Establishment of Gram Nyayalaya Trimbakeshwar, District Nashik

No. Gramanya 2015/CR 167/D-XIl.— In exercise of the powers conferred by sub- sections (1) and (2) of section 3 and section 5 of the Gram Nyayalaya Act, 2008 (4 of 2009), and in supersession of the earlier Notification, Law and Judiciary Department No. Gramanya. 2015/CR 167/D-XII, dated the 29th February, 2016 issued in this behalf, the Government of Maharashtra, after consultation with the High Court of Judicature at Bombay, hereby directs that, with effect from the 1st January, 2020.— (a) There shall be Gram Nyayalaya for the Village Panchayat at the intermediate level, i.e. Panchayat Samiti area Trimbakeshwar, (villages exclusively within Jurisdiction of Civil Judge, Junior Division, Nashik presently attached to Trimbakeshwar Taluka), sub-ordinate to the District Court of Nashik, in Nashik District, (b) The said Gram Nyayalaya shall be presided over by the Civil Judge (Junior Division) and Judicial Magistrate (First Class), Court No.1 Nashik, Taluka Nashik, as a Nyayadhikari (till regular appointments are made), who shall periodically visit the villages falling under his jurisdiction and conduct trial and proceedings at any place which he considers to be in close proximity to the place where parties ordinarily reside in terms of Section 9 of the Gram Nyayalayas Act, 2008, after consultation with the Principal District and Sessions Judge, Nashik. (c) The Civil Judge (Junior Division), Court No. 1, Nashik, Nashik Taluka as a Nyayadhikari shall have jurisdiction to try all suits and proceedings of a Civil nature falling under the classes of disputes specifies in Part-l 006 Second Schedule and try all classes of claims and disputes which may be notified by the Central Government under sub-section (1) of section 14 and by the State Government under sub- section (3) of section 14 of the Gram Nyayalayas Act, 2008. The Judicial Magistrate (First Class), Court No.1, Nashik as a Nyayadhikari may take cognizance of an offence on a complaint or on a police report and shall try all 080085 specified in part-| of the First Schedule and try all such offences and grant relief, if any, specified under enactments included in Part-1l of that Schedule of the Gram Nyayalayas Act, 2008, and shall also try all such offences or grant such relief under the State Acts which may be 00160 by the State Government under sub-section (3) of section 14 of the said Act. (d) The local limits of the ordinary jurisdiction of Nyayadhikari, Trimbakeswhar shall comprise of क्षा the village Panchayat at the intermediate level i. e. Panchayat Samiti area of Trimbakeshwar, District Nashik.
