coures and Studies under the second Proviso of their composition, the of number teachers taken from amongst those who have put in to years' and those who have put in less than to years' service shall be proportionately increased. Clarification in respect of the following terms used in the Regulations regarding Constitution and Meetings of Committees of Courses and Stu- dies in the Faculties of Arts, Social Sciences, Science, Mathematical, Sciences and Music and Fine Arts. (i) The term 'Colleges' means the constituent and affiliated colleges of the University of Delhi. Regulations—Conte. of Courses & Stds. 699 boo Regulations—Conte. of Courses of Stds. (ii) The term 'Readers' will also include the Readers wanking in the Institute of Post-Graduate (Evening) Studies. (iii) The category Lecturers from the Colleges' also includes Principals of Colleges for the purpose of their representation. (iv) The terms "not less than to years' service" and "less than to years' service", meants the service rendered by a teacher in Delhi University or in a constituent/affiliated College of Delhi University. COMMITTEES OF MA O THEMATICAL OF CURSES AND STU SCDIENCES IES IN THE FACULTY Regulations Regarding Constitution and Meetings There shall be a Committee of Courses and Studies for each of the following Departments, for Honours, Postgraduate and Research Studies. 1. Mathematics 2. Statistics 3. Operational Research. The Committee of Courses and Studies shall be constituted as follows. Department of Mathematics (a) Head of the Department ( a-officio member & Chairman). (b) Two Professors in the Department, according to seniority by rotation. (c) Three Readers from the University Department, according to seniority by rotation. (d) Two Lecturers from the University Department, according to seniority by rotation. (e) Three Lecturers from the Colleges associated with the teaching of Post-graduate and/or Honours Courses by rotation on the basis of seniority from among those teachers in all the colleges provided that not more than one teacher shall be from one and the college. (f) One student who has secured the highest percentage of marks in the last Honours Examination of this University in the subject concerned and has joined the Master's course in the same subject. (g) One student who has secured the highest perrentage of marks in the first year examination of Master's Course and one student who after securing the highest percentage of marks in the last two years in the Master examination of this University has joined Ph.D. Course as a full time student. Department of Statistics (a) Head of the Department ( a-officio member & Chairman). Regulation—Conte. of Courses & Stds. 701 (b) One Professor in the Department, according to seniority by rotation. (c) Two Readers from the University Department, according to seniority by rotation. (d) Two lexturers from the University Department, according to seniority by rotation. (e) Two lecturers in the subject from the Colleges associated with the teaching of Post-graduate and or Honours Courses by rotation on the basis of seniority from among those teachers in all the colleges, provided that not more than one teacher shall be from one and the same college. One student who has secured the highest percentage of marks in the last Honours examination of this University in the subject concerned and has joined the Master's Course in the same subject. One student who has secured the highest percentage of marks in the first year examination of Master's course and one student who after securing the highest percentage of marks in the last two years in the Master examination of this University has joined Ph.D. Course as a full time student. Department of Operational Research Head of the Department (ex-officio member & Chairman). One Professor rotation; (c) Two Readers from the University Department, according to seniority by rotation. Two leturers from the according to seniority; One student who has secured the highest percentage of marks in the first year examination of Master's Course and one student who after securing the highest percentage of marks in the last two years in the master examination of this University has joined Ph.D. Course as a full time student. Note : There will be no student representative from the Honours examination since there is no provision for an Honours course in operational Research. 1. In case the requisite number of teachers of a particular category is not available, the teachers may be taken from other categories. 2. Members of the Committee other than ex-officio member shall held office for a term of two years, except in the case of the students where the membership shall be only for one year. (g) (a) (b) in the Department, according to seniority by (d) (e) University Department, by rotation 702 Regulations—Conte. of Courses & Stds. 3. The tenure of the Committee shall begin from ist of October, 4. The meetings of the Committee may be convened by the Head of the Department at any time and shall be convened by him on receipt of the requisition signed by not less than 1/3rd of the total number of members of the committee. All notices stating the time and place of the meeting alongwith the agenda papers shall be issued not less than 3 days before the date of the meeting. The quorum of the meeting shall be 1/3rd of the number of members of the Committee but if a meeting is adjourned for want of quorum, for the adjourned meeting no quorum shall be necessary. 5. The participation of the student members will not be permissible in matters relating to appointment of paper-setters and examiners or in matters which are confidential in nature. COMMITTEE OF COURSES AND STUDIES IN THE FACULTY OF MANAGEMENT STUDIES Regulations Regarding Constitution and Meetings T. The Committee of Courses and Studies shall consist of the following : (a) Head of the Department (ex-officio member and Chairman). (b) All Professors in the Department (ex-officio members). (c) Not less than five and not more than seven members (exclusive of Co-opted members) of whom at least one should be Reader and one Lecturer in the subject to be appointed by the Faculty of Management Studies. 2. The Committee of Courses and Studies shall have the power to co-opt not more than two members. 3. Meetings of the Committee of Courses may be convened by the Head of the Department at any time and shall be convened by him on receipt of th: requisition signed by not less than three members. All notices stating time and place of the meeting along withthe Agenda papers shall be issued not less than three days before the date of the meeting. 4. Members of the Committee (other than ex-officio members) shall hold office for three years. 5. The quorum shall consist of three members. But if a meeting is adjourned for want of a quorum, for the adjourned meeting no quourum shall be necessary. Regulation—Conte. of Courses & Stds. 703 COMMITTEE OF COURSES AND STUDIES IN THE FACULY OF AYURVEDIC & UNANI MEDICINES Regulations Regarding Constitution and Meetings (t) There shall be a Committee of Courses & Studies in each of the Departments established in the Faculty of Ayurvedic and Unani Medicine. (2) Each Committee of Courses and Studies shall consist of the following members: (a) Head of the Department—Ex-officio member and Chairman (b) All recognised Professors in the Department—Ex-officio members. (c) Four Readers in the Department in order of combined seniority. (d) One Teacher from each of the following group of disciplines to be appointed by rotation on the basis of the combined seniority by the Faculty of Ayurvedic and Unani Medicines to represent different disciplines comprising the Department. COMMITTEES OF COURSES STUDIES IN THE FACULTY OF INTER-DISCIPLINARY AND APPLIED SCIENCES Regulations Regarding Constitution and Meetings Each Committee of Courses and Studies, shall consist of the following :— (a) The Head of the Deptt. concerned (ex-officio member). (b) All Pofessors in the Department concerned (ex-officio members). (c) One third of the total number of Readers in the Department or four Readers, whichever is more, by rotation in order of seniority. (d) Two Lecturers from the University Department or the actual number of Lecturers, whichever is less, by rotation in order of seniority. (e) Teachers from the Colleges affiliated to the Delhi University whose number will be calculated on the basis of 3/7th of the total number of members under Clauses (b), (c) and (d) above fraction of half and above would be counted as one and less than half will not be considered. Such teachers should be associated with the teaching of Post-graduate and/or Honours Courses inthe subject. The teachers will become members by rotation according to combined seniority of all the teachers in the subject in the Colleges concerned. Provided that in case of a Department where the number of Lecturers is less than two, the Department shall have the option to increase the number of Readers to that extent as members. But not more than one shall be from one and the same college. However one and the same person can be a member of more than one Committee of Courses and Studies at a time by rotation on the basis of seniority. 704 Regu'ation—Conte. of Courses & Stds. (f) One student who after securing the highest percentage of marks in the last Hons. Examination of this University in the subject con- cerned has joined as a regular student in the Master's Course in the same subject. (g) One student of the final year of the Master's Course who after having secured the highest percentcge of marks in the Ist year Examina- tion of the Master's Course continues as a regular student in the final year. (h) One student who after securing the highest percentage of marks from among the students who had passed the Master's Examination in the subject concerned in the last two years of the University and had joined the Ph.D./M.Phil. Course as a full-time student. The members under Clauses (c), (d) and (e) will hold office for a period of two years. The members under clauses (f), (g) and (h) will held office for a period of one year. Provided further they will continue to be members of Committee of Courses and Studies so long as they continue to be regular student of the class concerned of the University. Notwithstanding anything contained in the above regulations, a student shall not be entitled to be a member of the Committee of Courses and. Studies if : (i) He/She has been convicted of a criminal offence involving moral turpitude or punished by the University/College for an act coercive in nature and constituting a threat to life and property; (ii) He/She has been found guilty of, and punished for, the use of unfair means in any of the examinations of a College, University or Board. If a student is otherwise eligible to be the member of the Committee of Courses and Studies but is disqualified by reason of the provisions of clauses(i) and (ii) above his/her place shall be taken by the student who is next below him/her in the order of merit in the respective Committee of Courses and Studies. A student shall cease to be a member of the Committee of Courses and Studies when he she ceases to be a regular student of the University. [It may be noted that temporarily the Faculty consists of small Depart- ments where the number of teachers are less, therefore, outside teachers gexperts have also been made members of the Committee of Courses of different departments.] Regulations—Eaminations—Exam. Committees 705 EXAMINATIONS Examination Committees and Tabulation of Results The Controller of Examinations shall issue instructions to examiners with regard to the maintenance of secrecy and any other matters incidental thereto. 2. Examiners shall send their papers to the Controller of Examina- tions in sealed covers before a date (normally three months before the date of the examination) to be notified on their appointment by the Controller of Examinations under instructions of the Academic Council. Whenever two or more papers are set in any subject in an escaminadoa for a degree, the examiners in those papers may, or. if so directed by the Academic ouncil, shall consult one another in the setting of their papers. The appointment of and examiner shall be deemed to be cancelled if he fails to send in the question paper by the date fixed in this behalf provided that the Vice-Chancellor may for sufficient cause extend the period. 3. Examiners shall submit the results to the Controller of Exami- nations in sealed covers before a date fixed by the Academic Council. The Controller of Examinations shall report each year to the Executive Council all cases of late transmission of results by examiners. 4. The Controller of Examinations shall have the results tabulated separately for each subject. 5. Each Examination Committee/Board shall if called upon submit a report of its operations to the Academic Council. 6. (i) For the examinations where boards of examiners are constituted for the purpose of setting question papers and examining the scripts, moderation of question papers as also the moderation of results should he done by the board of examiners and no separate board of moderators should be appointed. (ii) As regards those subjects for which there are no Boar is of Examiners, a Board of Moderators should be appointed for moderating the question papers as also results. There should he one Board of Moderators for question papers as also for results for the Post-Graduate examinations and another for Honours examinations in each subject. The two boards, one for Post-graduate examinations and the other for Honours examinations in a subject may be one and the same wherever it is feasible to do so. Each Board of Moderators will consist of the followsing : t. The Head of the Department concerned. 2. Two more persons nominated by the Vice-Chancellor from amongst the examiners in the subject concerned. (iii) Board of Moderators for examinations pertaining to Under-graduate Courses : There will be a separate Board of Moderators for question papers in each subject and this Board will consist of : 1. The Head of the Department concerned. 2. Two persons nominated by the Vice-Chancellor from amongst the examiners in the subject concerned. (iv) Board of Moderators for Examination Results As regards the under-graduate examinations, there should be one Board fm each subject and this Board will consist of :— I. The Head of the Department concerned. 2. Two persons nominated by the Vice-Chancellor f'rom amongst the examiners in the subject concerned. (v) There should be another Committee to moderate the results in all subject's for a particular undergraduate degree. This should consist of the Deans and the Heads of the Departments concerned. (vi) In the event of a particular member (including the Head of the Department) not being able to attend the meeting of the Board of Moderators, he/she will inform the Vice-Chancellor in. advance and the latter may appoint another person in his/her place as a member of the Board. (vii) The boards of moderators of examination results will have the same discretionary powers as are enjoyed by these boards in the present set-up. Tabulation of Results/Marks 2. I. The examiners' awards as shown in the result statements submitted by them shall be final unless and until they are revised by the examiners themselves : and the tabulation of results sL,all be based on such statements. 2. Reference may not be made by the Tabulator or the Scrutineer to the marks shown in the answer-books. 3. In doubtful cases or when a candidate makes an application for rechecking examination results on payment of the prescribed fee, reference shall be made to the atswer-hooks and the total re-checked. 4. The answer-books shall Le preserved and be in the custody of the Registrar till the expiry of three months from the publication of the results, after which date no application for re-checking of results stall be entertained. (a)—Hand Tabulation : Tabulation of each examination result will be done by two Tabu- lators independently and the final results compiled ufter comparison and checking of the two tabulated result statements by the Tabulators. Each result statement will then be scrutinized by two Scrutineers indepen- dently. Regulations—Exams.—Rechekit1g of Exam. Results Supply of Marks 7o7 The results of the examination processed on Computer will be checked by two Tabulators independently and final results compiled after comparison of the two result statements. Each result statement will then be scrutinized by two Scrutineers, independently. (c) The Tabulators and Scrutineers for the purpose will be appointed by the Vice Chancellor. 6. Remuneration pn. able to the Tabulators and Scrutineers shad be as under :— For hand tabulation of results : Rupees 25/- per hundred candidates and for results processed on Computer—Rupees 12/50 per hundred candidates, to each Tabulator. (ii) For scrutiny of result statements—Rs. 100/- per thousand candidates (total amount to be divided equally between the two Set winters). (iii) For processing of results at the Computer—Rupees 24,/- per hundred candidates (total amount to be divided proportionately according to the nature and volume of work put in by each person, amongst the staff engaged for processing of the results at the Computer Centre, on the recommendations of the Secretary, Computer Centre). Fee for Re-Checking Examination Results 3. t A tee of Rs 5/- shall be payable by a candidate who wants to get his results re-checked in any subject of examination subject to a maximum of Rs. 20/-: Provided that the fee shall be refundable to the candidate if, on re-checking the results, any error or omission is discovered in respect of the marks originally awarded by the examiner concerned or in the record of results prepared by the University. Fee for the Supply of marks 4. t. The following fees shall be payable for supply of marks for a particular examination (i) For marks in one subject only of an examina- tion (with details where possible, e.g., Practi- or One paper in case of Honours, MA., M.Sc. and Law Examinations ... Rs. 3 OT Aggregate only for the whole examination ... Rs. 5 (ii) For marks in all papers or subjects .. Rs. 5 (i) Note :—In case of Honours Course examinations, the examination in the Main and the Subsidiary subjects will be treated as separate examinations for the purpose of supply of marks. (From 1956 and onwards) 2. (i) Every candidate for the University Examinations other than the Examination in Subsidiary subjects for the Hons. Courses and Qu-tlifying Test for B.Sc. (General) or the Certificate Examinations shall pay a "Marks Fee" of Rs. 5/- alongwith the Examination Fee, The detailed marks obtained by each candidate at the Examination shall, shortly after the publication of the results, be sent to the candinates through the Principal of the College, Institution or Department concerned. In the case of ex- students, teachers and non-collegiate women candidates, the marks shall be sent by the Controller of Examinations. (ii) In the case of candidates for the Subsidiary Subjects for Hons., Qualifying Tests, Certificate Course Examinations, etc., the marks shall be supplied on individual applica- tion on payment of the fee of Rs. 5 per candidate. Duplicate copies of statements of marks may on payment of a fee of Rs. 5/- per statement. Thirty only) per paper. In . case of upward revision as a results of re-valuation in any paper, 50% of the revaluation fee paid for that paper will be refunded. No refund will, however, be made, if the award in a paper did not change or was less than the original award. 6. Fees for Issuing Migration, Provisional and Other Certificates t. Fee for issuing Migration/Provisional or any other Certificate or for duplicate copies thereof. Rs. 15/- 2. A fee of Rs, 10/- shall be payable by a student or other candidate, who wishes to add or alter his name as originally recorded in the University Register and any such change shall he added to his origi- nal name as alias in the University Enrolment Register only. 3 A fee of Rs. 10/- shall be sayable by a student or other candidate who applies for an alteration of the record of his date of birth as entered in the University Registers. 4. A duplicate copy of the degree, diploma or certificate may be issued on application by the candidate on the grounds that either the Regulations--Examinations—N.C.C. etc. original ogrede defaced or certificate has been irrecoverably lost or destroyed and on payment of the fees prescribed under clause. I.- Provided that in very special cases subsequent copies of the degree, diploma or certificate may be issued for not more than four times, on submission of an affidavit signed and certified by a First Class Magistrate to the effect that the degree, diploma or certificate imsud perviously by the University has been lost or destroyed, and on payment of the same fees as are prescribed for the issue of duplicate copy. ADVISORY BOARD OF WOMEN'S (NON-COLLEGIATE) EDUCATION g. 1. One of the members of the th B e Sec oard shall be all e a bppointed e for by the Vice-Chancellor as its Secretary and the Board's detailed work. The Secretary shall be responsible to the Board for the approval of courses of instruction in individual cases. The Secretary shall be responsible for keeping proper accounts of the income and expenditure of the Board and accounts shall be submitted to the Executive Council every year for audit. The Board shall submit a report of its work including a state- ment as to the financial requirements of the Board during the succeeding twelve months to the Executive Council every year and the Executive Council shall make such grants to the Board as the Council may deem necessary. 5. Fees payable by non-collegiate women students shall the be collected by the Registrar and shall form part of the general funds of University. Applications for enrolment as non-collegiate women students; of the University shall be made to the Registrar, in such form as the Beard may prescribe, who shall forward the applications to the Secretary of the Board for consideration and record. The regulations relating to the dates of registration of students by the colleges shall apply mutatis mutandis to the enrolment of non-collegiate women students . But in exceptional cases, the Vice-Chancellor in his discretion may permit applications to be registered by September to. The Board shall keep a register of non-collegiate women tutors who have been recognised by the University on the recommenda tion of the Academic Council. g. Note: The term "his College'' in this Ordinance means the College last attended by the student. TEACHERS lit. Subject to provisions of Ordinance VII applications of teachers for enrolment and for permission to appear at an examination should reach the University Office on or before the 16th July of the academic year in which the examination is to be held. The last date for receipt of application for admission to an examination shall be the same as for the students in the Colleges: Provided that an application for such enrolment and for permission to appear at an examination may be entertained in a special case at the discretion of the Controller of Examinations after the expiry of the above date upto ist August of the academic year in which the examination is to be held on payment of a penalty of Rs. 5/. DIRECTIONS TO CANDIDATES FOR EXAMINATIONS The Examination Hall shall be opened each, day at least ten minutes before the time specified for the distribution of question paper and all candidates must be in a Hall by the time specified. No candidate who is late by snore than half an hour shall be admitted to the Examination; 716 Regulations—Exams.--Directions to candidates and no candidate must leave the Hall during first half an hour. When a candidate leaves the hall he must before doing so, give up his papers and he shall on no account be readmitted. No extension of time shall be granted to a candidate on the ground of late arrival. Each candidate must show on demand his Admission Ticket bearing his Roll Number for admission to the Examination Hall. 2 No candidate is permitted to leave the room until the expiry of half an hour after the contrunencement of the examination. 3. A seat with a number will be allotted to each candidate Candi- dates must find out and occupy their allotted seats. 4. The order in which the candidates are seated will be forwarded to the examiners. 5. No candidate, without the special permission of the Superin- tendent or the Invigilator concerned, is to leave his seat or the examination room until he finishes his paper. Candidates should not leave the Hall without handing over their answer-books to the Invigilator on duty. 6. Each candidate will write on the outside of his answer-book his Roll No. before beginning his answers. When the time allowed has expired, the answer-book must be surrendered even thoughthe candidate may not have answered any part of the question paper. 7. All candidates are required to bring their own pens and ink. Wherever required, candidates should bring their own foot ruels, scales, set squares or other instruments for use during the examination. Answers should be written in the answer-book supplied to the candidateon both sides of the paper. No candidate shall tear a leaf or a part of it from an answer-book or from a continuation sheet. Blotting paper will be supplied, on demand. 8. Smoking in the Examination Hall during examination hours is strictly prohibited. 12. Tea, coffee, cold drinks or snacks are not allowed to be taken into examination rooms during examination hours. 13. Attention of the candidates is specifically invited to Ordinances 7 17 Regulations—Exams.—Directions to Superintendents DIRECTIONS TO SUPERINTENDENTS OF EXAMINATIONS 13. 1. The Executive Council shall appoint Superintendents who will be responsible for the proper conduct of the examinations. In case of sudden illness or other emergency, the Vice-Chancellor or the Rector or in the absence of the latter, the Controller of Examinations shall appoint a Superintendent. 2. The Superintendent will see that the doors of the Examination Hall open half an hour before the time specified for the distribution -of the question-paper on the first day and quarter of an hour before on sub- sequent days. 3. The Superintendentwill be supplied by the Controller of Exami- nations before the commencement of the examination with the list showing the names of candidates who will appear at his centre of examination and the optional subjects taken up by them and a statement showing the number of candidates appearing in each subject of examination. 4. The Superintendent shall not admit any candidate whose name is not shown in the list or allow any candidate to take an optional subject other than that shown against his name: Provided that in doubtful cases the Superintendent may allow any candidate to take the paper and immediately refer the matter to the Controller of Examination-. He may require any candidate to show his Roll Number. 5. The question-paper set for the examination shall be despatched by the Controller of Examinations in a scaled cover which shall be opened by the Superintendent in the presence of at least one invigilator. The Superintendent and the invigilator (or invigilators) shall certify that the sealed cover was in proper condition and that it was openeti- in the Examination Hall at the proper time. The certificate shall be forwarded to the Controller of Examinations on the same day. 6. Before the commencement of the examination the Superintendent shall see to the satisfactory arrangement of examination tables and seatsi He shall take care to place the candidates so as to render all communica- tions between them impossible. Candidates must be seated well apart to prevent collusion. 7. A card giving the Roll Number of each candidate shall be fixed on each table so that the candidate may readily find out his place. After the conclusion of the examination, a plan of the examination room showing the position of each candidate relative to others, shall be sent to 'every Examiner and a copy of the same to the Controller of Examinations. - 8. Blank books for answers will be supplied from the Controller of Examinations office. An invigilator should report himself on duty to the Superinten- dent half an hour before the commencement of the exemination on the first day and fifteen minutes before on subsequent days. They shall also help the Superintdenent in arranging the answer-books for despatch. 4. The invigilators will help the Superintendent in preparing a list of the candidates present at the examination and in veryfying their identity by comparing their signatures with those on the Admission Tickets. 5. During the course of examination the invigilators are expected to move about the place and not to engage themselves in study or conversation. 6. If any candidate is found to resort to unfair means at the exandna- tion or to create disturbance or act in any manner so as to cause inconve- nience to the other candidates, the invigilator should at OTIce report the matter to the Superintendent. 7. The invigilators should also bring to the notice of the Superin- tendent any camplaints or other difficulties pointed out by any candidate regarding the question-paper set for the examination. 8. InVigilators are expected to help the SuperintIndent in an other matter connected with the conduct of the examinaton. y g. In case an Invigilator is unable to be present on account of unavoidable circumstances, he shall give at Icast 24 hours notice to the Superintendent. z5. Change of Date of Birth Date of birth as entered in the University Register of students shall not be altered except (a) on the Registrar being satisfied that there has been a clerical error in either a College office or tie University office, or (b) on the Registrar receiving information from the Inspector of Schools concerned that he has ordered an alteration in the School Register from which the date of birth as entered in the University Register was originally taken: Provided that the Executive Council may, On a reference by the Registrar and after consideration of such documentary evidence as may be produced in any case, direct an alteration to be made in the record of the University Register of students. CONVOCATION 1. A Convocation for the purpose of conferring degrees shall be held annually at Delhi on such date as the Chancellor may fix. 2. The Academic Council shall, from time to time, determine as to the degrees which may be conferred on graduates in person and the degrees to be conferred in absentia, at the Convocation: Provided that the Vice-Chancellor may confer a degree in advance of the Annual Convocation on students proceeding to Universities abroad for further studies. 3. The Diplomas and Degrees shall be signed by the Registrar and shall bear the printed signature of the Vice-Chancellor. 4. The Academic Council shall, from time to time, determine the procedure to be followed at the Convocation. 5. Special Convocations for conferring degrees or for other purposes may be held on such dates and on such -times as the Chancellor on the recommendation of the Academic Council. may fix. Candidates who are unable to attend the Convocation must inform the Registrar before hand. Such candidates will be admitted to the degree in absentip in accordance with the rules prescribed from time to time. 4. Candidates for degrees shall be presented by the Principal of the College at which they have studied, or, by the Registrar if they are teachers or non-collegiate women candidates in a manner decided by the Academic Council from time to time as follows: "Sir, I present to you the whose names are set out in the list, and who have been examined and found qualified for the Degree of —to which I pray that they may be admitted." The undermentioned categories of persons shall be entitled to borrow the specified number of volumes from the library for the periods mentioned against each. (viii) Outsiders engaged in research or higher studies under special permission of the University Librarian on payment of Rs. 50/- as library security and an annual subscription of Rs. 12/- for period beginning ist April and ending 31st March of the following year. Teachers, Research Students and Post-Graduate Master's Degree Students in the Departments of Economics, Commerce, Sociology, Geo- graphy and Faculty of Management Studies will be enrolled as members of the Delhi University Library System through Ratan Tata Library. Teachers and students in the Faculty of Law will be enrolled as members of the Delhi University Library System through the Faculty of Law Library. Undergraduate students in the Colleges will be extended book lending facilities front the Zonal Libraries at Shandara, Greater Kailash and Vishal Enclave. How to become Member— Application forms arc available on request from the respective libraries. Regulations—Use of Library 725 Applicants are required to produce an introduction from the Principal of the College or Head of the Deparment concerned. The completed application form should be deposited with the library staff at the membership counter. If the application form is satisfactorily completed the applicant will be given a date and time for the collection of membership tickets. Members should keep the library informed of any change of address, change of college, class or subject of study during the period of their membership. Renewal of Membership Membership must be renewed on or before the date of expiry. For purpose of renewal, the member will be required to produce all the tickets at the library counter. Library membership not renewed on or before the date of expiry lapses automatically. Library Security Deposit Library security deposit or any other special deposit with the University or the University Library is refundable on claim within two years of the date of expiry of membership of the library beyond which the money lapses to the University. Conditions of Loan Library tickets are not transferable as they are tokens of privilege which only the member to whom they are issued is entitled to. Sub-lend- ing of books is misuse of this privilege and may lead to the withdrawal of membership. Manuscripts, reference books, rare books, theses, dissertations, periodicals (loose numbers and bound volumes) and such other reading materials as are marked for consultation within the library shall not be issued out for loan except with the special permission of the University Librarian. Borrowers must statisfy themselves about the physical condi- tion of the books before borrowing; otherwise, they will be held responsi- ble for any damage or mutilation noticed later or at the time of returning. Penalties for books lost, damaged, mutilated or defaced by marking shall be fixed by the University Librarian. Defaulters may be suspended from the use of the library by the University Librarian pending the discharge of their liabilities. Books on loan with members can be recalled by the University Librarian at any time. Loan of books is not renewable. Rules for the use of Text Book Collections (i) Text Book Collections comprise reading materials covering prescribed readings, recommended readings, allied and relational 726 Regulations—Use of Library readings and such other books as may be considered important for placement alongwith such collections. (iv) For borrowing Text Books, only the ticket marked 'Text Book' shall be used. (v) Reservation of Text Books is done to ensure equitable use of such books as are less in number but much in demand. (vi) Overdue charge for keeping the Text Book overtime are 25 paisa per day per volume for the first two days and 5o paisa per day per volume, thereafter (AC Res. dated 31-1-1976 and EC Res. dated 3-2-1976). Issue System On each occasion the hook is borrowed a reader's ticket is to be given at the library counter and the Identity Card/Membership Card shown. The ticket will be returned to the member only when the book is returned. Reservation for books which are not on the library shelves can be made by teachers and research students on prescribed reservation cards available at the reference desk. The library will inform the member as soon as the book is available. Overdue Charges . The member is expected to return borrowed books on or before the due date stamped on the date label in the book. An overdue charge of 1 o paisa per day per volume will be levied for the late return of ordinary books. `Conscience Box' method of collecting overdue charge shall be used in all the units of Delhi University Library System. page service as follows : 3 days -do- 3 days 3 days 3 days 3 days Regulations—Une of Library 727 Members are requested to drop the correct amount into the fine box at the library counter. No receipt is issued for such payments. Care of Books The library books are for the benefit of not only the present but also the future members of the library. They should, therefore, be handled with every care and consideration. Loss of Books and/or Library Tickets The member is responsible for the books borrowed on his/her library tickets. Neither books nor tickets be lent to another person. Loss of library books or tickets must be reported in writing to the University Librarian immediately. Borrowers will be asked to pay for or replace the book lost or returned in a damaged or mutilated condition. When a Reader's Ticket and a Membership Card are lost together, a special deposit of Rs. 50/- will be required from the member, refundable on the expiry of the validity of lost ticket/card . Duplicate tickets will be issued at the discretion of the University Librarian on the payment of Re. IF per ticket. The member, however, will continue to be responsible for any loss that the library may suffer through the loss/misuse of the lost ticket. In case of loss of Property Counter Token a charge of Re IF will be made. Clearance Certificate The library tickets are the property of the library and are to be returned and dues, if any, paid and a Clearance Certificate obtained for them before taking a university examination or terminating connection with the college or the university. No College/Institution/Department of the University shall issue a discharge certificate to any of its student/teacher/ staff member (non-teaching) who is a member of the library without obtaining a Library Dues Clearance Certificate from the library. A research student is required to submit a clearance certificate of the library to the Board of Research Studies before the research work is accepted for examination. Clearance Certificate is not issued to non-members. Open Access and shelf Arrangement The members have the privilege of direct access to the shelves in the stack halls and the freedom to browse among the books during specified hours. It is important that the classified arrangement of books, according to the numbers, is maintained on the shelves for the convenience of the members themselves. 728 Regulations—Uus of Library While books can be freely taken out of the shelves, on no account should they be reshelved by the members because of the danger of mis- placement. Conditions for the use of the research floor (i) Seats will not be allotted to individual research students. A student will occupy any seat available at the time of his visit. (ii) A 'Controlled Stack' of books needed by research students will be set up and maintained on the Research Floor. A viable contingent of library staff will function as the Controller of the 'Controlled Stack'. At the end of the day, the books will have to be brought back to the Controlled Stack as noted above. (iii) No researcher should take books from the stacks to his room with- out getting it properly issued at the research floor counter. (iv) No researcher should lock his research cubicle or the table drawer. (v) Students shall be required to locate and bring to the Research Floor their books from the stacks. However, if book(s) are not traceable, the request should be given at the Research Floor counter staff for acquisition. (vi) When the needed books are not available in the library, the research students will be required to submit lists of unavailable books duly approved by the Head of the Department concerned for purchase by the library. (vii) Books no more needed by researchers will be sent back to the library stacks. On the need again, a book will be brought back upstairs to the controlled research collections on the Research Floor. (vii) Visitors shall not be allowed to the Research Floor. (ix) No teaching work will be conducted on the Research Floor. Photocopying Services (i) The request for reproduction of a document shall be made in a pres- cribed form available from the Photocopying Unit. The form must be duly completed before the job can be undertaken. Photocopies shall be supplied to the bonafide teachers and research scholars and in special cases to post graduate students of the Uni- versity of Delhi, at the rate of (payable in advance in cash): One copy each of legal size paper-40 Paise The term 'legal size paper' of the rule denotes the size of the paper used in the preparation of the photocopy and not thesize of the docu- ment to be photocopied. Normally, a legal size paper accommodates one photocopy of the normal size document. But in case of small size or under-asize documents, a legal size paper may accommodate two or more than two such documents and the rate charged in such cases will be 4o paisa per legal size paper and not per page of the document. (iii) The library normally undertakes to reproduce material required for research and study only. Regulations—Use of Library 729 (iv) All responsibilities for questions pertaining to copyright that may arise due to copying and the use made of copies shall lie with the person making the request. (v) The library shall normally reproduce only such material as is avail- able in its collections which in the opinion of the University Librarian is properly available for duplication. (vi) If a substantial portion of any copyright material is required, prior permission of the copyright owner must be produced by the person concerned. (vii) Photocopies of the unpublished Dissertations/Theses shall not be provided unless permission of the author is produced. (viii) Only one article from one issue of a periodical publication, can be supplied to one person at a time. This restriction is warranted in view of the copyright obligations. (ix) Requests to undertake reproducticmc of certificates, testimonials, forms etc. shall not be accepted. (x) Documents copied by the library are not to be put to any com- mercial use. (xi) The decision of the University Librarian to accept or reject a request for photocopying of any material shall be final. Atmosphere of Study As the University Library is a place of individual study and research, it is necessary to maintain an atmosphere of quiet and dignity inside the library. Members are, therefore, reminded that conversation or consultation among themselves or noisy or demonstrative greetings of friends inside the library is not permissible. Smoking is also not allowed inside the library. Library Hours The library functions for nearly twelve hours or more during the academic session. Library hours are subject to change from time to time and all changes in timings are duly notified on the library notice board. The library is open round the year except on Republic Day, Holi Independence Day and Gandhi Jayanti. 18. LEAVE RULES APPLICABLE TO WHOLE-TIME PERMANENT TEACHERS. PART-A 1. In these rules :— Leave includes "Earned Leave", "Half-Pay Leave", "Commut- (ii) "Earned Leave" means leave earned on the basis of actual service rendered including the vacations, (iii) "Half pay Leave" means earned in respect of completed years of service calcuated according to the rules hereinafter contained. (iv) "Commuted Leave" means leave as provided hereinafter. (i) (v) "Completed years of service" means continuous service of the specified duration under the University and includes periods s ent on dut as well as on deputation with Governm an leave including Exra-Ordinary Leave, unless otherwise ent provi d ded. Note :—(a) Notwithstanding anything contained in these rules, medical leave in respect of teachers in the service of the University on the date immediately preceding that on which these revised rules come into force, will be accounted for separa- tely and granted according to the rules which were immediately previously in force. (b) No leave accumulated before Ist May, 1946, under the leave rules in force prior to that, date, shall be taken save that a member of the staff may be granted two-thirds of such accumulated leave on full pay terminating on the date on which he finally ceases to be a member er of the staff to provided, however, that a teacher may be p mitted utilize the leave so accumulated for study on full pay. 2. Right of Leave Leave cannot be claimed as a matter of right and when the exigen- cies of service so demand, leave of any description may be refused or revoked by the leave sanctioning authority. In case a teacher is recalled to duty before the expiry of his such recall to duty shall be treated as compnlsory in all cases. leave, 3. Earning of Leave Except as otherwise provided in these rules, leave shall be earned by period spent on duty only. 4. Commencement and termination of Leave (i) Leave ordinarily begins from the date on which leave as such is actually availed of and ends on the day preceding on which duty is resumed. (ii) Sunday or other public holidays (except vacations) may be prefixed as well as suffixed to leave. Note :— Teachers are normally expected to be present on the last day of the term and on the opening day of the term after a vacation. How— ever, in exceptional or special circumstances, combination of tions might be allowed any kind of leave except casual leave. vaca- 5- Return to duty on expiry of leave : Except with the permission of the authority which granted the leave, no person on leave may return to duty before the expiry of the period of leave granted to him. 6. Combination of Leave : Except as otherwise provided in these rules, any kind of leave under these rules may be granted in combination with or in continuation of any other kind of leave. 7. Grant of leave beyond the date of retirement and on resignation : No leave shall be granted beyond the date on which a teacher must retire, provided that a teacher may be paid cacti equivalent of leave salary in respect of the period of earned leave at his credit at the time of retirement on superannuation subject to the following conditions The benefit under this rule shall be admissible to a teacher who attains the age of superannuation on or after 30.9.77. (ii) The payment of cash equivalent of leave salary for earned leave shall be limited to 240 days. (iii) In respect of a teacher who retires on attaining the normal age prescribed for retirement under the terms and conditions governing his service, the authority competent to grant leave shall suo-motu issue an order granting cash equivalent of leave salary for earned leave, if any, at the credit of the teacher on the date of his retirement subject to a maximum of 240 days. (iv) The cash payment will be equal to leave salary as admissible for earned leave and dearness allowance admissible on that leave salary at the rates in force on the date of retirement. No city compensatory allowance and/or house rent allowance shall be payable. The cash payment for unutilized earned leave shall with effeet from 31.7.1979 be made in the manner indicated below : Pay admissible on the date of retirement plus missible on that cash payment date. Number of unntilised earned leave at credit on the date of retire- ment subject to maximum of 240 days (i) x (v) A teacher who is re-employed after retirement may, on termi- nation of his re-employment, be granted suo-motu by the authority competent to grant leave, cash equivalent in respect of earned leave at his credit on the date of termination of re- employment, subject to a maximum of 240 days, including the period for which encashment was allowed at the time of retire- ment. (vi) A teacher can also avail of, as leave preparatory to retirement, a part of earned leave at his credit. In that case, he will be allowed benefits of this rule for the earned leave that remains at credit on the date of retirement in accordance with the terms and conditions stipulated in this rule. (vii) The benefit of this rule shall also be admissible to the teachers who attain the age of retirement on or after 30.9.77 and are granted extension of service after that date. In such cases, the benefit shall be granted on the date of final retirement on expiry of extension to the extent of earned leave at credit on the date of superannuation plus the earned leave earned during the period of extension reduced by earned leave availed of du- ring such period, subject to a maximum of 290 days. (viii) A teacher already on leave preparatory to retirement who has been allowed to rf turn to duty shall also be entitled to benefit under this rule on the date of retirement, (ix) Those employees who attained the age of retirement on super— annuation before 30_9.1977 and were on extension of service on or beyond that date will also be entitled to the benefit of cash payment on the date of final retirement on expiry of extension to the extent of earned leave that had been refused to them at the time of retirement and was allowed to be carried forward into period of extension plus leave earned during the period of extension reduced by earned leave availed of during such period subject to a maximum of 240 days. The authority competent to grant leave may withhold whole or part of cash equivalent of earned leave in the case of a teacher who retires from service on attaining the age of retirement while under suspension or while disciplinary or criminal proceedings are pending against him, if in the view of such authority there is a possibility of some money becoming re- coverable from him on conclusion of the proceedings against him. On conclusion of the proceedings, he will become eligible to the amount so withheld after adjustment of University's dues, if any. A teacher who retires from service by giving notice or he is retired by the University by giving notice, on pay and allowances in lieu of such notice, in accordance with the terms and conditions of service may be granted suo motu by the authority competent to grant leave, cash equivalent of the leave salary in respect of earned leave at his credit subject to maximum of 240 days and also in respect of all the half pay leave at his credit provided this period does not exceed the period between the date on which he so retires or is retired from service and the date on which he would have retired in the normal course after attaining the age prescribed for retirement under the terms and conditions governing his service. The cash equiva- lent shall be equal to the leave salary as admissible for earned leave and/or equal to the leave salary as admissible for half pay leave plus dearness allowance admissible on that leave salary for the first 24o days, at the rates in force on the date the University teacher so retires or is retired from service. The pension and pension equivalent of other retirement benefits and ad-hoc relief/graded relief on pension shall be deducted from the leave salary paid for the period of half pay leave, if any, for which the cash equivalent is payable. The amount so calculated shall be paid in one lumpsum as a one-time settlement. No HRA or CCA shall be payable. Provided that if leave salary for the half pay leave component falls short of pension and other pensionary benefits, cash equiva- lent of half pay leave shall not be granted. Provided further that a teacher who is retired by the University by giving him pay and allowances in lieu of notice, cash equiva- lent of leave salary shall be allowed only for the period of leave excluding that period for which any allowances in lieu of notice have been allowed. (a) (i) Where the services of a teacher are terminated by notice or by payment of pay and allowances in lieu of notice or otherwise in accordance with the terms and conditions of his appointment he may be granted suo-motu by the authority competent to grant leave, cash equivalent in respect of earned leave at his credit on the date on which he ceases to be in service subject to a maximum of 240 days. (ii) If a teacher resigns or quits service, he may be granted suo-motu, by the authority competent to grant leave, cash equivalent in respect of earned leave at his credit on the date of cessation of service to the extent of half of such leave at his credit, subject to a maximum of 90 days. 8. Conversion of ane kind of leave into another kind At the request of teacher the sanctioning authority may convert any kind of leave retrospectively into leave of a different kind which was due and admissible to him at the time the leave was granted, but the teacher cannot claim such conver- sion as a matter of right. (ii) The conversion of one kind of leave into another, shall be subject to adjustment of leave salary/ on the basis of leave finally granted to the teacher, that is to say, any amount paid to him in excess shall he recovered or any arrears due to him shall be paid. Note: —Extra Ordinary Leave granted on medical certificate or other- wise may be converted retrospectively into leave not due subject to the provisions of Rule 9 (Leave not due). 9. Rejoining of duty on return. from leave on medical grounds A teacher who has been granted leave on medical certificate will be required to produce a medical certificate of fitness before resu- ming duties in such manner and from such persons as may be prescribed. The authority competent to grant leave may in its discretion, waive the production of a medical certificate in case of an application for leave for a period not exceeding 3 days at a time on medical ground. Such leave shall not, however, be treated as a leave on medical certificate and shall be debited against leave other than leave on medical grounds. 10. Leave should always be applied for and sanctioned before it is taken except in case of emergency and for satisfactory reasons. 11. The leave account shall be maintained for each teacher in the Department/Faculty concerned. The order sanctioning earned leave/half pay leave to a teacher shall thereafter indicate the balance of such leave at his credit. (i) 12. The leave year shall run from 16th July in every year to the 15th July of the following year. 13. Continuous temporary service followed by a permanent service with- out any break shall be included in permanent service for the purpose of computation of leave. 14. The following kinds of leave would be admissible to permanent teachers : (i) Leave treated as duty— Casual Leave, Special Casual Leave and Duty Leave. (ii) Leave earned by Duty :— Earned Leave, Half Pay Leave and Commuted Leave. (iii) Leave not earned by duty :— Extra Ordinary Leave and leave not due. (iv) Leave not debited to leave account— (a) Leave on ground of health: Maternity Leave, and Quaran- tine Leave, Sabbatical Leave (Prescribed separately). The Executive Council may in exceptional cases grant, for the reasons to be recorded, any other kind of leave subject to such terms and conditions as it may deem fit to impose. 2. Casual Leave (i) A whole time teacher of the University shall be eligible for 10 days casual leave each year for domestic and private affairs. Casual Leave not exceeding five days may be availed of by a teacher for 'Academic Work' as hereinafter defined. (ii) Casual Leave cannot be carried over to the next leave year. (iii) Casual Leave cannot be combined with any other kind of leave except when leave is granted on account of sickness supported by medical certificate. (iv) A teacher on casual leave is not treated as absent from duty and his pay is not intermitted. (v) Public Holidays and Sundays falling in between the Casual Leave shall not be counted as part of Casual Leave. 3. Special Casual Leave (i) Special Casual Leave not exceeding ten days in an academic year may be granted to a teacher— (a) to conduct examination of a University, Public Service Commission, Board of Examination or other similar (b) to inspect academic institutions attached to Statutory Boards etc. (c) to participate in literary, scientific or educational confer- ences, symposium, or seminar or cultural or athletic acti- vities conducted by bodies recognized by the University authorities; or (d) to do such other work as may be approved by the Vice- Chancellor as academic work. Note : In computing the ten days leave admissible the days of actual journey, if any to and from the places where such conference activity takes place will be excluded. (ii) In addition, special casual leave to the extent mentioned below may also be granted :— (a) to undergo sterilization operation (Vasectomy or Selpingee- tomy) under Family Planning Programme. Leave in this case will be restricted to six working days: (b) to a female teacher who undergoes non-peruperal sterliza- tion. Leave in this case will be restricted to fourteen days. (c) Special Casual Leave cannot be accumulated nor can it be combined with any other kind of leave. It may be granted in combination with holidays or the vacation. Duty Leave Duty Leave may be granted for :— (a) attending conferences, congresses, symposia and seminars on behalf of the University. (b) Delivering lectures in institutions and Universities at the invitation of such institutions or Universities received by this University and accepted by the Vice-Chancellor. (c) Working in another Indian or Foreign University, any other agency, Institution or organisation when so deputed by the University or for performing any other duty for the University. (d) Working on a delegation or Committee appointed by the Government of India, the University Grants Commission, a sister University or any other Academic Body. (c) Visiting foreign countries under Cultural Exchange & Bilateral Exchange Programme, Indo-US Fellowship, Indo- US Exchange of Scientists Programmes sponsored by the University Grants Commission. (ii) The duration of leave should be such as may be considered necessary by the sanctioning authority on each occasion. (iii) The leave may be granted on full pay provided that if the teacher receives a fellowship or honorarium or any other finan- cial assistance beyond the amount needed for normal expenses, he may be sanctioned duty leave on reduced pay and allow- ances. (iv) Duty Leave may be combined with earned leave, half-pay leave or extra ordinary leave. 5. Earned Leave : Earned leave admissible to a teacher shall be :— (a) I/30th of actual service including vacation plus (b) 1/3rd of the period, if any, during which he is required to perform duty during vacation. Note : (i) For purpose of computation of period of actual service all periods of leave except casual, special casual and duty leave shall be excluded. (ii) Earned Leave at the credit of a teacher shall not be accummu- lated beyond 240 days. The maximum earned leave that may be sanctioned at a time shall not exceed 120 days. Earned Leave exceeding 120 days may, however, be sanctioned in the case of higher study or training or leave on medical certificate or when the entire leave or portion thereof is spent outside India. Provided Earned Leave taken as leave preparatory to retirement can be availed upto a maximum of 240 days However, no permission for private employment except with Public Sector Undertaking or Government of India shall be granted. (iii) Prefixing arid sufficing holidays to leave, other than leave on medical certificate, shall be allowed automatically except in cases where for administrative reasons permission for suffixing/ prefixing holidays to leave is specifically withheld. In the case of leave oa medical certificate, if the day on which a teacher is certified medically fit for rejoining duty happens to be a holi- day, he shall be automatically allowed to suffix such holidays to his medical leave and such day(s) shall not be counted as leave. Note : 1. When a teacher combines vacation with earned leave, the period of vacation shall be reckoned as leave in calculating the maximum amount of leave on average pay which may he included in the particular period of leave. 2. In cases where only a portion of leave is spent outside India, the grant of leave in excess of 120 days shall be subject to the condition that the portion of leave spent in India shall not in the aggregate exceed 120 days. 6. Half Pay Leave : Half Pay Leave admissible to a permanent teacher shall be 20 days for each completed year of service. Such leave may be granted on medical certificate, for private affairs or for academic purposes. Note : A completed year of service means continuous service of specified duration under the University and includes periods spent on duty as well as leave including extra oridinary leave. (i) 7. Commuted Leave : Commuted Leave not exceeding half the amount of half pay leave may be granted on medical certificate to a permanent teacher subject to the following conditions :— (a) When commuted leave is granted, twice the amount of such leave shall be debited against the half-pay leave due. (b) No cummuted leave may he granted under the provision unless the authority competent to sanction leave has reasons to believe that the teacher will return to duty on its expiry. Where a teacher who has been granted commuted leave resigns from service or at his request is permitted to retire voluntarily without returning to duty, the commuted leave shall be treated as half pay leave and the difference between the leave salary in respect of commuted leave and half pay leave shall be recovered. Provided that no such recovery shall be made if the retirement is by reason of ill-health incapacitating the teacher for further service or in the event of his death. Note Commuted Leave may be granted at the request of the teacher even when earned leave is due to him. 8. Extra Ordinary Leave : A permanent teacher may be granted extra ordinary leave (a) When no other leave is admissible ; or (b) When other leave is admissible, the teacher applies in writing for the grant of extra ordinary leave. (ii) Extra Ordinary Leave shall always be without pay and allowances. Extra-Ordinary-Leave shall not count for incre- ment except in the following cases :— (a) Leave taken on medical certificate : (b) Cases where the Vice-Chancellor is satisfied that the leave was taken due to causes beyond the control of the teacher, such as inability to join or rejoin duty due to civil commo- tion or a natural calamity, provided that the teacher has no other kind of leave to his credit. (c) Leave taken for prosecuting higher studies; and (d) Leave granted to accept an invitation to a teaching post or fellowship or research-cum-teaching post or an assignment for technical or academic work of importance. (iii) Extra Ordinary Leave may be combined with any other lea% e except casual leave and special casual leave provided that the total period of continuous absence from duty on leave (including period of vacation when such vacation is taken in conjunction with leave) shall not exceed three years except in cases where leave is taken on medical certificate. The total period of absence from duty shall in no case exceed five years in all during the entire period of service. (c) (i) (iv) The authority empowered to grant leave may commute retro- spectively periods of absence without leave into extra ordinary leave. 9. Leave not due : (i) Leave not due may, at the discretion of the Vice-Chancellor, be granted to a permanent teacher for a period not exceeding 360 days during the entire service,' out of which not more than 90 days at a time and 180 days in all may be otherwise titan on medical certificate. Such leave shall be debited against the half-pay-leave earned by him subsequently. (ii) 'Leave not due' shall not be granted unless the Vice-Chancellor is satisfied that as far as can reasonably be foreseen, the teacher will return to duty on the expiry of the leave and earn the leave granted. (iii) A teacher to whom 'Leave not due' is granted, shall not be permitted to tender his resignation from service so long as the debit balance in his leave account is not wiped off by active service, or he refunds the amount paid to him as pay and allowances for the period not so earned. In a cast where retirement is unavoidable on account of reason of illness incapa- citating that teacher for further service, refund of leave salary for the period of leave still to be earned may be waived by the Executive Council. Provided further that the Executive Council may, in any other exceptional cases waive, for reasons to be recorded, the refund of leave salary for the period of leave still to be earned. 10. Maternity Leave : Maternity leave may be granted to a woman teacher on full pay for a period of 90 days from the date of its commencement. (ii) Maternity leave may also be granted in case of miscarriage, including abortion, subject to the condition that the leave applied for does not exceed six weeks and the application for leave is supported by a medical certificate. (iii) Maternity Leave may be combined with leave of any other kind, except casual leave, but the leave applied for in continuation of maternity leave may be granted only if the application is supported by a medical certificate. (iv) Leave in continuation of maternity leave may also be granted in case of illness of a newly born baby, subject to production of nu &cal certificate to the effect that the condition of the ailing baby warrants mother's personal attention and that her presence by the baby's side is absolutely necessary. 11. Quarantine Leave - (i) Quarantine leave is leave of absence from duty necessitated in c ,nsequence of the presence of an infectious disease in the family or household of a teacher. (i) (ii) Quarantine leave may he granted on medical certificate for a periodnot exceeding 21 days; in exceptional cases this limit may be raised to thirty days. Any leave necessary for quarantine purpose in excess of this period shall be treated as ordinary leave. Quaratine leave may be combined with earned leave, half pay leave or extra ordinary leave. (iii) A teacher on quarantine leave is not treated as absent from duty and his pay is not affected. 12. (A) Leave Salary (1) Except as provided in sub-rules (5), a teacher on earned leave is entitled to leave salary equivalent to the pay drawn immediately before proceeding on leave. (2) A tea:cher on half pay leave or leave not due is entitled to leave salary equal to half the amount specified in sub-rule(1) (3) A teacher on commuted leave is entitled to leave salary equal to the amount admissible under sub-rule (1) (4) A teacher on extra ordinary leave is not entitled to any leave salary. (5) (a) A teacher who is granted leave beyond the date of retire- ment or quitting of service, as the case may be, shall be entitled, during such leave, to leave salary as admissible under the rules in lumpsum for the entire period of such leave as one time settlement, reduced by the amount of pension and pension equivalent of :other retirement benefits. (b) Where such teacher is re-employed during such leave, -the leave salary shall be restricted to the amount of leave admi- ssible while on half pay leave and further reduced by the amount of pension and pension equivalent of other retire- ment benefits. Provided that it shall be open to the teacher not to avail himself of the leave but to avail of full pension. (c) If during such-employment he is granted leave earned by him during the period of re-employment, the leave salary shall be based on the pay drawn by him exclusive of the pension and pension equivalent of other retirement benefits. (B) Advance of Leave Salary : (a) The advance in lieu of leave salary admissible to a teacher proceeding on leave of not less than thirty days shall of income tax, provident fund, house rent, recovery of include allowances as well subject to deduction on account advance etc. (b) In case a teacher who dies in harness, the cash equivalent of the leave salary that the deceased employee would have got, had he gone on earned leave, but for the death, due and admissible, on the date immediately following the date of death, subject to a maximum of leave salary for 240 days, shall be paid to his family. Further, such cash equivalent shall not be subject to reduction on account of pension equivalent of death-cum-retirement. gratuity. (c) Half Pay Leave upto a maximum of 180 days shall be allowed to be commuted during the entire service where such leave is utilised for an approved course of study i.e. a course which is certified to be in the public interest by the leave sanctioning authority. PART-B Teacher appointed on probation : A teacher, appointed as a probationer against a substantive vacancy and with definite terms of probation, shall during the period of probation, be granted leave which would be admissible to him if he held his post substantively otherwise than on probation. If for any reason it is proposed to terminate the services of a probationer, any leave granted to him should not extend beyond the date on which the probationary period expires or any earlier date on which his services are tertninated by the orders of the Executive Council. On the other hand, a teacher appointed 'on probation' to a post, not substantively vacant, to assess his suitability to the post shall until he is substantively confirthed, be treated as a temporery teacher for purposes of grant of leave. If a person in the permanent service of the University is appointed 'on probation to a higher post he shall not, during probation, be deprived of the benefit of leave rules applicable to his permanent post. PART-C Temporary Teacher : Temporary teachers shall be governed by the provisions of part (A) of these rules subject to following conditions and exceptions : (1) Earned Leave (a) A temporary teacher shall be entitled to earned leave as a permanent teacher except that in respect of the first year of his service he shall be entitled to earned leave as follows : (i) 1/60th of the period of actual service plus (iii) I/3rd of the period, if any, during which he is requi- red to perform duty during vacation. (b) A temporarry teacher appointed without interruption of duty substantively to a permanent post will be credited with the earned leave which would have been admissible if his previous duty had been in permanent employ, diminished by any earned leave already taken Leave is not interruption of duty for the purpose of this rule (2) Half Pay Leave : No half pay leave may be granted to a temporary teacher unless the authority competent to sanction leave has reason to believe that the teacher will return to duty on the expiry of such leave. (3) Commuted Leave Temporary teacher shall not be entitled to commute any portion of the half pay leave. (4) Extra Ordinary Leave In the case of a temporary teacher the duration of extra ordinary leave on any occasion shall not exceed the following limits :— (a) Three months at a time ; (b) Six months in cases where the teacher has completed three years continuous service and the leave application is supported by medical certificate. (c) Eighteen months where the teacher is undergoing treat- ment in a recognised hospital for tuberculosis, cancer or leprosy ; (d) (i) 24 months in cases where the leave is required for prosecuting studies certified to be in the University interest provided that the teacher has completed three years' continuous service on the date of commencement of extra ordinary leave. In cases, where this condi- tion is not satisfied, extra ordinary leave to this extent may be sanctioned in continuation of any other kind of leave due and applied for (including three months' extra ordinary leave under (a) above) if the teacher completes three years' continuous service on the date of expiry of such leave. (ii) When a temporary teacher fails to resume duty on the expiry of the maximum period of extra ordinary leave granted to him or where a teacher who is granted a lesser amount of leave remains absent from duty for any period which together with the limit upto which he could have been granted such leave under (i) above, he shall unless the Executive Council, in view of the exceptional circumstances of the case otherwise determines, be deemed to have resigned his appointment and shall accordingly cease to be in the University employment. (5) Leave not due, Study Leave and Sabbatical Leave : Temporary teacher shall not be entitled for the grant of leave not due, study leave or sabbatical leave. PART-D Teachers appointed on contract : Teacher appointed on contract will be grantee leave in caw- ' dance with the terms of the contract. PART-E Honorary and Part-time teachers : Honorary and Part-time teachers of the University shall be entitled to leave on the same terms as are applicable to whole-time temporary teachers of the University. STUDY LEAVE (i) Study Leave may be granted to a permanent whole-time teacher (other than a Professor of the University) with not less than two years' continuous-service, to pursue a special line of study or research directly Sated to his work in the University or to make aspecial study of the various aspects of University Organisation and methods of education giving full ' plan of work. Provided that the Executive Council may, in special cicumstances f a case; waive the condition of two years' service being continuous. Explanation : In computing the length of service, the duration for which a.person was on probation or engaged as a Research Assistant may be included provided that :— (a) the person is a teacher on the date of the application and (b) there is no break in service. (ii) Study Leave shall be granted on the recommendation of the Advisory Committee, but leave shall not be granted for more than two years, save in very exceptional cases in which the Executive Council is satisfied that such extension is unavoidable on academic grounds and necessary in the interest of the University. The period of Study Leave shall, in no case, exceed three years. (iii) Study Leave shall not be granted to a teacher who is due to retire within three years of the date on which he is expected to return to duty after the expiry of Study Leave. (iv) Study Leave may be granted more than once provided that not less than five years have elapsed after the teacher returned to duty on completion of earlier spell of Study Leave. For subsequent spellof Study Leave, the teacher shall indicate the work done during the period of earlier leave as also give details of work to be done during the proposed spell of Study Leave. (v) No teacher who has been granted Study Leave shall be permitted to alter substantially the course of study or the programme of research without the permission of the Executive Council. When the Course of Study falls short of Study Leave sanctioned, the teacher shall resume duty on the conclusion of the course of study unless the previous approval of the ...f(xecutive Council to treat the period of shortfall as Extra-Ordinary leave __has been obtained. (vi) The teachers granted.study leave would be entitled to continue 'to draw their total emoluments for the duration of the Study Leave as are applicable to teachers granted fellowships under the Faculty Improve- ment Programme except the living expenses allowance of Rs. 250/- p.m. The necessary increment will also be sanctioned as and when due. :However,- the amount of emoluments payable to the teachers on Study Leave shall be reduced subject to the provisions of Sub-Clauses (vii) and (viii) below. (vii) The amount or Scholarship/Fellowship or other financial assistance that a teacher granted Study Leave has been awarded, will not preclude his being granted Study Leave with pay and allowances but the acholarship etc. so received shall be taken into account in determining the pay and allowances on which the Study Leave maybe granted. The following guidelines shall apply while determining the admis- sibility of pay and allowances where financial assistance received by a teacher is : I. Where the amount payable to the teacher by the foreign inviting agency each month is equal to or less than the cummulative per diem allowance to a Grade I Officer of an Indian Mission or Indian Government agency for travel in that country, the full Delhi University Salary may be paid to the teacher. Example : Teacher A is authorised to go to Canada and is to receive $45 per month from the Canadian Institution. The permissible per diem cummulated on a monthly basis for a Grade I Govern- ment of India Officer in Canada is say $5oo. In this case, since what he received will be less than the per diem, he should be paid his full Delhi University salary and allowances. Where the grant, fellowship, salary or other support, is in amount greater than the amount allowable as per diem for a Grade I Officer, the teacher may be paid Delhi Univsity sa'ary minus the difference between his actual grant and the permissible per diem worked out on a monthly basis. Example: Teacher B receives a grant of $600 per month. In this case he gets $100 or Rs. 750 /- per month more than the permissible per diem. If his Delhi University Salary, dearness and city compensatory allowances aount to Rs. r, 550 he should be paid by Delhi University Rs. m Soo only. Where a teacher gets a grant, fellowship or salary that is greater than the permissible per diem plus the Delhi University salary, dearness allowance and city compensatory allowance, he shall not be paid any amount by the University. Example : Teacher C receives a fellowship of $1,000 per month. This is $500 or Rs. 3,75o more than the permissible per diem. If the Delhi University salary plus dearness and city compensatory allowances is Rs. 1,95o he will be ineligible to receive any amount from Delhi University. 4. (i) In the above case, the teacher may be paid the normal house rent allowance he was in receipt of before accepting the fellowship, if he continues to incur the expenditure. If a teacher is in occupation of a house leased by the Uni- versity, he can, if he so chooses, retain the accommodation during the period of fellowship subject to the usual recovery towards house rent. (ii) The payment of house rent allowance and city compensatory allowance will be made on production of the re gnsisate certificates. A teacher who receives a fellowship or grant or other support tenable exclusively during the Summer Vacation period and whose travel is approved by the Delhi University authorities may be sanctioned his salary and allowances in full (E.G. dated 1.3.1981). (viii) If a teacher, who is granted Study Leave, is permitted to receive and retain any remuneration in respect of Part-time employment during the period of Study Leave, he shall ordinarily not be granted any Study Leave salary, but in cases, where the amount of remuneration received in respect of Part-time employment is not c onsideredadequat in e, the Executive Council may determine the Study Leave salary payable each case. Note : It shall be the duty of the teacher granted Study Leave to communicate immediately to the University the amount of financial assistance in any form r eceived by him during the course of Study Leave from any person or Institution whatsover. (ix) Subject to the maximum period of absence from duty on leave not exceeding three years, Study Leave may be combined with earned leave, half-pay leave, extra-ordinary leave or vacation provided that the earned leave at the credit of the teacher shall be availed of at the commencement of the study leave. When study leave is taken in continu- ation of vacation, the period of Study Leave shall be deemed to begin to run on the expiry of the vacation." , (a) The period provided Stuy Leave shall count as service for purposa of retirement benefits, p that the teacher rejoins the UniVersity OD the expiry of his Study Leave, and serves for the period for which the Bond has been executed. (xi) Study Leave granted to a teacher be deemed to be cancelled in case it is not availed of within six months of its sanction. Provided that where study leave granted, has been so cancelled, the teacher may apply again for such leave. (xii) A teacher availing of Study Leave, shall undertake that be shall serve the University continuously for double the period of Study Leave subject to a maximum of three years from the date of his resuming duty after expiry of the Study Leave. (xiii) A teacher — (a) who fails to rejoin the service of the University on the expiry of his Study Leave, or (b) who rejoins the service of the University but leaves At service without completing the prescribed period after rejoining the service, or (c) who within the said period is dismissed or removed frets the service by the University. shall be liable to refund to the University, the amount of leave salary and al wances and other expenses, incurred on -the teacher or pankao him or lo on his behalf in connection with the course of study : Provided that if a teacher had served in the University for a' period ot not less than half theperiod of service under the Bond on return from Study Leave, he shall refund to the University half of the amount calcu- lated as above. In case the teacher has been granted Study Leave without pay and allowances, he shall be liable to pay the University an amount equivalent to his four months, pay and allowances last drawn as well'as other expenses incurred by the University in connection with the course:of study. Exptanation : (a) if a teacher asks for extension of Study Leave and is not granted the extension but does not rejoin duty on the expiry of the leave originally sanctioned, he will be deemed to have failed to rejoin the service on the expiry of his leave for the purpose of recovery of dues under these rules. (b) Notwithstanding the above the Executive Council may order that nothing in these rules shall apply to a teacher who within three years of return to duty from Study Lem e is permitted to retire from service on medical grounds. Provided further that the Executive Council may, in any other exceptional case, waive or reduce, for reasons to be recorded, the amount refund- able by a teacher under these rules. (xiv) (a) After the leave has been sanctioned, the, teacher shall, before availing of the leave, execute a bond in favour of the University in the prescribed form undertaking to serve the University for not less than double' the period of Study Leave sanctioned to him on full, half or no pay' subject to a maximum period of three years. (E.G. 1.6.1g79). (b) In addition to executing a bond as aforesaid the teacher shall have to provide two sureties when Study Leave is granted to him on full pay and one surety when Study Leave is granted to him on half pay and give security of immovable property to the satisfaction of the University 6r &Fidelity Bond of an Insurance Company, or a Guarantee, by a Scheduled Bank. The sureties furnished shoidd be acceptable to the University, Where the two sureties or the one surety, as the case may be, provided lay. the teacher are those who are permanent teachers of the Institution to which the teacher belongs, the University may, in its discretion, waive the additional requirement of getting security of immovable property or a Fidelity Bond of an Insurance. Company or a Guarantee by a Scheduled Biqa, The_Surety clause shall form part of the Study Leave Bond and the persons giving surety shall be liable to pay to the University the amount recoverable from the teacher concerned on his failure to fulfil the obligations of the Bond. (xv) A teacher who has been granted Study Leave for pursuing faith towards his doctorate shall submit to the Registrar six monthly reports of progress in his studies through his supervisor or the Head of the Institution. In case of others, the teacher concerned may send the reports 91 the work done by him directly to the Registrar. These reports shareach the Registrar within one month of the expiry of every six months of the Study Leave. If the reports do, not reach the Registrar within the time specified, the payment of salary may be deferred till the receipt of such reports. (B.C. Res. No 3o5 dated 1.3.ig8t). GENERAL LEAVE RULES FOR NON-TEACHING STAFF (Corrected apt° 19+1984) 31 Extent of Application The leave rules contained in the chapter will be applicable to the non-teaching staff of the University from the date of adoption by the Executive Council or such date as the Executive Council may prescribe in this behalf, provided that in the leave account of the staff who are already in the service of University when they become subject to these rules shall be credited; (i) Privilege leave on full pay, or with whatever nomenclature it may be designated as earned leave; (ii) Leave on private affairs, medical leave or half-pay leave with whatever homenclature it may be designated as half-pay leave; Which it would on the date on which he becomes subject to these rules, be permissible for grant to him under the rules in force prior to that date. §4. interpretation : Under the rules in this chapter unless the context otherwise requires: (a) Earned leave, half-pay leave, leave not due, commuted leave, extra-ordinary leave etc., mean the leave as provided in these rules; (b) 'A complete year of Service' means continuous service of the specified duration under the University and includes periods spent on duty as well as on deputation to foreign service or extraordinary leave; - (c) 'Earned Leave' means leave earned in respect of period spent on duty; and (d) 'Half-pay leave', means leave earned in respect of completed years of service calculated according to theprovisions hereinafter contained; (e) 'Date of retirement' or 'date of his retirement' in relation to a non-teaching University employee, means the afternoon of the last day of the month in which the non-teaching University employee attains the age, prescribed for retirment under the terms and conditions governing his service. GENERAL CONDITIONS 35. (a) Right of leave : Leave cannot be claimed as a right and • when the kigericies of service so demand, leave on any occasion be refused or revoked by the authority empowered to sanction leave. In case an employee is recalled to duty before the expiry of his leave, such recall to duty shall be treated as compulsory in all cases. (b) Combination of leave : Except otherwise provided under these rules, any kind of leave under these provisions may be granted in combination with or in continuation of any other kind of leave subject to any limit on the aggregate period of absence as may be prescribed in such cases, except in case of casual leave. Commencement and Termination of leave :-- • (i) Leave ordinarily begins from the date on which leave as such is actually availed of and ends on the day one resumes his duty; and (ii) Sundays and other holidays may be prefixed, or suffixed to leave subject to any limit of absence on leave "prescribed under each kind of leave. (d) Leave/Cash payment in lieu of leave beyond the date of retirement or quitting 4 service: (I) No leave shall be granted to an employee beyond: (a) the date of his retirement or ; (b) the date of his final cessation of duties, or (4 the dete on whicch he retires 'by giving notice tp the University or he is retired by the University by giving him notice or pay and allowances in lieu of such notice, in accordance with the terms and conditions of his services or (c1) the date of his resignation from service. (II) (a) where a University employee retires on 'attaining the normal age prescribed for retirement ,under the terms and conditions g overning his service the authority competent to -grant leave shall suo mats issue an order granting cash equivalent of leave salary for earned leave, if any, at the credit of the employee on the date of his retirment, subject to a maximum of 240 days. (b) The cash equivalent under clause (a) shall be calculated as follows and shall be payable in one lumpsum as a one-time settlement. No House Rent Allowance or City Compensatory Allowance shall be payable. (c) Pay admissible on the date of retirement plus dearness allowance admissible on that date Number of days of unutilised earned leave at credit on the date of retirement subject to maximum x of 24o days. Cash equivalent (III) A University employee, who retired from the service on attaining the age of retirement while under suspension, shall become eligible for the benefit of cash equivalent of earned leave that was at his credit on the date of his retirement, calculated in the manner provided in clause (b) of sub rule .(II), on conclusion of the proceedings against him, if the:authority competent to reinstate him in service holds that the suspension was wholly unjustified. ) A University employee who retires or is retired from service in the manner mentioned in clause (c) of sub-rule (I), may be granted, suo-rnotu by the authority competent to grant leave, cash equivalent of the leave salary, in respect of earned leave at his credit subject to a maximum of 24o days and also in respect of all the half pay leave at his credit provided this period (E.L. + H.P.L.) does not exceed the period between the date on which he so retires or is retired from service and the date on which he would have retired in the normal course after attaining the age prescribed for retirement under the terms and conditions governing his service. However, encashment of Earned Leave due and admissible, subject to a maximum of 240 days, 'ma) be allowed even if this exceeds the period between the date on which the employee retires and the date on which he would have retired in the normal course on superannuation. The cash equivalent shall be equal to the leave salary as admissible for earned leave and/or equal to the leave salary as aemissble for half pay leave plus dearness allowance admissible on that leave salary for .the first tho days, at the rates in force on the date the University employee so retires or is retired from service. The pension and pension equivalent of other retirement benefits and ad-hoc relief/graded relief on pension shall be deducted from the leave salary paid for the period of half pay leave, if any, for which.the cash equiva- lent is payable. The amount so calculated shall be paid in one Jump sum.as a one-time settlement. No House Rent Allowance . or City Compensatory Allowance shall be payable. Provided that if leave salary for the half pay leave component falls short of pension and other pensionary benefits, cash equivalent of half pay leave shall not be granted. ProVided further that a University employee who is retired by Uni- versity by giving him pay and allowances in lieu of notice, may apply for leave within the period for which such pay and allowances were given, and where he is granted leave, the leave salary shall be allowed only for the period of leave excluding that periodlor which pay and allowance in lieu of notice have been allowed. The leave salary payable for the Half Pay Leave components granted tinder this rule and rule No. 47-D, shall henceforth be calculat$ ill she manna indicated below: Cash payment in lieu of half pay leave component Half Pay Leave salary plus D.A. if admissible (minus) Pension, Pension equivalent of gratuity and relief on pension if dear- ness allowance is admissi- ble on H.P.L. No. of days of H.P.L. due on the date of retirement/quitting the service 'subject" to the limits prescribed under the rules. 3o (V) (a) (i) Where the services of a University employee are terminated by notice or: by payment of pay and allowances in lieu of notice, or otherwise in. accordance with the terms and conditions of his appointment, he may be.granted, suo-modu by the authority competent to grant leave, cash equivalent in respect of earned leave at his credit on the date on which he ceases to bt, in service subject to a maximum of 38o days; (ii) If a University employee resigns or quits service, he may be granted, suo motu, by the authority competent to grant leave, cash equivalent in respect of earned leave at his credit on the date of cessation of service, to the extent of half of such leave at his credit, subject to a maximum of go days; The cash equivalent under clause (a) shall be equal to leave salary admissible for earned leave calculated under clause (b) of Sub-Rule (II) of General Leave Rule 35(d) plus dearness allowance admissible on that leave salary at the rate in force on the date the University employee ceases to be in service. The amount so calculated should he paid in one lump stun as one-time settlement. No City Compensatory Allowance and/or House Rent Allowance shall be payabale. (4) Conversion of one kind of leave to another kind : (i). At the request of an employee the sanctioning authority may convert any kind of leave retrospectively into leave of a different kind which was due and admissible to him at the time the leave was granted, but the employee cannot claim such conversion as a matter of right. (ii) The conversion of one kind of leave into another shall be subject to adjustment of leave salary on the basis of leave finally granted to the employee, that is to s cy, any amount paid to him in excess shall be recovered or any arrears due to him shall be paid. ,Note : Extra-ordinary leave granted on medical certificate or other- wise may be converted retrospectively into leave not due subject to the provisions of Rule 4.0. (f) Leave on medical ground and resumption of duty The authority competent to grant leave may in its discretion, waive the production of a medical certificate in case of an application for leave Aar a period not exceeding three days at a time on medical grounds. Such leave shall not, however, be treated as leave on medical certificate and shall be debited against leave other than leave on medical" grounds. (b) Regulations—Leave Rules Non-teaching Staff 751' An employee who has been granted leave on medical grounds shall be required to produce a medical certificate of fitness before resuming duty. (g) Re-joining of duty before the expiry of the leave:— Except with the permission of the sanctioning authority no employee on leave may join duty before the expiry of the period of leave sanctioned to him. (h) Application for leave : Leave should be applied for in the prescribed form given in Annexure II. It should be applied for sanction before it is availed of except in special cases of emergency and for reasons to the satisfaction of the sanc,- tioning authority. (1) Continuous temporary service, followed by permanent service with- out any break, shall be included in the permanent service for the purpose of computation of leave. (j) Increment during leave : If the increment falls during leave other than casual leave or special casual leave, the effect of increase of pay will be given from the date the employee resumes duty without prejudice to the normal date of his increment. (k) (1) No permanent employee shall be granted leave of any kind fife a continuous period exceeding five years. (ii) When an employee does not resume duty after remaining op leave for continuous period of three years, or whether an em- ployee after the expiry of his leave remains absent from duty, otherwise than on foreign service or on account of suspension, for any period which together with the period of, leave granted to him exceeds three years his lien shall, unless the Executive Council in view of the exceptional circumstances of the case otherwise determines be deemed to have terminated and he shall cease to be in the University service. (1) Leave account will be made for each employee in the prscribed form. The order sanctioning earned leave, half-pay leave to an employee shall hereafter indicate the balance of such leave at his credit. (in) Honorary or part-time employees shall be entitled to leave on , theSarne conditions on which iris available to salaried employees of the University. (n) • Leave to the employees engaged on contract will be in accordance with the terms of the contract enterted into. ( ) Absence after expiry if leave Unless the authority competent to grant leave extends the leave, a University employee who remains absent after the end of leave is entitled to no leave salary for the period of such absence and that period shall be debited against his leave account, as though it were half pay leave, to the extent such leave is due, the period in excess of such leave due being treated as extra-ordinary leave. (n) Leave to the employees engaged on contract will be in accordance with the terms of the contract enterted into. (i) Absence after expiry of leave Unless the authority competent to grant leave extends the leave, a University employee who remains absent after the end of leave is entitled to no leave salary for the period of such absence and that period shall be debited against his leave account., as though it were half pay leave, to the extent such leave is due, the period in excess of such leave due being treated as extra-ordinary leave. (2) Wilful absence from duty after the expiry of leave renders a University employee liable to disciplinary action. Decisions (i) Treatment of wilful absence from duty not recognised Wilful absence from duty even though not covered by grant of leave does not entail loss of lien. The period of absence not covered by grant of leave shall have to be treated as' dies-non' for all purposes, viz., increment, leave and pension. Such absence without leave where it stands singly and not in continuation of any authorised leave of absence will constitute an interruption of service for the purpose of pension and unless the pension sanctioning authority exercises its powers to treat the periods as leave with- out allowance, the entire past service will stand forfeited. (2) Action for overstayal of leave Doubts were raised in certain quarters as to how the cases in which an official overstays the prescribed quantum of extraordinary leave, should be dealt with. It has been clarified that the amendment does not take away the power of the disciplinary authority to take appropriate disciplinary action for any misconduct. Action can, therefore, be taken under these rules for unauthorised absence from duty or overstayal of leave even for one day, treating it as istiScOnduet, if the facts and circumstances of the case warrant such an action . (g) 'Action for unauthorised absence from duty or overstayal of leave The following decisions have been taken: (i) When a temporary University employee asks for leave in excess of the limits prescribed under Rule 45 and if the circumstances are exceptional, a decision could be taken by the leave sanction- ing authority to grant further leave in excess of the limits with the approval of the Vice-Chancellor. (ii) When a temporary University employee applies forleave beyond the prescribed limit of extra-odinary leave and the leave sanc- tioning authority is not satisfied with the genuineness of the grounds on which further leave has been asked for, nor does it consider the grounds as exceptional, the leave cannot be granted. In such a case the University employee should be asked to rejoin duty within a specified date failing which he would render himself liable for disciplinary action. Disobedience of
