Regarding exemption of stamp duty under Uttar Pradesh Electronics Manufacturing Policy First Amendment 2022

UTTAR PRADESH SHASAN STAMP EVAM REGISTRATION ANUBHAG-2 In pursuance of provisions of clause (3) of Article 348 of the Constitution, the Governor is pleased to order the publication of the following English translation of Notification no. 2/2025/92/94-SR-2-2025-700(89)/2024 dated : 03 February, 2025 : Notification No. 2/2025/92/94-SR-2-2025-700(89)/2024 Lucknow; Dated : 03 February, 2025 In exercise of the powers under clause (a) of sub-section (1) of section 9 of the Indian Stamp Act, 1899 (Act no. 2 of 1899) as amended in its application to the State of Uttar Pradesh read with section 21 of the General Clauses Act, 1897 (Act no. 10 of 1897), the Governor, in supersession of Notification no. 12/2020/1245 /94-S.R.- 2-2020-700(19)/2020 dated 12.11.2020, except as respects things done or omitted to be done before such supersession, under this notification, is pleased to remit the stamp duty to the extent shown in Column-3 of the Schedule below, chargeable in respect of the instrument as shown in Column-4 of the said Schedule for the purposes as mentioned in Column-2 of the said Schedule as provided in paragraph 5.3 and 5.10 of the Uttar Pradesh Electronics Manufacturing Policy, 2020 (as amended in 2022). SCHEDULE Relevant Paragraph of the Uttar Pradesh Electronics Manufacturing Policy, 2020 (as amended in Purpose and other detail Extent of remission Nature of instruments and Article number of Schedule I-B of the Indian Stamp Act, (i) on the purchase/lease of land for the establishment of individual E.S.D.M unit "Conveyance" under clause (a) of Article- 23 and "lease" under of Schedule I-B of the Indian Stamp Act, 1899 (ii) on the first transaction of purchase/lease of land (from land owner to Developer/S.P.V) for the establishment of E.M.C/E.S.D.M parks (iii) on the second transaction of purchase/lease of land (from Developer/S.P.V to E.S.D.M unit) for the establishment of E.M.C/E.S.D.M parks on the purchase/lease of land for the establishment of semiconductor units (Silicon Semiconductor Fab, Display Fabrication Unit (Fab), Compound Semiconductors, Silicon (including MEMS) Fab, Discrete Semi conductors Fab Semiconductor Assembly, Testing, Marking and Semiconductor Assembly and Test (OSAT) Facility) 2. The aforesaid remission shall be subject to the following conditions, namely:- (a) the Unit shall not be provided with other remission or facility under any other policy of the State Government; (b) the District Magistrate or the General Manager, District Industries Centre/Deputy Commissioner Industries with the approval of District Magistrate shall sign such instrument as witness for the purpose of confirming the fact that the conveyance deed is being executed for the purposes mentioned above; and (c) irrevocable bank guarantee of the amount equal to the remission of stamp duty in favour of Inspector General of Registration, Uttar Pradesh shall be presented before the Registering Officer at the time of registration of such conveyance deed/lease deed. In this regard, it shall be the liability of the I.T. and Electronics Department, Uttar Pradesh to inform the status of non- fulfillment of the purpose or non-commencement of commercial production within the prescribed period, by the unit receiving such remission to the Stamp and Registration Department, Uttar Pradesh immediately. In such a condition, the Stamp and Registration Department, Uttar Pradesh shall deposit the amount in the proper account head of the Department, by encashing the bank guarantee: Provided that upon confirmation of the fact by the I.T. and Electronics Department, Uttar Pradesh that the conditions under the aforesaid policy have been properly complied with by the concerned unit, the Bank Guarantee shall be released by the Stamp and Registration Department, Uttar Pradesh.
