JUDGMENT

¶28

The present contempt petition has been filed alleging the willful disobedience or non-compliance of the judgment dated 15.01.2024 passed in W.P© No. 16241/2023. This court allows the said writ petition.

Paragraph 7 of the judgment would read as under:-

“7. Though notice of this court was served on 5th respondent, he has not chosen to contest the Writ Petition. In the result, the Writ Petition is allowed and it is declared that the petitioner is entitled to all the benefits in the cadre of Asst. Professor including AGP from 26.5.2015, the day on which he was appointed as per Ext.P1 with all consequential monetary benefits flowing out of it. Orders shall be passed by the respondents as declared above, within a period of 2 months from the date of receipt of a copy of this judgment.”

2.In pursuance of the notice issued in this contempt petition,

an affidavit of compliance has been filed by the contemnor annexing the order dated 03.04.2024, whereby, the amount due to the petitioner in compliance with the judgment dated

15.01.2024 has been sanctioned.

3.The learned counsel for the respondent/contemnor submits that the payment will be made to the petitioner once the office of the Director, Institute of Integrated Medical Science, Palakkad, sents the bill to the treasury. It is further submitted that the order sanctioning the amount has already been passed, and now procedural aspects must be complied with by the office of the Director, Institute of Integrated Medical Science, Palakkad.

I have heard Ms. L.Annapoorna, the learned counsel for the petitioner and Ms. Latha T Thankappan, the learned Special Government Pleader (SC/ST).

Considering the aforesaid order and affidavit dated 03.04.2024 (Exts.R2(a) & R2(b), the present contempt petition is closed, with directions to the Director, Institute of Integrated Medical Science, Palakkad, to send the bill for payment of the dues of the petitioner as sanctioned by the order dated 03.04.2024. The director must ensure that the bill is send to the treasury within fifteen days from today. The petitioner and the learned Special Government Pleader (SC/ST) appearing for the
