Punjab State Prevention and Control of Infectious and Contagious Diseases in Animals Rules, 2013

PUNJAB GOVT. GAZ. (EXTRA), JULY 26, 20131001 (SRVN 4, 1935 SAKA) GOVERNMENT OF PUNJAB DEPARTMENT OF ANIMAL HUSBANDRY, FISHERIES AND DAIRY DEVELOPMENT NOTIFICATION The 17thJuly,2013 No.G.S.R.45/C.A.27/2009/S.43/2013.-In exercise of the powers conferred by sub-section (I) of section 43 of the Prevention and Control of Infectious and Contagious Diseases in Animals Act, 2009 (Central Act 27 of 2009), and all other powers enabling him in this behalf, the Governor of Punjab, with the prior approval of the Central Government, is pleased to make the following rules, for carrying out the purposes of the said Act, namely:- RULES 1. Short title and commencement:- (I) These rules may be called the Punjab State Prevention and Control of Infectious and Contagious Diseases in Animals Rules, 2013. (2) They shall come into force on and with effect from the date of their publication in the Official Gazette. 2 Definitions.- (I) In these rules, unless the context otherwise requires; (a) 'Act' means the Prevention and Control of Infectious and Contagious Diseases in Animals Act, 2009; (b) 'Government' means the Government of the State of Punjab in the Department of Animal Husbandry, Fisheries and Dairy Development; (c) 'section' means a section of the Act; and (d) 'Form' means a Form appended to these rules. (2) All other words and expressions used in these rules but not defined shall have the same meaning as assigned to them in the Act. 3. The manner of inspection and the period of detention a~ a Check Post or at a Quarantine Camp.- (I) In order to ascertain whether the animal is infected with any of the scheduled diseases, the animals stopped at the Check Post or detained in the Quarantine Camp shall be inspected by the Section 14 and 15 1002 PUNJAB GOVT. (EXTRA), JULY 26, 2013 (SRVN 4, 1935 SAKA) Section 15 person incharge of the Check Post or the Quarantine Camp for the following:- (a) movement and gait; (b) dull, depressed, normal or excited behaviour; (c) increase in body temperature; (d) ulcers in the mouth, feet or udder; (e) excessive lacrimation, nasal or vaginal discharge; (f) sweating and shivering; (g) dryness of the skin, alopecia, skin rashes; (h) weakness; (i) bleeding through natural openings; and G) oedema or swelling in dewlap region or any other part of the body. (2) The person incharge of the Check Post or the Quarantine Station shall also collect the necessary samples for laboratory examination, ifrequired. (3) The person incharge of the Check Post may detain animals at the Check Post for a period not exceeding twelve hours for the purpose of inspection, compulsory vaccination and identification/marking etc. For the animals vaccinated at the Check Post, the owner of the animal shall be given a vaccination certificate as required under section 9 of the Act. (4) After examination of the animal, the officer incharge shall either allow entry of the animals to the controlled area or the free area by issuing an Entry Permit in Form A, or transport the animal to the Quarantine Camp. (5) The cost of examining, vaccinating, ear-tagging of the animal or of . any other activity at the Check Post shall be fixed by the Director from time to time and shall be borne by the owner of the animals. 4. Form of entry permit granted by the officer incharge of a Quarantine Camp:- (1) The officer incharge of the Quarantine Camp shall· detain the following category of animals:- (a) which are suffering from any of the scheduled disease; or PUNJAB GOVT. (EXTRA), JULY 26, 2013 1003 (SRVN 4,1935 SAKA) (b) which have come into contact with or have been kept in the proximity of an animal infected with a scheduled disease; or (c) transported by the incharge of the check post as detai led in sub rule(4)ofrule3; or (d) of the species while exiting from the infected area as per the provisions contained in section 10 of the Act and shall be subjected to a quarantine of minimum period offourteen days in a Quarantine Camp. The Competent Officer may decide, if the animal is to be retained for a period of more than fourteen days, based on epidemiological and scientific basis. (2) The officer incharge of the Quarantine Camp shall give an official acknowledgement to the owner of the animals for the detained in the Quarantine Camp in Form B. (3) During quarantine, the animals shall be identified by Ear-tagging Or by inserting microchip or by any other suitable method bearing a unique identification number/mark (for cattle, buffalo, sheep, goat, pig, donkey, horse or any other animal).Animals shall be vaccinated against the scheduled disease and provide with veterinary treatment, if required, and shall be examined regularly for any scheduled disease. If animals are vaccinated, the owner shall be provided with a vaccination certificate as required under section 9 of the Act. (4) The cost of maintenance and vaccination of the animals during the quarantine shall be fixed by the Director from time to time and shall be borne by the owner of the animals. (5) After successful quarantine, the officer incharge of the quarantine camp shall release or hand over the animal to the owner of the animals and also grant the Quarantine Release Permit in Form-C under his signature. Form-C shall also serve as Entry Permit as required under sub-section (2) of section 15 of the Act. 5. Interpretation:- If any question arsis as to the interpretation of these rules, the Government shall decide the same whose decision shall be final and binding. 1004 PUNJAB GOVT. GAZ.
