JUDGMENT

This original petition is filed for a direction to the Sub

Court, Kollam, to dispose of EP No.55/2023 at the earliest within a time frame.

The petitioner is the decree holder, and he had

filed EP No.55/2023 to execute the decree. Against the

¶55

judgment and decree in OS No.352/2010, an appeal was preferred, and the appeal was dismissed as per Ext.P3.

A report was called for, and a report dated

07.03.2025 is received, wherein it is stated that there are 16 judgment debtors; out of them, the relief is sought against the judgment debtors 1 to 11 only. The 11^th judgment debtor is no

more. Hence, the decree holder has filed an application to

¶59

implead the legal heirs on 07.02.2025 and it is posted to

¶60

21.03.2025 for consideration. The Additional Sub Judge has

¶61

requested six months' time, excluding the summer vacation, to

dispose of the case.

Taking into consideration the facts and circumstances of

the case and the report, I direct the Sub Judge, Kollam, to
