'lt it "iA-* No. F-5-4-2012-LVIII-ID exercise of the poweN conferred bv sub sectio (2) of Seclion 2l of lhe Madhya P€desh Phal-Paudh Ropani (\4niyaman) Adhiniyam, 2010 (No. 3 of 20ll), the Stale Governmeni' hereby' makes the following rules, lhe same having been previously published in the Madhya Pradesh Gazetle dated 20th January 2012 as rcquired by sub-section (l) of Secrion 2l of the said Adhiniyam, namely :- RULES (Viniyanan) Rules 2012. (2) They shall come inlo force from the date of publication in the Madhya Pmdesh Gazette' 2. Definttions.-(1) In these rules unless the Conaext otherwise requires'- (a) "Act" means the Madhya Pradesh Phai Paudh Ropani (Vinivaman) Adhiniyan\ 2010 (No 3 of 20ll)! (b) 'Competent authodty" means a coinpelent aulhorjty appointed under Section 3 of the Ac! and who shall be ' Deputy Dir€cto/Assistant Director, Horticuhure posted in the respeciive district (c) "Se.tioD" means sectron of the Act; (d) "Form" means forms appended to ths6 rules (e) "working area" means entire district 2. Words and expressions used in these rules but not defined in the Act shall have the same meanings as assigned to them in the Act. 3. OwDer of nursery to ob;in ficence.*Any owler of a fruilplanl nursery desires to conduct or carry on the busin€ss of the fruit plant nunery shall obtain a licence under these rules folm A to the compeient authority for grant of licence (2) The owner of Government nrusery shall also make an apPlication to the competent authority for gmnt of licence. 5. Fee for grant of licence.-(i) The owner of a nursery shall deposit, the licence fee of Rs 1000/- (One thousand) for the nursery having the area of two hectares of land and Rs. 2000/_ (two thousand) for the nursery the ateu ol wlict is -or" *an two hectared of land, in the ofrice of the Assistant Director. horticulturc and shall obtain the ofEcial receipt of the deposited amount. (2) No licence feo shall be payable for the nursedes of the Government Departmenl' Govemment undetaking which includes local bodies, Krishi Vishwavidyalaya and Krishi Vigyan Kendras' ' 6. Graut of Lic€nce.-(l) The competent authodty on receipl of aPplication alongwith documents being satisfied that all the alocuments fulfill the requAement, may grant a licence in the Form B to the applicant' (2) The duration of licence shall be three vears hom the date specifled in the licence' 7. Renewd of lic€nce.-(l) The owner of fruit plant nursery shall make an application in Form C for the rene\tal of licence, (2) The compeient authoDty mat on application being made !o him in that behalf ienew the licence for the requisite period on payment of Rs. 1000/- (one tho$and) as renewal fee [ \rr 4 (r) (3) No fee for renewal of licence shall be payable by the olvDer of Governmeoi fruil planl nursery (4) The application for renewal of a licence shrll be made to the competeni autboriiy at lenst three monhs before the date of expiry of the existing licence' (5) The competent authority shall renew the licenca before the expiry of the period of exisling licence The *d;;il;r; ;.y reject the application for rene al and intimaiion thereof shall be sent to the appiicant (6) No application of renewat ibr lrcence shall be entertained after the expiry of the period of licence' 8. Duplicate copy of licmce.-lf a licences granted to an owner is lost' mutilated or damaged' stolen or aestroyea, te competeni authority shall on payment of Rs 50O (Rupees Five Hundred)' issue duplicate licence' 9. Suspension or cancellstlon oflic€nce -(l) The competent authority shall have powet to suspeno or cance) any licence granted under these rules for contlavention of any of the rules: Provided that the competent authority shall give ihe licencee on aPportunity to sbow cause before taking any action or passing any order under these rules. (2) Notwithstanding anything contarned in sub-rule (1), the licence shall be liable to immediare suspension or "o*it *t auilority, if rhe place is insufircient or is causing danger to the safetv or health or inconvenience to the Public. 10. Licenc€ not transferable -A lrcence granted under these rules shall not be transferable aod after the death of the ticensee it shall be deemed to be revoked 12. permission to include or remove plants.-If the owner of a fruit plant nursery desires to include plants id the nufery or remove some plants fmm ti,e nursery he shall make an.apPlication in Form D to the competent authority for permission.
