Regarding amendment of Rule 74 of the Maharashtra Co-operative Societies (Election of Committee) Rules, 2014

RNI No. MAHBIL /2009/37831 CO-OPERATION, MARKETING AND TEXTILES DEPARTMENT Mantralaya(Annex), Madam Cama Marg, Hutatma Rajguru Chowk, Mumbai 400 032, dated the 17th February 2022 NOTIFICATION No. CSL-2016/C.R. 35/13-C.—In exercise of the powers conferred by sub-section (1) and (2) of section 165 of the Maharashtra Co-operative Societies Act, 1960 (Mah.XXIV of 1961), and of all other powers enabling it that behalf, the Government of Maharashtra hereby, after considering objections and suggestions, pursuant to the Government Notification, Co-operation, Marketing and Textiles Department, No. CSL-2016/C.R. 35/13-C, dated the 16th December 2021, published in the Maharashtra Government Gazette, Extraordinary, Part IV-B, dated 16th December, 2021, makes the following rules further to amend to the Maharashtra Co-operative Societies (Election to Committee) Rules, 2014, namely :— 1. These rules may be called the Maharashtra Co-operative Societies (Election to Committee) ( Third Amendment) Rules, 2021. 2. For rule 74 of the Maharashtra Co-operative Societies (Election to Committee) Rules, 2014, the following rule shall be substituted, namely :— “ 74. Casual vacancies.—(1) In the event of the vacancy occurring on account of death, resignation, disqualification or removal of an elected committee member of a society or through such a member becoming incapable of acting, prior to the expiry of his term of office or otherwise, the committee of the society shall forthwith communicate the occurrence of such vacancy to the State Co-operation Election Authority and District Co-operation Election Officer, and the vacancy shall be filled within one month from the date of such communication, by nomination of the eligible members out of the same class of the members in respect of which casual vacancy/vacancies has arisen, in the meeting of the remaining members of the committee, which shall be presided over by an officer authorized by State Co-operation Election Authority : Provided that, at any instance during the tenure of a committee, there shall not be nominated members of the committee exceeding one third of the total strength of the committee. (2) The member so elected or nominated under sub-rule (1) shall hold office so long only as the member of the committee in whose place he is elected would have held it, if the vacancy had not occurred.” By order and in the name of the Governor of Maharashtra, ANOOP KUMAR, Principal Secretary to Government.
