Sir, It is often observed that confusion prevails regarding the effect of judicial orders passed under the consolidation process after the promulgation of Section 6(1) of the Uttar Pradesh Consolidation of Holdings Act, 1953. However, necessary instructions have already been issued in this regard at the Directorate level through Circular No. 2101/G-415/2012-13 dated 09.04.2013. In this regard, the Hon'ble Revenue Council's letter No. E-2833/4- Miscellaneous/2011 dated 01.11.2012 has issued guidelines regarding the promulgation of Section 6(1) of the Uttar Pradesh Consolidation of Holdings Act in a village, when the consolidation process commenced in that village and the date on which Section 6(1) came into effect. Tehsil officials should be directed to comply with judicial orders passed during that period under Section 6(2) of the Act, as per the existing law. Section 6(2) of the Uttar Pradesh Consolidation of Land Holdings Act provides that when a notification regarding a block is cancelled under subsection (1), that area will cease to be subject to consolidation proceedings from the date of cancellation, subject to any final order relating to amendment of land records, if any, issued on or before the date of such notification. That is, on the date of promulgation of Section 6(1), all orders passed by the consolidation authorities relating to land records under the consolidation process, against which no appeal/monitoring is pending in a competent court and which have become final, will remain in effect. Therefore, in the above context, it is requested that necessary action be taken as per the provisions of Section 6(2) of the Uttar Pradesh Consolidation of Holdings Act, 1953 and the guidelines given in this regard in the letter dated 01.11.2012 of the Hon'ble Revenue Council.
