11 Qjojh 2019 dqy & 100 vad 11 Qjojh 2019 The 11th February 2019 No. 6-N-07-35/2010-204(6)— In exercise of powers conferred by proviso to Article-309 of the Constitution of India, the Governor of Bihar is pleased to make the following Rules to regulate the appointment, promotion and service conditions in the Nurse cadre under the Health Department:- 1. Short title, extent and commencement.—(1) These Rules may be called the “Bihar Nurse Cadre Rules, 2019.” (2) It shall extend to the whole of the State of Bihar. (3) It shall come into force at once. 2. Definitions.— In these Rules, unless otherwise required in the subject or context- (i) ‘Government’ means Bihar State Government; (ii) ‘Department’ means Health Department; (iii) ‘Appointing Authority’ means Joint Director (Nursing), Nursing Directorate, Bihar in respect of Grade ‘A’ Nurse and Bihar State Government in respect of all higher posts; (iv) ‘G.N.M.’ means General Nursing and Midwifery; (v) ‘Commission’ means Bihar Technical Service Commission; (vi) ‘Cadre’ means Bihar Nurse Cadre; (vii) ‘Appendix’ means appendix appended to these Rules; and (viii) ‘Recognized Institutions’ means the institution recognized by the Indian Nursing Council, New Delhi/Health Department, Bihar, Patna for General Nursing Midwifery. 3. Constitution of cadre.—The cadre shall be at State Level. In this cadre, the number of posts in each category shall be such as may be sanctioned by the government, from time to time: 4. Chain of posts of cadre.— Different categories and chain of posts of this cadre shall be according to the appendix. 5. Recruitment.—The appointment in this cadre shall be made by direct recruitment to the basic category posts, on the basis of recommendation of the Commission. 6. Qualifications.— (1) For appointment by direct recruitment to the basic category posts, minimum educational qualifications shall be pass in General Nursing Midwifery training course of the period as determined by the Indian Nursing Council, from time to time, from a recognised institution and a certificate related thereto shall be necessary. Registration of candidates from Bihar Nurses Registration Council shall also be necessary. (2) For direct recruitment, minimum age limit shall be 21 years and maximum age limit shall be the same as determined reservation categorywise, from time to time, by the Government (General Administration Department): Provided that, for the purpose of giving opportunity of appointment to the Grade ‘A’ Nurse appointed and working on contractual basis in the Government Health Institutions of Bihar State, on being requisite qualifications determined under sub&rule (1), the maximum age limit may be relaxed, from time to time. (3) For the purpose of determining age, 1st August of the concerned year shall be deemed to be the cut off date. 7. Procedure of Recruitment.— (1) The appointing Authority, after calculating the vacancy on the basis of position as on 1st April of the year and getting roster cleared, shall send reservation categorywise requisition to the Commission by 30th April. (2) In view of the requisition, the Commission shall invite applications by advertising vacancies and shall prepare a merit list on the following basis:- (a) For marks obtained in G.N.M. course examination - 60 Marks (b) For higher course (if any) - 15 Marks (c) For working experience in Government hospitals of Bihar state - 25 Marks (5 Marks per year, maximum 25 marks) Total - 100 Marks Explanation:- The marks to be given to a candidate for G.N.M. course examination shall be determined by multiplying the percentage of total marks obtained in the aforesaid examination by the multiple of 0.6 For example, if a candidate has obtained 50% marks, then he will be given 50 X 0.6 ¾ 30 marks. (3) The Commission shall send merit list prepared on the basis of aforesaid sub-rule (2), and reservation categorywise recommendations in accordance with requisitioned vacancies to the Department. The Department will make the appointments after scrutiny of certificates of recommended candidates, conducting health check-up, verification of antecedents etc and after complying guidelines regarding appointment issued by the government (General Administration Department) from time to time. 8. Probation period.— After appointment, the probation period will be of two years. In case, the service during probation period is not found satisfactory, the probation period will be extended for one year. If the service is not found to be satisfactory in the extended period also, then the appointing authority may terminate the service of such Grade ‘A’ Nurse. 9. Departmental Examination.—The Grade ‘A’ Nurse shall have to pass the departmental examination conducted by the Central Examination Committee. The subject, syllabus and procedure of departmental examination shall be determined by the Board of Revenue, Bihar in consultation with the Department. 10. Confirmation.— On being satisfactory service during probation period and passing of the departmental examination, a Grade ‘A’ Nurse may be confirmed in the service. 11. Seniority.— The inter-se seniority of Grade ‘A’ Nurse shall be determined according to the merit list prepared by the Commission. 12. The personnels appointed/promoted and working before the commencement of these Rules on the posts of this cadre mentioned in appendix of these Rules shall be deemed to be automatically included in this cadre. 13. Chain of Posts of Promotion.— (1) Subject to the availability of vacancies and according to seniority cum merit, the Grade ‘A’ Nurse may be considered to be promotion to the next chain of the post of Ward Sister. (2) Matron/ Deputy Nursing Superintendent & This post shall be filled up by promotion from amongst Ward Sister on the basis of seniority-cum-merit, subject to availability of vacancy. (3) Nursing Superintendent & This post shall be filled up by promotion from amongst Matron/ Deputy Nursing Superintendent on the basis of seniority-cum-merit, subject to availability of vacancy. (4) For the consideration of promotion, compliance of instructions relating to the KALAWADHI, issued by the General Administration Department, from time to time, shall be necessary. Compliance of instructions issued by the General Administration Department, from time to time, with respect to promotion, CR or PAR, Sealed cover procedure etc shall be necessary. 14. Departmental Promotion Committee.— (1) Promotions will be considered on the basis of recommendations of the Departmental Promotion Committee. (2) The Departmental Promotion Committee will be constituted by the Department. 15. Reservation.—Compliance of provisions of Reservation Act of the Government and reservation roster for direct recruitment and promotion issued, from time to time, by the Government shall be necessary. 16. Delegation of Powers.— Cadre controlling authority may delegate some of his powers to Civil Surgeon-cum-Chief Medical Officer of the concerned district/Superintendant of concerned Medical College Hospital/Director of concerned Super Speciality Hospital. 17. Uniform.- It shall be compulsory for the Nurses to wear uniform during duty period as determined by the Department. 18. Residuary Matters.—For the subjects for which provisions have not been made in these Rules, provisions of concerned Code/Rules/Resolutions/Instructions shall apply. 19. Removal of Doubts.—If any doubt arises with respect to interpretation of any provision of these Rules, it shall be referred to the Department and in this respect the decision of the Department shall be final after consultation with the Law Department. 20. Removal of difficulties.—If any difficulty arises in implementation of provisions of these Rules, the matter shall be referred to the Department and the Department may remove such difficulty by such general or special order which is not inconsistent with the provisions of these Rules, after consultation with the Law Department and in this respect the decision of the Department shall be final. 21. Repeal and savings.— (1) The Bihar Nurse Cadre Rules, 2013 is hereby repealed. (2) Notwithstanding such repeal, anything done or any action taken under the said Rules shall be deemed to be done or taken under these Rules, as if these Rules were in force on the date on which such thing was done or such action was taken.
