EXTRAORDINARY PUBLISHED BY AUTHORITY No. 133] NEW DELHI, TUESDAY, JANUARY 7, 2025/PAUSHA 17, 1946 MINISTRY OF ENVIRONMENT, FOREST AND CLIMATE CHANGE NOTIFICATION New Delhi, the 7th January, 2025 S.O. 135(E).⸺In exercise of the powers conferred by sub-section (3) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986) and in pursuance of the notification of the Government of India in the erstwhile Ministry of Environment and Forests, number S.O. 1533(E), dated the 14th September, 2006 (hereinafter referred to as the said notification), the Central Government hereby constitutes the State Level Environment Impact Assessment Authority, Chhattisgarh (hereinafter referred to as the Authority) comprising of the following persons, namely: ⸺ (i) Shri Polisetty Venkat Narsinga Rao, House No. HIG 2/809, Sector 29, Nava Raipur Atal Nagar (C.G.)- 492002 -Chairman; Professor, School of Studies in Biotechnology, Pt. Ravishankar Shukla University, Raipur Jadhav Niwas, Jai Hind Chowk, Rajatalab, Raipur – 492001 -Member; (iii) Member Secretary, Chhattisgarh Environment Conservation Board, Nava Raipur Atal Nagar -Member Secretary. 2. The Authority shall take its decision on the recommendations of the State Level Expert Appraisal Committees constituted under paragraph 4. 3. All decisions of the Authority shall be taken in a meeting and shall ordinarily be unanimous: Provided that, in case a decision is taken by majority, the details of views, for and against it, shall be clearly recorded in the minutes and a copy thereof sent to the Central Government. 4. The Central Government, in consultation with the State Government of Chhattisgarh, for the purpose of assisting the Authority, hereby constitutes following State Level Expert Appraisal Committees for the State of Chhattisgarh (hereinafter referred to as the Committees) comprising of the following persons, namely: State Level Expert Appraisal Committee-1 (i) Dr. Prakash Chandra Pandey, House No. 45, Officers Colony Dharampura, Near Radhaswami Satsang, Gate no. 1, Krishak Nagar, Raipur – 492012 (Chhattisgarh) -Chairman; Birgaon, Raipur – 493221 (Chhattisgarh) -Member; (iii) Shri Kishan Singh Dhruw, Raipur-492009 (Chhattisgarh) -Member; MIG-80, Maruti Vihar Colony, Mohababazar, Raipur – 492010 (Chhattisgarh) -Member; (v) Shri Suresh Chandra Sao, Flat No. 143, orchid, talpuri, B Block, Bhilai – 490006 (Chhattisgarh) -Member; (vi) Special Secretary or Joint Secretary or Deputy Secretary, Housing and Environment Department, Government of Chhattisgarh, Nava Raipur Atal Nagar -Member Secretary. The State Level Expert Appraisal Committees specified under column (2) of the Table shall exercise jurisdiction over districts specified in the corresponding entry under column (3) of the TABLE Sl.No. State Level Expert Appraisal Committee Area of jurisdiction 1. The Chairman and Members of the Authority, and the Committees, shall hold office for a period of three years from the date of publication of this notification in the Official Gazette. 7. The Authority and the Committees shall exercise such powers and follow such procedures as specified in the said notification. 8. In order to avoid any conflict of interest,⸺ (i) the Chairman and Members of the Authority and the Committees shall,⸺ (a) declare to which consulting organisation they have been associated with and also the project proponents; and (b) not undertake any consultation or associate with regard to preparation of Environment Impact Assessment and Environment Management Plan for project, which is to be decided by the Authority or to be appraised by the Committees during their tenure; and (ii) in the preceding five years, if the Chairman or any Member of the Authority and the Committees have provided consultancy services or conducted Environment Impact Assessment studies for any project proponent, in that event they shall recuse themselves from the meetings of the Authority or the Committees as the case may be, from the process of appraisal of any project proposed by such proponents. 9. The Committees shall function on the principle of collective responsibility and the Chairman shall endeavour to reach a consensus in each case, and if consensus cannot be reached, the views of the majority shall prevail. 10. The State Government of Chhattisgarh shall specify an agency to act as Secretariat of the Authority and the Committees which shall provide financial and logistic support, including accommodation, transportation and such other facilities in respect of their functions under the said notification. 11. The sitting fees, travelling allowances and dearness allowances to the Chairman and Members of the Authority and the Committees shall be paid in accordance with the provisions of relevant rules of the State Government of Chhattisgarh.
