Registration Fees chargeable on first transaction for Tourism Policy, 2022

UTTAR PRADESH SHASAN STAMP EVAM REGISTRATION ANUBHAG-2 In pursuance of provisions of clause (a) of Article 348 of the constitution, the Governor is pleased to order the publication of the following English translation of Government notification of Government Notification No-24/2023/1151/94-S.R.-2-2023-700(78)/2023 dated, 26 October, 2023. Notification Order. Lucknow, dated, 26 October, 2023. In exercise of the powers under section-78-A of the Registration Act 1908 (Act No. 16 of 1908) as amended, from time to time, in its application to Uttar Pradesh, the Governor of Uttar Pradesh, from the date of publication of this Notification in the Gazette, is pleased to remit the Registration Fee, for establishing new unit under the Uttar Pradesh Tourism Policy 2022, in accordance with the Para-7 of the above said Policy, for the purposes of the objectives specified therein, to the limit as mentioned in column-3 of the table below in relation to the Instrument as shown in column-4 - Para of Uttar Pradesh Tourism Policy 2022 Purpose Exemption Limit Nature of Instrument Registration Fee exemption to the eligible Tourism Units, for the first transaction only, during the operative, period of this policy. On the instrument of conveyance under & Lease of Article-35 of Schedule- (b) of the Indian Stamp Act The aforementioned exemption under this notification is subject to the following 1- In case, Uttar Pradesh Tourism Policy 2022, comes to an end, by any means, the remittance under this notification, shall be considered to be revoked by itself from the date of the withdrawal of the said policy. 2- The District Magistrate/ Deputy Commissioner of Industries concerned District shall confirm in the Instrument of conveyance/ Lease that the deed is being executed under the Uttar Pradesh Tourism Policy 2022 and also signs as a witness for the said purpose. 3- The unit which has obtained the benefit of Registration Fee exemption under any other policy will not be eligible for a Registration Fee remittance/ exemption under this policy and notification. 4- The implementation of the notified provisions shall be done according to the extant procedural guidelines issued by the Stamp & Registration Department. 5- The provisions mentioned in the above notification will be considered effective from the date of the Government Order issued by the Administrative Department (Tourism Department) regarding the implementation of the policy. 6- Irrevocable bank guarantee of the amount equivalent to the remission of Registration Fee in favour of the District Magistrate of the concerned district shall be presented before the registration officer at the time of registration of such deed. The period of the Bank guarantee should not be less than the period, as prescribed in the policy, for the completion of project. 7- Rules and procedure of Bank Guarantee covering stamp duty exemption shall apply mutatis mutandis to the Bank Guarantee covering registration fee exemption.
