No'Bashpake-061U0R-29/Labour-1.-In exercise ofthe powere conferred by the proviso to article 309 ofthe Constitution of India and in supersession of all existing rules, orderslr instruments made y pleased to make the following rules regulating lersn Joint Director of Steam Boilers and Deputy m.ent of the Directorate of Steam Boilers which is under the Induetries, Enerry and Labour Department of the Government ofMaharashtra. as follows:- 1. Tlreee rules may be called as the Directorof Steam Boilers, Joint Direetor of Stearn Boilere and Deputy Director of steam Boilers, Group-A (Recruitrnent) Rulee, zazL. 2. In these rules, unless the context requires otherwisen_ (a) "Act" means the Boilers Act, tr928 (b of 1g2B); (b) "Directorate'means the Direetorate of Stearn Boilers, Government of Maharashtra; (c) "Degree'means a degree in Mecharrical Engineering or Production Engineering or power Plant Engineering or L{etallurgical Engineering from a recognized University or equ-ivalent; (d) "Governrnent" means the Government of Maharashtra; - (e) "Reeognized Univereity or equivalent" means Central or State funded University or Inetitution, Engineering Cotrlege approved byAll lndia Council for Technical Education or priiate or Deemed University approved by the University Grants Commission, Institution of Engineers. 3. Appointment to the post of Director in the Directorate shall be made either,- (c) by promotion of a suitable person having minimum four years' experience as a Joint Director in the Directorate; or minimum eight years' total experi"J** r" a Joint Di'ector in the Directorate and as a Deputy Director in the Directorate; or minimum eight years, experience as a Deputy Director in the Directorate; or (b) bV nomination from amongst the candidates who._ (i) possese a degree; aud (ii) to.*u** ten years'experience in majagsrial capacity, in the design, constrlction, erectiono operation, testing, repair, raintenanc" oi itrup"ction of boilers or in the implementation of the Act and Rulee and Regulations framed thereunder: and (iri) is not more than 1'8 metere in height and not too stout to enter ellipticat rnanhole of size 305 mrrr x 406 mrn of boiler cornfortablv. 4. Appointment to the post of Joint Director in the Directorate shall be made either:- (a)by promotion of a stritable person having minimum four years' experience as a Deputy Director in the Directorate; or (b) by nomination frorn amongst the candidates rvh.o,- (a) possess a degr-ee; (li) possess six years'experience in managerial capacity in the design, construction, erection, operation, teeting, repairn maintenance or inspection of boilers or in the implementation of the Act and Rules and Regulations framed thereunder; and (i;1.;1* not more than 1.8 rneters in height and not too stout to enter elliptieal manhole of size 305 mm x 406 mm of boiler comfortably. 5. Appointment to the post of Deputy Director in the Directorate shall be made by nomination from arnongst the candidates u'ho,- (a) are uot rnore than thirty-elght year"s of age: Provided that, the age limit shall be relaxed upto five years in case of ttre candidates belonging to the reserved category: Provided further that, the maximurn age lirnit can be relaxed upto five years for the candidates working in Government: Provided further that, relaxation of five years shall be available to the reserved category Govemment employees either for being Gdvernm.ent employee or for belonging to the reserved category; (b) possess a degree; (c) possess two years' experience as a technical personnel in the design, constmction, erection, operation, testing, repair, maintenance or tnspection ofboilers or in the implernentation of the Act and Rules and Regulations framed thereunder; and (d) is not more than 1.8 metets in height and not too stout to enter elliptical manhole of size 305 mrr x 406 rnrn of boiler comfortably. 6. A persot appointed to the post mentioned in clause (b) of rrrle 3, 4 or 5 above shall be on probation for a period of two ye*rs. Probaticn period may be extended maximum upto one year. Person appointed to the said post shall be required to complete the plobation period satisfactorily. If he does not complete the probation period satisfactorily or is not found suitable for the post during the probation period he shall be liable to be terminatnd from service. V. A person appointed to the poat rnentioned in clause (b) of rule $, 4 or 5 above ehall be required to pass the examinations in Marathi and Hindi Langrages according to the rules made in that behalf, unless he has already passed or has been exempted from passing those examinations. A peason shall not be eligible for annual increment or for the promotion, until he passes examinations in Marathi and Hindi Language. 8. A person appointed to the post mentioned in clause (bi of rule 3, 4 or 5 above should possesses a Knowledge of Computer Operations as p€r the rules prescribed by the Government, frorn time to time, within the stipulated pericd, unless he has been exempted therefrom. A person shall not be eligibtre for annual increment or for the promotion, until he possess such a Iftrowledge of,Computer Operations as per the rrrles prescribed by the Government in that behalf. 9. A person appointed to the post rnentioned in clauses (b) of rule 3,4 or 5 above shall eubmit a declaration of Srnall Family aB per the provisions of the Maharashtra Civil services (Small Family Declaration) Rules, 2005 or any other rules made by the Govemment in that behalf, from time to time. 10" A person appointed to the post mentioned in rule 4 or 5 above shall be liable for transfer anywhere in the St&te of Maharashtra.
