NATIONAL HIGHWAYS AUTHORITY OF INDIA NOTIFICATION New Delhi, the 22nd November, 2012 The National Highways Authority of India (Recruitment, Seniority and Promotion) Sixth Amendment Regulations, 2012 The National Highways Authority of India (Recruitment, Seniority and Promotion) Sixth Amendment Regulations, 2012 No.NHAI/l1011/17/2012-HR.I(VoI.V).— In exercise of the powers conferred by section 35, read with section 9, of the National Highways Authority of India Act, 1988 (68 of 1988), the National Highways Authority of India hereby makes the following regulations further to amend the National Highways Authority of India (Recruitment, Seniority and Promotion) Regulations, 1996, namely: - 1. Short title and commencement:- (1) These regulations may be called the National Highways Authority of India (Recruitment, Seniority and Promotion) Sixth Amendment Regulations, 2012. (2) They shall come into force on the date of their publication in the Official Gazette. 2. In regulation 11 of the National Highways Authority of India (Recruitment, Seniority and Promotion) Regulations, 1996 (hereinafier referred to as the principal regulations), for clause (b) of sub-regulations (3), the following clause shall be substituted, namely:- “(b) The constitution of the Selection Committee for non-technical posts of Deputy Manager and Manager will be as indicated in clause (c) below and for non-technical posts of Deputy General Manager, a Member and three Chief General Managers to be nominated by the Appointing Authority.” 3. In regulation 11 of the principal regulations, for sub-regulation (4), the following sub- regulation shall be substituted, namely:- “(4) In case of selection of candidates belonging to Group~B, C and D posts, the Selection Committee will comprise of a Chief General Manager and another Group-A officer of appropriate discipline to be nominated by the Appointing Authority and the General Manager (Admn.) / Deputy General Manager (Admn.). Provided that in each Selection Committee an officer of appropriate rank belonging to the Scheduled Caste or Scheduled Tribe shall also be inducted as a Member in case no member of the Selection Committee belongs to the Scheduled Caste or Scheduled Tribe.” wmmzmm[am in we M 4. In the principal regulations, for regulation 21A, the following regulation shall be substituted, namely:- “ZlA. Conduct and Discipline:- The provisions of the Central Civil Services (Conduct) Rules, 1964 and the Central Civil Services (Classification, Control and Appeal) Rules, 1965, as amended from time to time, shall be applicable to the officers and employees of the Authority in the matter of conduct and discipline. ' Provided that in case of matters governed by the Central Civil Services (Classification, Control and Appeal) Rules, 1965 the disciplinary authority, the appellate authority and reviewing authority shall be as follows:- Sl. In the Schedule to the principal regulations, the following note shall be inserted, namely:- “Note l:- Wherever the deputation is prescribed as a mode of recruitment in Column 5 of the Schedules, the period of deputation prescribed in Column 8 thereof shall be substituted, namely:- Period of deputationz- Initial period of deputation shall be 05 years, which may be extended for a period of 02 years or curtailed with the approval of the Appointing Authority.” RAJIV YAIDAV, Member (Administration) Foot Note : The principal regulations were published vide notification No.NHAR-1201 1/1/95-Admn., dated 11‘h March, 1996, in the Gazette of India, Extraordinary, Part 111, Section 4, dated the 11‘h March, 1996 and last amended vide notification No.NHAl/11011/17/2012— HR.I(Vol.V), dated 11‘h September, 2012, published in the Gazette of India, Extraordinary, Part III — Section 4, dated the 11‘h September, 2012.
