Enhance the grants and to initiate a new scheme for the welfare of registered eligible construction workers and their nominees/dependents

26 Qjojh 2019 26 Qjojh 2019 The 26 th February 2019 S.O.- 45, dated 28 th February 2019— In exercise of power conferred by section 22(h) of Building and Other Construction Workers (Regulation of Employment and Conditions of Service) Act, 1996 (27 of 1996) and 284 – A of Bihar Building and Other Construction Worker (Regulation of Employment and Conditions of Service) (Amendment) Rule, 2016, the Government of Bihar makes following provisions to enhance the grants and to initiate a new scheme for the welfare of registered eligible construction workers and their nominees/dependents :- 1. Death Benefit.—In case of “Natural Death”, the amount of grant provided to nominees/ dependents is enhanced from Rs. 1,00,000/-(One Lakh) to Rs. 2,00,000/- (Two Lakh). 2. Pension.—The eligibility for pension as described in Rule 272 of Bihar Building and Other Construction Worker (Regulation of Employment and Conditions of Service) Rule, 2005, “A member of the fund, who has been working as a building worker for not less than one year after the commencement of these rule, shall be eligible for pension on completion of sixty years of age” is amended as below :- “A member of the fund, who has been working as a building worker for not less than five year after the commencement of these rule, shall be eligible for pension on completion of sixty years of age.” 3. Maternity Benefit.—In place of Rs. 10,000/- (Ten thousand) as maternity benefit, an equivalent amount of the wages of ninety days of minimum wages rate laid down for unskilled workers by State Government on the date of delivery is provisioned for the registered female construction workers after delivery of first two children. 4. Cash Award.—The Cash Award of Rs. 25,000/-, Rs.15,000/- and Rs. 10,000/- for the sons and daughters of three registered construction workers in every District for scoring highest marks in matric examination conducted by Bihar School Examination Board every year is amended as below :- “The cash award of Rs. 25,000/- (Twenty five thousand), Rs. 15,000/- (Fifteen thousand) and Rs. 10,000/- (Ten thousand) shall be given to the maximum two children of the registered construction workers for scoring 80% and above, 70% to 79.99% and 60% to 69.99% marks respectively in the examinations of class 10 th and class 12 th conducted by any Board in the State of Bihar. An application in Form – XLIII shall be submitted with the mark sheet of the Board upto the last month (March) of the financial year of passing the examination. No application will be accepted after the lapse of this period. 5. Paternity Benefit.— Rule 271 (a) is embedded in Rule 271 of Bihar Building and Other Construction Worker (Regulation of Employment and Conditions of Service) Rule, 2005. For the first two deliveries of the wife of registered male construction worker, who is not registered under Board, a sum of Rs. 6,000/- (Six thousand) per delivery shall be given to registered male construction worker as Paternity Benefit. This shall be payable on the basis of birth certificate or certificate issued by the hospital for the delivery of the wife of registered construction worker and this will be additional to the grant under other Government schemes. An application for Paternity Benefit shall be submitted in Form – xxxiv(a). The benefits described in para 1 to 5 will be payable to registered and eligible construction workers under Board only. Other Conditions in respect of the above schemes, which are defined in the Bihar Building and Other Construction Workers (Regulation of Employment and Condition of Service) Rules, 2005 and Bihar Building and Other Construction Workers (Regulation of Employment and Condition of Service) (Amendment) Rules, 2016 will remain same.
